Regulations of Qinghai Province on Poverty Alleviation and Development in Rural and Pastoral Areas

Chapter I General Provisions Article 1 In order to promote and standardize poverty alleviation and development activities in rural and pastoral areas, accelerate economic and social development in poverty-stricken areas, narrow the development gap and achieve common prosperity, these Regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to poverty alleviation and development activities in rural and pastoral areas within the administrative region of this province.

The term "poverty alleviation and development" as mentioned in these Regulations refers to the activities of the people's governments at all levels in this province and all sectors of society to help the poor improve their production and living conditions, enhance their development capabilities and achieve poverty alleviation through policy support, capital investment, project support and technical services. Article 3 Poverty alleviation and development should adhere to the policy of development-oriented poverty alleviation and follow the principles of government leadership, social participation, self-reliance and precise poverty alleviation. Fourth people's governments at or above the county level shall be responsible for poverty alleviation and development within their respective administrative areas, and establish and improve the target responsibility and assessment system for poverty alleviation and development.

The administrative departments for poverty alleviation and development of the people's governments at or above the county level shall be responsible for special poverty alleviation and development work, and coordinate industry poverty alleviation and social poverty alleviation work. Other relevant departments shall, in accordance with their respective responsibilities, do a good job in poverty alleviation in the industry. Fifth people's governments at or above the county level shall incorporate poverty alleviation and development into the national economic and social development plan, and organize the formulation of poverty alleviation and development plans within their respective administrative areas. Sixth people's governments at or above the county level shall strengthen the construction of poverty alleviation and development institutions, improve their work functions, and improve their service capacity and management level. Article 7 People's governments at all levels should strengthen the propaganda of poverty alleviation and development, create a good atmosphere for the whole society to participate in poverty alleviation and development, and guide the poor people to improve their self-development ability and realize poverty alleviation independently.

The people's governments at or above the county level and their administrative departments for poverty alleviation and development shall commend and reward the units and individuals that have made remarkable achievements in poverty alleviation and development. Chapter II Target and Scope of Poverty Alleviation Article 8 The target of poverty alleviation refers to the residents in rural and pastoral areas who are below the poverty alleviation standard.

The scope of poverty alleviation and development includes poor households, poor villages, key counties for poverty alleviation and development, and concentrated contiguous areas with special difficulties. Article 9 The administrative department in charge of poverty alleviation and development of the provincial people's government shall, jointly with relevant departments, formulate poverty alleviation standards of this province that are not lower than the national poverty alleviation standards, submit them to the provincial people's government for approval, and announce them to the public.

Poverty alleviation standards in rural and pastoral areas are adjusted in a timely manner according to economic and social development. Tenth people's governments at the county level shall, in accordance with the national and provincial poverty alleviation standards and procedures, identify poor villages and poor households.

The list of poverty-stricken villages and poor households identified shall be reported to the administrative department of poverty alleviation and development for the record. Article 11 People's governments at all levels shall give priority to supporting special groups among the poor, such as martyrs, disabled people and families who have lost their families. Twelfth administrative departments of poverty alleviation and development of the provincial people's government shall establish a poverty alleviation and development information network system.

The administrative department of poverty alleviation and development of the people's government at the county level shall establish files for poor villages and poor households, improve information files in a timely manner, and implement dynamic management.

Poverty-stricken villages and poor households should truthfully provide the information needed to set up a card. Article 13 No organization or individual may cheat the preferential policies for poverty alleviation and development, obtain economic benefits and infringe upon the legitimate rights and interests of poverty alleviation and development targets by resorting to fraud or concealing income. Fourteenth meet the following conditions should be identified as the object of poverty alleviation:

(1) Poor villages have achieved the goal of poverty alleviation and development;

(2) With the help of poor households, the economic income exceeds the poverty alleviation standard of rural and pastoral areas of the provincial government, and there is a stable source of economic income. Fifteenth national poverty alleviation and development key counties, concentrated contiguous areas with special difficulties to determine and withdraw, in accordance with the relevant provisions of the state and the province. Chapter III Working Mechanism of Poverty Alleviation and Development Article 16 People's governments at all levels shall establish a precise poverty alleviation mechanism, make comprehensive policies, give classified guidance, implement accurate identification, accurate assistance, accurate management and accurate assessment, and ensure that poverty alleviation reaches villages and benefits households. Article 17 People's governments at or above the county level shall establish a coordination and promotion mechanism, strengthen work linkage through the joint meeting system, and coordinate relevant departments to focus on contiguous areas with special difficulties, key counties for poverty alleviation and development, and poverty alleviation targets when formulating policies, making plans, allocating funds, and arranging projects, so as to optimize the allocation of poverty alleviation resources and form a joint force for poverty alleviation and development. Eighteenth people's governments at all levels should innovate the social participation mechanism, formulate incentive measures, establish a platform for social poverty alleviation information exchange, and provide services for units and individuals involved in poverty alleviation cooperation, designated poverty alleviation, social assistance and other activities. Nineteenth people's governments at or above the county level shall improve the financial service mechanism, build a financing platform, innovate financial products and services, improve the credit system, and encourage and guide financial capital to invest in poverty alleviation and development. Twentieth provincial people's government should improve the assessment mechanism of poverty-stricken counties, take poverty alleviation and development as the main content of the assessment of economic and social development in poverty-stricken counties, scientifically set assessment indicators for poverty alleviation and development, and pay attention to the application of assessment results. Twenty-first people's governments at or above the county level shall establish and improve the supervision and restraint mechanism for poverty alleviation and development, give play to the supervisory role of auditing and supervision departments, and ensure the safe and effective use of funds for poverty alleviation projects. Chapter IV Measures for Poverty Alleviation and Development Article 22 The administrative departments for poverty alleviation and development of the people's governments at or above the county level shall organize the formulation and implementation of special poverty alleviation work plans according to the poverty alleviation and development plans formulated by the people's governments at the corresponding levels.

The industry planning of the relevant departments of the people's governments at or above the county level shall be linked with the poverty alleviation and development planning within their respective administrative areas, and the annual industry poverty alleviation plan shall be formulated, giving priority to industry poverty alleviation projects.
