Measures of Zibo Municipality for Reporting and Rewarding Illegal Acts of Dangerous Chemicals Transportation
These Measures shall not apply to the reports made by the Office of the Municipal Security Committee, the administrative law enforcement organs and their staff (including their spouses, immediate family members or other personnel entrusted by them), infringers and complainants of complaints, and the administrative law enforcement organs have filed a case at the time of reporting. Article 3 The Office of the Municipal Work Safety Committee shall be responsible for the report acceptance, reward examination and approval, information disclosure and case closing of illegal transportation of dangerous chemicals.
The Office of the Municipal Safety Committee accepts the reported cases of illegal transportation of dangerous chemicals as stipulated in Article 5 of these Measures, and the safety production supervision, public security and transportation departments entrust the Municipal Safety Production Supervision Detachment to investigate and deal with them, and impose administrative penalties. Article 4 The ways of reporting illegal acts of dangerous chemicals transportation include mass reporting, telephone reporting, letter reporting and email reporting. Informants can report with their real names, aliases, anonymity and passwords.
The mailing address, telephone number and e-mail address of the applicant shall be announced to the public by the office of the Municipal Security Committee. Article 5 If the following illegal acts are reported and verified by the municipal production safety supervision detachment and are given administrative punishment according to law, the office of the Municipal Safety Committee will reward the informants in accordance with the provisions of these Measures:
(a) engaging in the transport of dangerous chemicals without obtaining the road transport license for dangerous goods according to law, or transporting dangerous chemicals beyond the business scope of the road transport license;
(2) When transporting hazardous chemicals, it is necessary to add inhibitors or stabilizers, or it cannot meet the storage and transportation requirements of other hazardous chemicals (such as cold storage, heat preservation and ventilation);
(three) the transport of dangerous chemicals is not equipped with necessary protective equipment and emergency rescue equipment;
(4) Dangerous goods are mixed with ordinary goods;
(five) failing to carry out regular safety and technical inspection of dangerous chemicals transport vehicles in accordance with the relevant provisions of the state;
(six) dangerous chemicals transport vehicles are not hung or sprayed with warning signs that meet the requirements of national standards, or the warning signs are inconsistent with the transported dangerous chemicals;
(seven) dangerous chemicals transport vehicles exceed the approved load quality to load dangerous chemicals;
(eight) the transport of dangerous chemicals is not equipped with qualified drivers and escorts;
(nine) vehicles transporting dangerous chemicals enter the area where vehicles transporting dangerous chemicals are restricted without the approval of the public security organ, or transport highly toxic chemicals by road without the approval of the public security organ;
(10) Entrusting enterprises and vehicles that have not obtained the road transport license for dangerous goods to transport dangerous chemicals, or transporting vehicles beyond the business scope of the road transport license to transport dangerous chemicals;
(11) When consigning dangerous chemicals, the shipper fails to explain to the carrier the types, quantities, dangerous characteristics and emergency measures of the transported dangerous chemicals, or fails to provide safety technical instructions, or fails to affix or hang chemical safety labels on the packaging (including outer packaging);
(12) The shipper carries dangerous chemicals in ordinary goods, or conceals or falsely reports dangerous chemicals as ordinary goods;
(thirteen) without obtaining a road transport license for highly toxic chemicals, transporting highly toxic chemicals by road;
(14) The driver or escort fails to report to the local public security organ for a long time during the transportation of highly toxic chemicals or dangerous chemicals easy to make explosives;
(15) The driver or escort fails to take necessary warning measures and safety measures, or fails to report the loss, theft, robbery, scattering and leakage of highly toxic chemicals and explosive dangerous chemicals to the local public security organ during road transportation;
(sixteen) freight station operators overload or overload dangerous chemicals, or provide services for people without road transport business license or incomplete license;
(seventeen) other acts in violation of laws, regulations and rules on the transportation management of dangerous chemicals. Article 6 When the Office of the Municipal Safety Committee reports the illegal acts of dangerous chemicals transportation, it shall record the relevant information in detail, immediately hand it over to the Municipal Safety Production Supervision Detachment for investigation and inform the informant. Article 7 Anyone who reports an illegal act of transporting dangerous chemicals, which is verified by the Municipal Safety Production Supervision Detachment and is given an administrative penalty according to law, shall be rewarded according to the following standards:
(a) to report the illegal acts specified in Items (1), (10) and (12) of Article 5 of these Measures, and give the whistleblower a reward of 6,543,800 yuan but not more than 20,000 yuan;
(two) to report the illegal acts specified in Item (2), (3), (4), (5), (9), (11) and (13) of Article 5 of these Measures, and give the whistleblower a reward of 5000 yuan to 10000 yuan;
(three) to report the illegal acts listed in items (6), (7), (8), (14), (15) and (16) of Article 5 of these Measures, and give rewards ranging from 1000 yuan to 5,000 yuan.
Report other violations of laws, regulations and rules on the transportation management of dangerous chemicals, and the office of the Municipal Safety Committee will give corresponding rewards according to the illegal facts.
If the whistleblower has made a particularly significant contribution, the reward amount may not be subject to the above restrictions.
