Although the judicial police under the appointment system are not civil servants, they can wear standard police uniforms and police insignia and exercise judicial powers. However, the assisting police cannot wear standard police uniforms and police insignia and cannot exercise them alone. Judicial power can only assist the police in their work. This is the essential difference between the two!
Article 2 of the "Interim Measures for the Trial Implementation of the Appointment System for Judicial Police in People's Courts" (Fafa [2001] No. 19) stipulates:
The appointment system for judicial police refers to the use of judicial police by the people's courts determined by the state. The political and legal administrative establishment or the fiscal allocation establishment approved by the local government shall openly recruit cadres from the public who pass the examination and assessment and be included in the contract-based appointment system. Article 9 stipulates: Judicial police officers under the people's court appointment system who perform particularly well, have outstanding achievements, and meet the requirements of national civil servants shall go through the recruitment procedures in accordance with the relevant provisions of national civil servants and be converted into formal cadres. Article 15 stipulates: Judicial police officers under the employment system shall wear police uniforms and police insignia, and shall be assigned police ranks in accordance with the relevant provisions of the "Regulations on Police Ranks of the People's Republic of China". Article 19 stipulates: If a judicial police officer under the appointment system is evaluated as outstanding for two consecutive years during the appointment period, his salary shall be promoted in accordance with relevant regulations.
The assisting police force is positioned as an "auxiliary" police force. It is a professional mass prevention and control team and does not have administrative law enforcement power. In terms of institutional nature, although the police assistance team is a fiscally subsidized public institution, it is not a first-level authorized joint defense team. The assisting police must carry out various tasks under the leadership of the existing civilian police.
