"Provisional Regulations on Human Resources Market" stipulates that

Article 1 In order to regulate the market activities of human resources, promote the rational flow and optimal allocation of human resources, and promote employment and entrepreneurship, these Regulations are formulated in accordance with the Employment Promotion Law of People's Republic of China (PRC) and relevant laws.

Article 2 These Regulations shall apply to job hunting, recruitment and human resources services conducted through the human resources market in People's Republic of China (PRC).

Where laws, administrative regulations and the State Council have other provisions on job hunting, recruitment and human resources services, those provisions shall prevail.

Article 3 The principles of legality, fairness, honesty and credibility shall be followed in job hunting, recruitment and provision of human resources services through the human resources market.

Article 4 The administrative department of human resources and social security of the State Council is responsible for the overall planning and comprehensive management of the national human resources market.

The administrative departments of human resources and social security of local people's governments at or above the county level shall be responsible for the management of human resources market within their respective administrative areas.

The relevant departments of the people's governments at or above the county level, such as development and reform, education, public security, finance, commerce, taxation, market supervision and management, shall do a good job in the management of the human resources market within their respective functions and duties.

Article 5 The State shall strengthen the standardization of human resources services and give full play to the role of human resources service standards in industry guidance, service standardization and market supervision.

Article 6 Human resources service industry associations shall, in accordance with laws, regulations, rules and their articles of association, formulate industry self-discipline norms, promote the construction of industry integrity, improve service quality, guide and supervise the human resources service activities of members, safeguard their legitimate rights and interests according to law, reflect their demands, and promote fair competition in the industry.

Chapter II Cultivation of Human Resources Market

Article 7 The State shall establish a unified, open and competitive human resources market system, give full play to the decisive role of the market in the allocation of human resources, improve the human resources development mechanism, stimulate the vitality of human resources innovation and entrepreneurship, and promote the prosperity and development of the human resources market.

Legal basis:

Article 20 Where a business human resources service institution establishes a branch, it shall report in writing to the administrative department of human resources and social security where the branch is located within 15 days from the date of completing the industrial and commercial registration.

Article 21 Where a business human resources service institution changes its name, domicile, legal representative or terminates its business activities, it shall report to the administrative department of human resources and social security in writing within 15 days from the date of completing the industrial and commercial change or cancellation of registration.

Twenty-second human resources and social security administrative departments shall promptly announce to the public the list of operating human resources service institutions that have obtained administrative licenses or put on record, as well as their changes and extensions.

Chapter IV Standardizing Human Resources Market Activities

Twenty-third individuals to apply for a job, should truthfully provide their own basic situation and job-related knowledge, skills, work experience and other information.

Twenty-fourth basic information of the unit, recruitment number, recruitment conditions, work content, work place, basic labor remuneration and other recruitment information. The information released by the employer or provided to the human resources service institution shall be true and lawful, and shall not contain any discriminatory content such as nationality, race, gender or religious belief.

If the employer needs to establish labor relations with the employees independently, it shall conclude labor contracts with the employees according to law, and go through social insurance and other related procedures in accordance with the relevant provisions of the state.

Twenty-fifth human resources flow, should abide by the provisions of laws and regulations on service period, employment restrictions, confidentiality and other aspects.

Article 26 When accepting the recruitment entrusted by the employer, the human resources service institution shall require the employer to provide the recruitment brochure, business license or documents approved by the relevant departments, the identity certificate of the agent and the entrustment certificate of the employer, and review the authenticity and legality of the materials provided.

Twenty-seventh human resources service institutions shall not resort to fraud, violence, coercion and other improper means to seek illegitimate interests in the name of recruitment when accepting the recruitment of employers or providing other human resources services, and shall not introduce units or individuals to engage in illegal activities.

Article 28 When holding on-site job fairs, human resources service institutions shall formulate organizational implementation measures, emergency plans and security work plans, verify the authenticity and legality of recruitment units and their recruitment brochures participating in job fairs, announce job fair information to the public in advance, and manage various activities in recruitment.

Holding large-scale on-site job fairs shall comply with the provisions of laws and regulations such as the Regulations on Safety Management of Large-scale Mass Activities.
