Provisions on the Permit for the Use of Transport Airports (revised 20 19)
Airport management organization refers to an organization with legal personality established according to law or entrusted to be responsible for airport safety and operation management.
Airport management agencies shall use the airport in accordance with the scope stipulated in the airport use permit.
The airport use permit remains valid and has not been revoked, revoked or cancelled. Article 4 The Civil Aviation Administration of China (hereinafter referred to as CAAC) shall be responsible for the unified supervision and administration of airport use licenses and related activities throughout the country; Be responsible for the examination and approval of airport use permit with flight zone index of 4F. Article 5 The regional civil aviation administration shall be responsible for the supervision and administration of airport use licenses and related activities within its jurisdiction. Including:
(a) entrusted by the Civil Aviation Administration, the implementation of the airport use permit examination and approval of the indicators of the flight zone below 4E (inclusive);
(two) to supervise and inspect the implementation of the airport use permit within its jurisdiction;
(three) to organize an annual applicability inspection and conformity assessment every five years for airports that have obtained the use license within their jurisdiction;
(four) other duties as prescribed by laws and administrative regulations and authorized by the Civil Aviation Administration. Article 6 The management of airport use license shall follow the principles of safety first, complete conditions, strict examination and approval, and standardized procedures. Chapter II Airport Use Permit Section 1 Application Article 7 An application for an airport use permit shall be submitted to the Civil Aviation Administration or the regional civil aviation administration where the airport is located entrusted by the Civil Aviation Administration in accordance with these Provisions. Article 8 An airport applying for an airport use permit shall meet the following conditions:
(a) a sound safety operation management system, organization and management system;
(two) the main person in charge of the airport management agency, the person in charge of operation safety and other senior managers who need to bear the responsibility of safety management have the qualifications and conditions suitable for their business;
(3) Having a flight area, a terminal area, a work area, operational service facilities, equipment and personnel that meet the requirements and are suitable for its business;
(4) Having facilities, equipment and personnel that meet the requirements and can ensure flight safety, such as air traffic services, aviation information, communications, navigation and monitoring, aviation meteorology, etc. ;
(5) The use of airspace has been approved;
(6) The flight procedures and operating standards conform to the provisions of the Civil Aviation Administration;
(seven) there are security facilities, equipment, personnel and civil aviation security programs that meet the requirements;
(8) Having emergency rescue plans, emergency rescue facilities, equipment and personnel that meet the requirements;
(9) The name of the airport has been filed with the Civil Aviation Administration. Article 9 To apply for an airport use permit, the following documents shall be submitted:
(1) Application for Transportation Airport Use Permit (attachment 1).
(2) Airport Operation Manual (hereinafter referred to as the Manual).
(3) Qualification certificates of the principal responsible person of the airport management organization, the responsible person in charge of operation safety and other senior management personnel who need to bear the responsibility of safety management, and a list of personnel related to airport operation safety.
(4) Approval documents for airport construction and relevant documents for industry acceptance; Proof documents of airport property rights and entrusted management.
(five) the approval or filing documents for the open use of communication, navigation and monitoring, meteorology and other facilities and equipment.
(six) materials that meet the requirements of airport use rules, flight procedures and minimum standards for airport operation.
(7) A list of personnel, facilities and equipment that meet the requirements of the civil aviation security plan.
(eight) emergency rescue plan for airport emergencies.
(nine) the filing documents of the name of the airport in the Civil Aviation Administration.
(ten) other necessary materials required by the Civil Aviation Administration and the regional civil aviation administration.
The airport management agency shall be responsible for the authenticity of the documents and materials for applying for the airport use permit. Article 10 If the application materials are incomplete or do not conform to the statutory form, the regional civil aviation administration shall inform the airport management agency of all the contents that need to be corrected on the spot or within five working days. Failing to inform the application materials within the time limit, it shall be accepted from the date of receiving the application materials. Section 2 Examination and Approval Article 11 After receiving the application documents for airport use license that meet the requirements, the Civil Aviation Administration or the regional civil aviation administration shall conduct examination according to the following requirements:
(1) Examining the authenticity and completeness of documents and materials;
(two) review the format and content of the manual and whether it meets the regulations and standards;
(three) on-site inspection and review of airport facilities, equipment, personnel and management system and the consistency of the submitted documents and materials.
The person in charge of the matters listed in the preceding paragraph shall be appointed by the CAAC or the regional civil aviation administration or the inspector, but only the inspector has the right to sign the corresponding documents.
