Measures of Weihai Municipality on the Administration of Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the provisions of relevant laws and regulations and in the light of the actual situation of this Municipality in order to standardize the management of police auxiliary personnel in public security organs, ensure that police auxiliary personnel perform their duties according to law and give full play to the role of police auxiliary personnel in public security work. Article 2 These Measures shall apply to the duties, recruitment, management and guarantee of police auxiliary personnel within the administrative area of this Municipality. Article 3 The term "auxiliary police" as mentioned in these Measures refers to the staff who are managed and used by public security organs, whose funds are included in the fiscal budget at the corresponding level, perform the duties of auxiliary police as stipulated in these Measures, and do not have the status of people's police. Police auxiliary personnel are collectively called auxiliary police, including service auxiliary police and civilian auxiliary police.

Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, and personnel engaged in logistics services such as catering, security and cleaning in public security organs do not belong to the auxiliary police. Article 4 Auxiliary police shall carry out police assistance work under the command and supervision of public security organs and their people's police, and the legal consequences shall be borne by public security organs.

The behavior of auxiliary police in performing their duties according to law is protected by law, and citizens, legal persons and other organizations shall support and cooperate with them. Article 5 The public security organ is the competent department in charge of the management of auxiliary police, and is responsible for the recruitment, management and use of auxiliary police.

The financial department is responsible for the auxiliary police funds.

The human resources and social security department is responsible for guiding the auxiliary police to determine wages and implement work-related injury insurance.

The Department of Veterans Affairs is responsible for the evaluation of auxiliary police martyrs and the payment of martyrs' pensions. Chapter II Duties, Rights and Obligations Article 6 The auxiliary service police shall assist the people's police in law enforcement and other policing activities; Civilian auxiliary police assist the people's police in non-law enforcement posts. Article 7 According to the arrangement of the public security organ, the auxiliary police in active service may engage in the following work:

(a) to prevent and stop illegal and criminal activities;

(two) to accept and deal with the masses for help;

(3) Public security patrol and duty;

(four) to carry out safety inspections at stations, airports, docks and other places where people gather;

(five) to maintain the order of the case (incident), protect the case (incident) and rescue the injured and trapped people;

(six) to divert traffic, discourage and correct traffic safety violations, and collect traffic violation information;

(seven) to carry out publicity and education on public security, traffic safety and drug control;

(eight) other work that can be carried out by the service auxiliary police as stipulated by laws and regulations.

The service auxiliary police shall be engaged in the work listed in the third and fourth items of the preceding paragraph, and shall not be less than two when they are not under the leadership of the people's police. Article 8 Under the leadership of the people's police, the service auxiliary police may engage in the following work according to the arrangement of the public security organs:

(a) to assist in receiving the alarm and handling it at the scene, and to conduct on-site interrogation, inspection and continuous interrogation of the suspected criminals;

(2) Assisting in summoning, arresting and escorting criminal suspects and recording interrogation and interrogation transcripts;

(three) to assist in taking temporary protective and restrictive measures against drunken people whose behavior is out of control and mental patients who commit violent acts;

(four) to assist in the development of community management, special industry management, dog management, public security supervision and inspection and other public security management activities;

(five) to assist the daily service work of detention centers, detention centers, compulsory isolation drug rehabilitation centers, law enforcement case handling areas and detention centers;

(six) to assist in maintaining the order of large-scale public activities and handling mass incidents;

(seven) to assist in the registration and dynamic control of drug addicts, the daily management of drug addicts, the inspection of precursor chemicals enterprises, and the public investigation of drugs;

(eight) to assist in verifying the identity information of personnel;

(nine) other work that can be carried out with the assistance of the auxiliary police in accordance with laws and regulations.

Where laws and regulations stipulate that there shall be no less than two people's policemen engaged in relevant work, such provisions shall prevail. Article 9 According to the arrangement of the public security organ, the civilian auxiliary police may engage in the following work:

(a) clerical assistant, file management, wiring inquiry, window service, certificate handling, information collection and entry and other administrative assistant work;

(2) Psychological consultation, medical treatment, translation, computer network maintenance, data analysis, video monitoring, software development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and identification, film and television production and other technical support work;

(three) police equipment maintenance, logistics services and other police security work;

(four) other work that can be carried out by the civilian auxiliary police as stipulated by laws and regulations. Tenth auxiliary police shall not engage in the following work:

(a) matters that are not suitable for auxiliary police to participate in domestic public security, technical reconnaissance, anti-cult and anti-terrorism work;

(2) Handling matters involving state secrets;

(three) to make an administrative decision, issue an appraisal report and identify the responsibility for traffic accidents;

(four) the implementation of criminal compulsory measures;

(5) Examining cases;

(6) Holding and using weapons;

(seven) law enforcement alone or in the name of an individual;

(eight) the people's police who are required to work by laws and regulations. Article 11 Auxiliary police officers shall enjoy the following rights according to law:

(a) to obtain the necessary working conditions for performing their duties;

(2) Get remuneration for labor and enjoy legal welfare and insurance benefits;

(three) to obtain the business knowledge and skills training required by the post;

(four) to put forward opinions and suggestions on the work of this unit;

(five) to lodge complaints and accusations according to law;

(six) other rights stipulated by laws and regulations and agreed in the contract.
