According to the Confirmation Scheme for Certified Auditors of Intellectual Property Management System promulgated by China Certification and Accreditation Association, the basic requirements for confirming applicants (i.e. those who apply for auditors and are confirmed by the Association) are as follows:

1. Personal quality

Applicants should have the following personal qualities:

● Morality: having the qualities of justice, reliability, loyalty, honesty and prudence;

● Open-minded: willing to consider different opinions or viewpoints;

● Good at communication: able to communicate with people in a flexible way;

● Good at observation: take the initiative to understand the surrounding environment and activities;

● Perception: Being able to know and understand the environment instinctively;

● Strong adaptability: easy to adapt to different situations;

● Perseverance: persistently complete tasks and achieve goals;

● Clear judgment: able to use logical reasoning or other analytical methods to draw conclusions in time;

● Self-reliance: work independently and play a role in interacting with others. 2. Code of Conduct

The auditor of the confirmed intellectual property management system has the obligation to strictly abide by the following code of conduct:

● Be law-abiding, professional, honest, objective and fair;

● Strive to improve audit skills and reputation;

● Help its supervisors to improve their management level, professional level and audit skills;

● Do not undertake the audit that I am not capable of;

● Don't get involved in conflicts or interest competition, and don't hide any relationship that may affect fair judgment from the auditor's employment agency;

● Do not discuss or disclose any audit-related information unless it is authorized in writing by the auditor's institution and the auditee or required by law;

● Do not accept any form of kickbacks, gifts and other benefits from the auditee, its staff or any interested party, and do not allow colleagues to accept them knowingly;

● Do not intentionally spread any wrong or misleading information, so as not to affect the credibility of the audit or auditor's confirmation process;

● Under no circumstances shall it damage the reputation of China Certification and Accreditation Association (CCAA) and its confirmation process, and fully cooperate with the investigation in violation of this Code;

● Do not consult the auditee, and do not conduct certification audit.

2. Knowledge requirements

(1) Audit and certification knowledge

● Understanding

GB/T19011901:Chapters 3, 4, 5 and 6 of 2002 Quality and/or Environmental Management System Audit Guide;

● Understand the contents of CNAS-CC0 1 9.6 required by management system certification bodies;

● Understand the application of auditing principles, procedures and technologies;

Familiar with the certification process of intellectual property management system.

(2) Knowledge of intellectual property management system

Familiar with the content, requirements and terminology of GB/T29490-20 13 Enterprise Intellectual Property Management Standard;

Understand the application of intellectual property management system in different types of organizations, including:

(a) Types of intellectual property rights of different types of organizations and their relationship with business;

(b) The demands of different types of organizations for intellectual property management resources;

(c) The process of acquisition, maintenance, application and protection of intellectual property rights of different types of organizations;

(d) Intellectual property risks of different types of organizations and their relationship with organizations;

(e) Management procedures specific to different types of organizations.

(3) Basic knowledge of intellectual property rights

● Master the definition, types and characteristics of intellectual property rights;

● Understand the basic knowledge related to patents, including:

Patents and patent rights;

Patents for inventions, utility models and designs;

(c) Service inventions and creations and the rights of service inventors;

(d) the right to apply for a patent arising from entrustment or cooperation;

(five) the right to apply for a patent and the transfer of the patent right, and the patent licensing contract;

The rights of the patentee;

Conditions for granting the patent right;

(h) substantive review;

(1) Administrative revocation and invalidation of the patent right;

Patent literature.

● Understand the basic knowledge related to trademarks, including:

(1) Trademarks, registered trademarks, unregistered trademarks and trademarks;

(b) the characteristics of the trademark;

The principle of voluntary registration and the principle of applying first;

(e) The differences between service marks and enterprise names, and between service marks and trade names.

● Understand copyright, exclusive right of integrated circuit layout design, new plant varieties, prevention of unfair competition, name of manufacturer, name of country of origin, trade secrets, etc.

(4) Knowledge of laws and regulations

Understand the laws and regulations, implementation rules, relevant working procedures and guidelines related to intellectual property rights; Understand the laws and regulations related to certification and accreditation.

● Understand the composition of relevant laws and regulations in China;

● Be familiar with the requirements of national certification and accreditation laws and regulations, focusing on the Regulations of People's Republic of China (PRC) on Certification and Accreditation, Measures for the Administration of Certification and Accreditation Training and Consultants (Order No.61of the General Administration of Quality Supervision, Inspection and Quarantine) and Notice on Printing and Distributing the Implementation Opinions on the Certification of Intellectual Property Management System (National Accreditation Association (20 13)56.

3. Educational experience

The applicant should have a bachelor's degree or above recognized by the national education administrative department.

4. Work experience

Auditors confirm that applicants should have at least 5 years of full-time working experience.

Senior auditors confirm that applicants should have at least 8 years full-time working experience.

For those with master's degree or above, the work experience requirement can be reduced by 1 year.

Work experience should be obtained after obtaining a bachelor's degree or above.

5. Professional work experience

Auditors confirm that applicants should have at least 3

3 years working experience in intellectual property and related fields.

Senior auditors confirm that applicants must have at least 5.

Years working experience in intellectual property and other related majors, with intermediate and above titles (positions) or intermediate and above management positions.

The working experience of intellectual property and other related majors includes: intellectual property management of enterprises and institutions, intellectual property intermediary services (intellectual property agency, intellectual property legal services, intellectual property information services, intellectual property commercialization services, intellectual property education and training, intellectual property consulting services, etc. ), intellectual property public services (intellectual property administration, patent examination, intellectual property research, intellectual property judicial protection, etc.). ), science and technology management, quality management, etc.

6. Training examination

The applicant shall successfully complete the training course for auditors of intellectual property management system approved by China Certification and Accreditation Association (CCAA), and the content of the training course shall cover the "knowledge requirements" of this scheme.

Should participate in CCAA

Organize exams and obtain qualification certificates.

7. Audit experience

The auditor confirmed that the applicant should participate in 4 audits of the intellectual property management system as an intern; The audit should be completed within the last three consecutive years.

After the senior auditor confirmed that the applicant had obtained the auditor qualification, he served as the audit team leader and completed three audits of the intellectual property management system; The audit should be completed within the last 2 years.

8. reconfirm

Auditors and senior auditors should report to CCAA three months before the qualification expires.

Apply for reconfirmation, and the audit experience shall be implemented according to the requirements of initial confirmation.

9. Employment

Confirm that the applicant should establish an employment relationship with the applicant's organization in Certification staff (and only with this organization).
