Regulations on the administration of water conservancy projects in Wenshan Zhuang and Miao Autonomous Prefecture, Yunnan Province

Chapter I General Provisions Article 1 In order to strengthen the management and protection of water conservancy projects, give full play to the benefits of the projects, promote the development of industrial and agricultural production, and ensure the safety of life and property of urban and rural people, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional National Autonomy, the Law of People's Republic of China (PRC) on National Water (hereinafter referred to as the Water Law) and relevant laws of the state, and in combination with the actual situation of Autonomous Prefecture. Article 2 The water conservancy projects mentioned in these Regulations refer to reservoirs, ponds, sluices, pools, wells, water conveyance facilities, soil and water conservation, hydrology, bank protection, dikes, irrigation channels, electromechanical irrigation and drainage stations and their ancillary houses, communication, observation, roads, boundary markers, comprehensive management and other facilities built in the Autonomous Prefecture, as well as land, forests and grasslands within the scope of project management and protection. Article 3 Autonomous Prefecture implements the system of combining unified management with hierarchical management, professional management with mass management for water conservancy projects, and adheres to the principle that whoever builds owns it and whoever uses it manages it.

The state and county water administrative departments shall be responsible for the unified management of water conservancy projects within their respective administrative areas, and other relevant departments shall cooperate with the water administrative departments to manage water conservancy projects in accordance with their centralized management responsibilities.

Water supply, flood control and drainage, pollution prevention and sewage treatment projects within the county planning area shall be managed by the administrative department of urban construction. Article 4 All units and individuals in the Autonomous Prefecture have the obligation to protect water conservancy facilities and participate in flood control and emergency rescue. All organizations and individuals in the fifth autonomous prefecture must abide by these regulations. Sixth Autonomous Prefecture People's governments at all levels should strengthen the leadership of water conservancy project management, to ensure the implementation of water laws, regulations and these regulations. Chapter II Management Institutions and Responsibilities Article 7 State and county water conservancy and electric power bureaus are the water administrative departments of the people's governments at the same level, and under the leadership of the people's governments at the same level, they shall perform the following duties:

(a) publicity, implementation and enforcement of laws, regulations, principles and policies related to the protection and management of water conservancy projects;

(two) to inspect, supervise and guide the work of subordinate water administrative departments and township (town) water conservancy management stations and water conservancy project management units;

(three) to check the construction, maintenance and supporting quality of water conservancy projects, deal with hidden dangers, prepare flood control dispatching and water supply operation plans, and guide flood control and water storage;

(four) to adopt and popularize new technologies, new equipment, new materials and new experiences in the management and protection of water conservancy projects, and to improve the management level;

(five) responsible for organizing the delineation of the scope of management and protection of water conservancy projects;

(six) to prepare and convene the meeting of the irrigation management committee of water conservancy projects;

(seven) to formulate management measures for the protection and management of water conservancy projects and report them to the people's government at the same level for approval and promulgation;

(eight) to strengthen the construction of water conservancy law enforcement system, mediation and investigation of disputes and events in the construction and management of water conservancy projects;

(nine) report to the people's government at the same level or directly commend the advanced units and individuals in the management of water conservancy projects;

(ten) to undertake other tasks assigned by the people's government at the same level and the higher authorities in charge of water conservancy projects. Eighth township (town) water conservancy management station and water conservancy project management unit, under the leadership of the county water conservancy and electric power bureau and the township (town) people's government, manage the water conservancy projects within their respective jurisdictions and perform the following duties:

(a) to publicize and implement the laws, regulations, principles and policies on the protection and management of water conservancy projects;

(two) responsible for the technical guidance and project quality supervision of farmland water conservancy capital construction, and participate in organizing and guiding the specific work of flood control and emergency rescue;

(three) responsible for the inspection report, maintenance, governance and soil and water conservation of hidden dangers within the scope of protection of water conservancy projects under its jurisdiction;

(four) to formulate rules and regulations on the management of water conservancy projects, and report them to the people's government at the same level for approval and implementation, and to assist villages in formulating conventions on the management of water conservancy projects;

(five) do a good job in the statistical work of water conservancy project management, sort out the hydrometeorological observation data, and establish and improve the archives of water conservancy project management;

(6) collecting water supply and water charges;

(seven) to prepare for the meeting of the irrigation district management committee, report the work, and listen to opinions and suggestions;

(eight) mediation of water conservancy project management disputes, assist in the investigation of water conservancy project management cases, and maintain the order of water use;

(nine) to undertake other water conservancy project management matters assigned by the water administrative department;

(ten) responsible for the preparation of township (town) small water conservancy, drinking water project planning and annual repair, maintenance, renewal and transformation plan, the preparation and management of township (town) where the water supply project. Ninth state and county water administrative departments set up a director, deputy director and assistant inspector; Water conservancy project management units below the county level shall set up full-time or part-time water policy inspectors and assistant water policy inspectors.

The director and deputy director of the water inspector shall be appointed and removed by the people's government at the same level and reported to the water administrative department at the next higher level for the record.

Water supervision personnel at all levels shall perform the following duties:

(a) to supervise the implementation of relevant water laws, regulations, principles and policies;

(two) to protect water sources, waters, water conservancy projects, soil and water conservation and other related facilities, and maintain the order of water use;

(three) to supervise and inspect water activities, find out the facts of acts in violation of the provisions of these regulations, put forward opinions on handling them, and report them to the water administrative department for ruling;

(four) to coordinate the water relations between regions and departments, and assist the judicial departments to investigate and deal with water security and criminal cases.
