Rewards for Personnel with Merit in Reporting the Production and Sale of Counterfeit and Substandard Drugs in Liaoning Province Measures

Article 1 is to severely crack down on the illegal and criminal activities of producing and selling counterfeit and substandard drugs, and encourage citizens, legal persons and other organizations to actively report. According to the "Reporting" jointly formulated by the State Food and Drug Administration and the Ministry of Finance Measures for Rewarding Personnel Who Have Contributed to the Production and Sale of Counterfeit and Substandard Drugs" to formulate these measures.

Article 2: These measures apply to reporting cases accepted and directly investigated and dealt with by the food and drug regulatory authorities (drug regulatory authorities) at all levels in the province, and rewards will be given to those who report meritoriously.

Article 3: The food and drug supervision and administration department (drug supervision and administration department) responsible for investigating reported matters and imposing penalties on illegal acts in accordance with the law shall reward those who have made meritorious reports in accordance with the provisions of these Measures.

Article 4: Persons with meritorious service in reporting (hereinafter referred to as whistleblowers) refer to those who report illegal and criminal production and sales of counterfeit and substandard drugs to the food and drug regulatory authorities (drug regulatory authorities) in written materials, phone calls or other forms. Persons whose conduct has been verified and reported to be true.

Article 5: Reporting any of the following illegal and criminal acts on drugs shall fall within the scope of rewards under these Measures:

(1) Producing, selling, and using drugs without state approval;

(2) Produce, sell, and use drugs that do not comply with national drug standards;

(3) Produce, sell, and use drugs that have been eliminated or prohibited from use by the state;

(4) Drugs that must undergo inspection but are sold without inspection or produced using raw materials that have not obtained an approval number (except Chinese herbal medicines that have not obtained an approval number)

( 5) Selling or using drugs imported without state approval;

(6) Producing, selling, and using drugs whose indicated indications or functions exceed the prescribed scope;

( 7) Produce, sell, and use drugs that have deteriorated or been contaminated;

(8) Produce, sell, or use drugs that are not marked with an expiration date or batch number or change the expiration date or batch number

(9) ) Production of packaging materials and containers that are in direct contact with drugs without approval, and drugs with colorants, preservatives, spices, flavorings and excipients added without authorization.

Article 6: If the same case is reported multiple times with the same content, the first whistleblower will be rewarded. The order of reporting shall be based on the time when the food and drug supervision and administration department (drug supervision and administration department) accepts the report; but for other reports Rewards may also be given as appropriate if the information provided by the person has a direct impact on the investigation of the case.

If two or more people (including two persons) jointly report the same case, they will be rewarded as one case.

Article 7: In principle, the objects of reporting rewards are limited to real-name reports. For cases reported anonymously, if the true identity of the reporter can be determined after the case is closed, if the reporter is willing to receive the reward, the reward should also be given.

Article 8: A one-time reward will be given based on the extent to which the evidence provided in the report is consistent with the illegal facts and the amount of fines and confiscations. The specific reward standards are as follows:

(1) Level 1 - If the person being reported and the illegal facts can be provided in detail and have direct access to on-site physical evidence and documentary evidence and assist in on-site investigation and handling activities, and the reported situation is completely consistent with the illegal facts, a reward will be given based on 5-6 of the fine and confiscation amount of the case;

(2) Level 2 - can provide the reported illegal facts and has obtained some on-site physical evidence and documentary evidence and assists in on-site investigation and handling activities. The reported situation is consistent with the illegal facts, and a reward will be given based on 3-4 of the fine and confiscation amount of the case;

(3) Level 3 - Unable to provide details of the person being reported and illegal facts, only providing clues for investigation and not directly assisting investigation activities, the reported situation is basically consistent with the investigation facts, 1% of the amount of fines and confiscations in the case -2 is given as a reward.

The level of reporting rewards is determined by the Food and Drug Administration (drug regulatory department). In principle, the total amount of reporting rewards for each case shall not exceed 50,000 yuan.

For cases that have been investigated and dealt with by the Food and Drug Administration (Drug Supervision and Administration), and although there is no fine or confiscation of money, but it is a first-level or second-level report, the reporter will be given a one-time payment of less than 500 yuan depending on the circumstances. award.

Article 9: For reports of major cases that have a greater impact across the country or the province, the amount of rewards may be determined by the provincial food and drug supervision and administration department depending on the specific circumstances.

Article 10 The specific case handling department shall fill in the "Liaoning Province Reward Approval Form for Reporting the Production and Sale of Counterfeit and Substandard Drugs" (Appendix) after the case is concluded, and submit it to the Food and Drug Administration Department (Drug Supervision and Administration Department) ) Notify the informant within 5 days after approval, and the informant must collect the bonus at the designated location within 30 days after receiving the notification. Those who fail to collect the bonus within the time limit will be deemed to have given up automatically.

Article 11: A designated person must be responsible for accepting reports and implementing rewards, and the reporting confidentiality system must be strictly implemented. No one may disclose the name of the whistleblower and the status of the report in any way.

Article 12: When the whistleblower receives the reward money, he or she should sign his or her real name and fill in the ID card number. A dedicated person from the department handling the case will be responsible for verification, go through the relevant collection procedures, and keep the whistleblower confidential.

Article 13 If law enforcement personnel of food and drug regulatory authorities (drug regulatory authorities) at all levels commit any of the following acts, they will be given administrative sanctions depending on the severity of the case; if a crime is constituted, legal liability will be pursued in accordance with the law:

(1) Forging reporting materials and pretending to receive reporting rewards;

(2) Treating the reporter or the reporting situation in a perfunctory manner without carefully verifying, investigating and punishing;

(3) Leaking secrets due to dereliction of duty;

(4) Tipping information to the person being reported to help him avoid investigation and punishment.

Article 14: These Measures do not apply to cases involving counterfeit and substandard drugs involving the official conduct of state agency staff or cases assigned by superiors or transferred by other departments.

Article 15: The sources of incentive funds stipulated in these measures shall be specially allocated by the Provincial Department of Finance for provincial vertical management units, and shall be specially allocated by the Municipal Finance Bureau for Shenyang and Dalian. The use and management of incentive funds must be subject to budget management in accordance with the regulations of the financial department, earmarked funds, and subject to the supervision of auditing and other departments.

Article 16 The food and drug regulatory department (drug regulatory department) should establish and improve financial management systems for the approval, issuance, collection, and voucher storage of bonuses in accordance with the relevant regulations of the financial department.

Article 17: The reward measures for those who have made meritorious service in reporting the production and sale of substandard medical devices shall be governed by these measures.

Article 18 These Measures shall be implemented from the date of issuance.
