Article 7

The state classifies telecommunications services and implements a licensing system. Engaged in telecommunications business, must be in accordance with the provisions of this Ordinance, the telecommunications business license issued by the competent department of information industry in the State Council or the province, autonomous region or municipality directly under the central government. No organization or individual may engage in telecommunication business activities without obtaining a telecommunication business license.

Article 68

Whoever, in violation of the provisions of this Ordinance, forges, fraudulently uses or transfers the business license of telecommunication business, the network access license of telecommunication equipment or forges the network access license number marked on telecommunication equipment shall be confiscated by the competent department of information industry of the State Council or the telecommunication regulatory agencies of provinces, autonomous regions and municipalities directly under the Central Government according to their functions and powers, and shall be fined not less than 3 times but not more than 5 times the illegal income; If there is no illegal income or the illegal income is less than 6,543,800 yuan, a fine of 6,543,800 yuan and 6,543,800 yuan will be imposed.

Article 69

In violation of the provisions of this Ordinance, anyone who commits any of the following acts shall be ordered to make corrections by the competent information industry department of the State Council or the telecommunications regulatory agencies of provinces, autonomous regions and municipalities directly under the Central Government according to their functions and powers, confiscate the illegal income, and impose a fine of more than 3 times and less than 5 times the illegal income; If there is no illegal income or the illegal income is less than 50,000 yuan, a fine ranging from 6,543,800 yuan to 6,543,800 yuan shall be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification:

(a) in violation of the provisions of the third paragraph of Article 7 of this Ordinance or the acts listed in Item (1) of Article 58 of this Ordinance, engaging in telecommunication business without authorization or operating telecommunication business beyond the scope;

(two) without the approval of the competent department of information industry in the State Council, the establishment of international communication gateway for international communication;

(three) unauthorized use, transfer, lease or change the use of telecommunications resources.

(4) Interrupting Internet interconnection or accessing services without authorization;

(5) refusing to perform the obligation of universal service.

ICP license processing materials
