Conditions for appointment and dismissal of personnel in Yulin City

Article 1 These Provisions are formulated in accordance with the relevant provisions of the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at All Levels, the Organic Law of People's Republic of China (PRC) People's Courts, the Organic Law of People's Republic of China (PRC) People's Procuratorate and the Regulations on the Selection and Appointment of Leading Cadres of the Party and Government, with reference to the Measures of the Standing Committee of Shaanxi Provincial People's Congress for the Appointment and Dismissal of Staff of State Organs, and combined with the actual situation of our city.

Article 2 The Standing Committee of the Municipal People's Congress appoints and dismisses the staff of state organs and adheres to the principle of the Party managing cadres; Adhere to the principle of meritocracy, having both ability and political integrity, being recognized by the masses and paying attention to performance; Adhere to the principle of giving full play to democracy and acting in strict accordance with the law.

Article 3 These Measures shall apply to the appointment and removal by the Standing Committee of the Municipal People's Congress of the relevant personnel of the Standing Committee of the Municipal People's Congress, the Special Committee of the Municipal People's Congress, the Municipal People's Government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate.

Article 4 The Standing Committee of the Municipal People's Congress shall appoint or remove the functionaries of state organs according to the following procedures:

(1) Nominated by the meeting of directors of the Standing Committee of the Municipal People's Congress, the mayor of the Municipal People's Government, the president of the Municipal Intermediate People's Court and the procurator-general of the Municipal People's Procuratorate respectively. Nominations should be made in writing.

(2) Pre-service legal knowledge examination. The examination contents mainly include the Constitution of People's Republic of China (PRC), the Organic Law of Local People's Congresses and Local People's Governments at Various Levels in People's Republic of China (PRC), the Election Law of the National People's Congress and Local People's Congresses of the People's Republic of China, the Supervision Law of the Standing Committees of People's Congresses at Various Levels, the Theory of People's Congress System, and laws and regulations related to the positions to be held. Those who fail to take the exam without reason will not be appointed; Those who fail to take the exam or fail to pass the exam for some reason will be suspended from appointment; Those who fail the make-up exam will not be hired.

(III) When the former Standing Committee of the Municipal People's Congress or the meeting of directors deems it necessary, it may instruct the relevant working bodies of the Standing Committee to understand and inspect the personnel appointed or removed by the Municipal Intermediate People's Court and the Municipal People's Procuratorate.

Article 5 The posts of members of the Credentials Committee of the Standing Committee of the Municipal People's Congress, deputy secretary-general of the Standing Committee, directors and deputy directors of various working committees shall be nominated by the meeting of directors, and the Standing Committee shall appoint and remove them.

When the Municipal People's Congress is not in session, the special committees of the Municipal People's Congress need to supplement individual vice-chairmen and some members, and the Standing Committee shall nominate and appoint them according to the meeting of directors.

Article 6 When the director of the Standing Committee of the Municipal People's Congress is unable to work or absent due to illness, the Standing Committee shall elect one of the deputy directors to act as the director until the director recovers health or the Municipal People's Congress elects a new director.

Article 7 The Secretary-General, Director and Director of the Municipal People's Government shall be appointed and removed by the mayor to the Standing Committee of the Municipal People's Congress.

Eighth when the Municipal People's Congress is not in session, according to the nomination of the mayor, the Standing Committee decides the individual appointment and removal of the deputy mayor; When the mayor is unable to hold the post for some reason, the Standing Committee shall decide to hold the post of mayor from among the deputy mayors upon nomination by the meeting of directors.

Article 9 The vice-president of the Municipal Intermediate People's Court, members of the judicial committee, the president, vice-presidents and judges shall be submitted by the president of the Municipal Intermediate People's Court to the Standing Committee of the Municipal People's Congress for appointment and removal.

Tenth when the Municipal People's Congress is not in session, if the president of the Municipal Intermediate People's Court is unable to hold his post for some reason, the Standing Committee shall decide to act as the acting president among the vice presidents upon the nomination of the directors' meeting.

Article 11 The Deputy Procurator-General of the Municipal People's Procuratorate, members of the Procuratorial Committee and procurators shall be appointed and removed by the Procurator-General of the Municipal People's Procuratorate to the Standing Committee of the Municipal People's Congress.

After the chief procurator of the county (city, district) people's procuratorate is elected by the people's congress at the corresponding level, the people's procuratorate at the corresponding level shall submit it to the chief procurator of the Municipal People's Procuratorate for approval and appointment by the Standing Committee of the Municipal People's Congress.

Article 12 When the Municipal People's Congress is not in session, if the chief procurator of the Municipal People's Procuratorate is unable to hold his post for some reason, the Standing Committee shall decide to be the chief procurator from among the deputy chief procurators on the nomination of the meeting of directors, and the Standing Committee and the Municipal People's Procuratorate shall report to the Standing Committee of the Provincial People's Congress and the Provincial People's Procuratorate respectively for the record.

The procurator-general of the county (city, district) people's procuratorate decided by the Standing Committee of the county (city, district) people's congress shall be reported to the Standing Committee of the Municipal People's Congress and the Municipal People's Procuratorate respectively for the record.

Article 13 Members of the Standing Committee of the Municipal People's Congress, members of special committees of the Municipal People's Congress, mayors, deputy mayors, presidents of the Municipal Intermediate People's Court and chief procurators of the Municipal People's Procuratorate may submit their resignations to the Standing Committee when the Municipal People's Congress is not in session, and the Standing Committee shall decide whether to accept their resignations. After the Standing Committee decides to accept the resignation, it shall report to the Municipal People's Congress for the record.

After the Standing Committee of the Municipal People's Congress decided to accept the resignation of the chief procurator of the Municipal People's Procuratorate, the chief procurator of the Municipal People's Procuratorate submitted it to the Standing Committee of the Provincial People's Congress for approval.

When other personnel appointed by the Standing Committee of the Municipal People's Congress resign, they shall be reported to the competent authority for approval and submitted to the Standing Committee for approval.

Fourteenth leaders of the new Municipal People's Government shall be submitted to the Standing Committee of the Municipal People's Congress for appointment of the Secretary-General, Director and Committee Director of the Municipal People's Government within two months after being elected according to law. Deputy Secretary-General of the Standing Committee of the Municipal People's Congress, heads of working committees and other offices, vice-presidents of the Municipal Intermediate People's Court, members of judicial committees, presidents, vice-presidents and judges, deputy procurators of the Municipal People's Procuratorate, members of procuratorial committees and procurators are not re-elected.

Fifteenth people appointed by the Standing Committee of the National People's Congress, after the change or cancellation of the organization, their posts will naturally be eliminated and they will no longer go through the dismissal procedures; After the name of the institution is changed, it shall be re-appointed by the Standing Committee.

Sixteenth Municipal People's Congress is not in session, the Standing Committee decided to revoke the position of individual deputy mayors; Decided to remove other members of the people's government at the corresponding level appointed by him, as well as the vice president of the Municipal Intermediate People's Court, members of the judicial committee, the president, vice president, judges, deputy procurator-general of the Municipal People's Procuratorate, members of the procuratorial committee and procurators.

Article 17 When the Municipal People's Congress is not in session, if the Standing Committee deems it necessary to replace the President of the Municipal Intermediate People's Court, the Standing Committee of the Provincial People's Congress shall submit it to the Provincial Higher People's Court for approval.

Eighteenth members of the Standing Committee of the Municipal People's Congress, members of the special committees of the Municipal People's Congress, shall not hold the positions of state administrative organs, judicial organs and procuratorial organs; Those who hold the above positions must resign as members of the Standing Committee and the special committees.

Article 19 The functionaries of state organs appointed or removed by the Standing Committee of the Municipal People's Congress shall be carefully understood and inspected by the requesting organ, and the appointment and removal report, cadre appointment and removal report and inspection materials shall be submitted to the Standing Committee in triplicate ten days before the meeting of the Standing Committee is held.

Where it is required to appoint the person-in-charge of a newly established institution, a document approving the establishment of the institution by a higher authority shall be attached.

Twentieth submitted to the Standing Committee of the Municipal People's Congress for deliberation, the meeting of directors of the Standing Committee shall decide whether to include it in the draft agenda of the meeting of the Standing Committee.

Article 21 When the Standing Committee of the Municipal People's Congress deliberates on the appointment and removal of personnel, it shall submit the appointed personnel or the person in charge of the relevant department to the meeting to introduce the appointed personnel. The appointed personnel shall meet with the members of the Standing Committee and answer questions raised by the members of the Standing Committee.

Article 22 The Standing Committee of the Municipal People's Congress shall appoint personnel, decide on agents and revoke their posts, and vote by voting machine or secret ballot. Dismissal and acceptance of resignation are decided by a show of hands.

Article 23 When voting by secret ballot, several scrutineers and tellers are responsible for scrutinizing and counting votes. The scrutineers shall be nominated by the meeting host from among the members of the Standing Committee attending the meeting, and with the consent of the people present, the tellers shall be the meeting staff.

If the number of votes is equal to or less than the number of voters, the vote is valid; If it is more than the number of voters, the vote is invalid and needs to be re-voted.

Article 24 The Standing Committee of the Municipal People's Congress shall decide on the appointment and removal of personnel, which shall be adopted by a majority of all its members.

Article 25 The functionaries of state organs appointed or removed by the Standing Committee of the Municipal People's Congress shall not take up their posts or leave their posts without approval, and the submitting organs and other units shall not publish them. The appointment and removal time shall be subject to the time adopted by the Standing Committee meeting.

Article 26 The functionaries of state organs appointed or removed by the Standing Committee of the Municipal People's Congress shall be directly announced by the Standing Committee, and the appointment and removal organ shall be notified in writing.

Twenty-seventh national staff appointed by the Standing Committee of the Municipal People's Congress shall be issued by the Standing Committee.

Twenty-eighth Municipal People's Congress Standing Committee on the election of personnel representatives shall establish a unified "notification file" for the staff of state organs appointed by the Standing Committee to perform their duties during their tenure.

Article 29 These Measures shall come into force as of the date of adoption.
