Measures of Suzhou Municipality for the Administration of the Use and Maintenance of Civil Air Defense Works

chapter I general provisions article 1 in order to strengthen the maintenance, management, development and use of civil air defense (hereinafter referred to as civil air defense) projects and ensure that they can give full play to their roles in wartime, these measures are formulated in accordance with the regulations on civil air defense and the regulations on the maintenance and management of civil air defense projects promulgated by the State Council and the Central Military Commission, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the use, maintenance and management of all kinds of civil air defense projects and their ancillary facilities in this Municipality.

Article 4 Suzhou Civil Air Defense Office (hereinafter referred to as the Municipal Civil Air Defense Office) is the competent authority for the use, maintenance and management of civil air defense projects in the whole city.

Article 5 The use, maintenance and management of civil air defense projects shall be based on the principle of "compartmentalization, block-oriented, unified guidance and division of responsibilities". Article 6 Departments of construction, planning, public security, industry and commerce shall, according to their respective responsibilities, cooperate with civil air defense departments to do a good job in the use, maintenance and management of civil air defense projects. Chapter II Peacetime Use Article 9 Existing usable civil air defense projects shall be developed and used by civil air defense project management departments at all levels, which may be used for their own use, leased or jointly developed with foreign investors to give full play to their social and economic benefits. Article 12 Units and individuals, as well as Hong Kong, Macao, Taiwan compatriots and foreign businessmen, are encouraged to develop and utilize civil air defense projects and their ancillary facilities, set up industries or tertiary industries and high-tech industries adapted to the underground environment, and enjoy the civil air defense industry and relevant preferential policies. Thirteenth long-term non-use of civil air defense projects, the civil air defense office has the right to make unified arrangements for the use. If the civil air defense project is adjusted for use by other units, the unit where it belongs shall handle the transfer procedures well, and provide convenience for the users in terms of access, air intake and exhaust holes, water sources and power supply, and share the economic benefits. Fourteenth the use of civil air defense projects must be based on the nature of their use, in accordance with the relevant provisions of the civil air defense, public security, fire protection, industry and commerce, taxation and other departments to go through the formalities. Fifteenth users of civil air defense engineering staff, should be based on different working conditions, in accordance with the relevant provisions of the necessary labor protection supplies and health care costs (underground work allowance). The required expenses shall be paid by the user in the production and operation costs or income. Chapter III Maintenance and Management Article 16 All units and individuals must abide by the following provisions:

(1) No waste water, waste gas, waste, garbage and excrement shall be discharged or dumped into the interior of civil air defense projects and their entrances and exits or near air intake and exhaust holes;

(2) It is forbidden to borrow soil, bury pipelines and build ground engineering facilities within the scope that endangers the safety of civil air defense projects. Construction units that really need to build ground engineering facilities must be approved by the Civil Air Defense Office, and a distance of collapse radius (half the height of the building) should be set aside. The planning department shall issue the construction project planning permit with the approval document of the Civil Defense Office;

(3) inflammable, explosive, toxic, radioactive and corrosive dangerous and harmful articles shall not be stored in civil air defense works;

(four) shall not be damaged and unauthorized occupation, renovation, sealing civil air defense projects;

(5) it is forbidden to open holes in external walls, partition walls, door frame walls, airport walls and other places where fortifications require protection and sealing without authorization. Units that really need to open holes must apply to the civil air defense office in advance, and the design and construction departments shall provide the treatment measures for the protective and airtight performance of the project, and the construction can be carried out only after approval. Article 17 Civil air defense project management departments at all levels shall establish archives for civil air defense projects and their ancillary facilities within the management scope, and improve the management system of civil air defense projects. Relevant information on the use, maintenance and management of civil air defense projects shall be regularly reported to the civil air defense project management departments at higher levels. Eighteenth new civil air defense project is completed, the construction unit shall, in conjunction with the construction, design units and civil air defense office, in accordance with the design drawings for acceptance. After passing the acceptance and handling the handover procedures, it will be managed by the Civil Air Defense Office.
