The Historical Evolution of Jinmen Branch of Fujian High Court

Jinmen Branch of Fujian High Court was formerly known as Xiamen Branch of Fujian High Court, which was originally located in Xiamen, Fujian Province. Xiamen Branch of Fujian Higher People's Court, formerly known as the First Branch of Fujian Higher People's Court (referred to as the First Branch for short), evolved from the First Branch of Fujian Higher People's Court (once changed to Xiamen Branch of the Provincial Appeal Court).

12 (1923) In February, the Fujian Provincial High Court set up the first branch of the Fujian Provincial High Court in Siming County, with no director, and the supervisor as the supervisor. The internal organs only included the criminal court, the civil court and the office of the clerk.

The first branch of Fujian Provincial Higher Judicial Department hears cases of civil strife and foreign invasion and their first-instance cases according to law, as well as appeals of local judicial departments or county governors against first-instance judgments and re-appeals against second-instance judgments (all re-appeals will be accepted by the Higher Judicial Department from May 13).

According to the data of the Republic of China 14 (1925), the first branch of Fujian High Court has jurisdiction over the trial courts of Siming, Longxi, Jinjiang and Gulangyu, but there are no local courts in Jinmen, Dongshan, Nan 'an, Anxi, Hui 'an, Tongan, Zhangpu, Nanjing, Changtai, Heping and Zhao 'an. Two other local halls in Minhou and Putian, and 39 counties without local halls (including Jian 'ou County, which set up halls the following year) are all under the jurisdiction of Fujian Higher Procuratorate.

16 (1927) In April, the Wuhan National Government carried out judicial reform in Fujian, merging the trial courts and procuratorates at all levels into courts, and Fujian Province established the Fujian Provincial Appeal Court and its Xiamen branch in Siming County. In June 165438+ 10 of the same year, according to the decision of Nanjing National Government, the Fujian Provincial Appeal Court and its sub-courts were changed to the Fujian Provincial High Court and its sub-courts, and the county courts were renamed as local courts, and the president system was implemented. Xiamen Branch of Fujian Appeal Court was changed to the First Branch of Fujian High Court.

In the 27th year of the Republic of China (1938), Xiamen fell in May, and the first branch of Fujian High Court moved to Longyan County.

After the victory of War of Resistance against Japanese Aggression in 34 years of the Republic of China (1945), the first branch of Fujian High Court moved back to Xiamen in 10, and another branch of Fujian High Court was located in Longyan County.

In the 37th year of the Republic of China (1948) and in June of 1, according to the instructions of the Judicial Administration Department of the National Government, five branches of Fujian High Court were renamed after their counties and cities, and the first branch of Fujian High Court was renamed as Xiamen Branch of Fujian High Court.

Fujian Higher People's Court and its branches try criminal cases of first instance related to civil strife, foreign invasion and obstruction of state diplomacy, as well as cases of second instance that appeal or protest against the first-instance judgment of local courts (or county judicial organs). In the 24th year of the Republic of China (1935), when the four-level three-trial system was implemented before July, it also accepted the third-trial cases originally under the jurisdiction of the first level, refused to accept the second-instance judgment of the local court (or county judicial organs), and appealed and protested again.

After the Kuomintang government retreated to Taiwan Province Province, Xiamen Branch of Fujian High Court resumed its Taipei office +095 1 1 on June 6, 2008 to accept the judicial business in kinmen county. At that time, the judicial affairs in Mazu area were still tried by military courts.

1956 and 1969, Fujian Jinmen District Court and its Lianjiang Civil Court were established in Jinmen and Mazu respectively. Because the staff of the hospital was still working in Taipei at that time, the Jinmen District Court only went to Jinmen twice a year except for major cases. However, in Mazu area, the number of cases going to court is regarded as fluid.

On July 1990, Xiamen Branch of Fujian High Court was renamed as Jinmen Branch of Fujian High Court, and moved back to kinmen county on February 1993.
