Measures for the Implementation of People's Republic of China (PRC) Blood Donation Law in Hunan Province

Article 1 These Measures are formulated in accordance with the Blood Donation Law of People's Republic of China (PRC) and the actual situation of this province.

Article 2 The province implements the system of voluntary blood donation. Advocate1healthy citizens aged 8 to 55 to donate blood voluntarily. Encourage rare blood group citizens who meet the conditions of blood donation to actively donate blood.

Encourage national staff, medical personnel, active servicemen and college students to take the lead in donating blood.

Article 3 People's governments at all levels shall lead the work of blood donation within their respective administrative areas, and uniformly plan, organize and coordinate relevant departments to do a good job in blood donation.

Article 4 The health administrative department of the people's government at or above the county level shall be responsible for the supervision and administration of blood donation within its administrative area.

Red Cross Societies at all levels participate in the propaganda and mobilization of blood donation, and participate in the organization of emergency blood use such as major disasters.

Chapter II Mobilization and Organization

Article 5 People's governments at all levels shall take measures to widely publicize the significance of voluntary blood donation and popularize the scientific knowledge of blood and blood donation.

The news media should carry out public welfare publicity of blood donation in a planned way.

Health administrative departments and medical institutions shall publicize the scientific knowledge of blood donation in combination with clinical blood use.

Education administrative departments and schools should incorporate the scientific knowledge of blood donation into the content of students' health education.

Article 6 The administrative department of health of the people's governments of cities, autonomous prefectures and counties (cities, districts) divided into districts shall, according to the clinical blood consumption of medical institutions in their respective administrative areas, formulate an annual implementation plan for voluntary blood donation in their respective administrative areas, which shall be implemented after being approved by the people's government at the same level.

Article 7 State organs, armed forces, social organizations, enterprises and institutions, residents' committees and villagers' committees shall mobilize and organize citizens in their own regions and units who meet the requirements for blood donation to donate blood without compensation.

Article 8 Medical institutions shall inform patients who need blood of the provisions on blood donation and free blood use, and mobilize and guide patients to store their own blood or their families to donate blood without compensation.

Ninth people's governments at or above the county level shall incorporate the blood collection and supply of emergencies into the emergency plan for emergency medical and health rescue, and ensure the need for emergency blood use.

Chapter III Blood Donation

Article 10 Citizens, with their resident identity cards or other valid certificates that can prove their identity, voluntarily participate in voluntary blood donation organized by units, or directly donate blood to blood stations, central blood stations, central blood banks (hereinafter referred to as blood stations), their fixed blood collection points and mobile blood collection vehicles.

Article 11 Before donating blood, citizens shall truthfully fill in the form of personal basic information and physical health status, and accept the free health examination of blood collectors. Those who fail to meet the requirements for blood donation after examination shall not collect blood and explain the situation to them.

The amount of blood collected by a blood station from a blood donor at a time is generally 200 ml, and the maximum amount shall not exceed 400 ml. Blood collectors shall solicit the opinions of blood donors on the specific amount of blood collected.

Twelfth blood stations should establish a reporting system and a blood donation elimination system for blood donors who may be infected with blood-borne diseases. Thirteenth citizens after blood donation, blood station staff should inform the number of blood donors and issue a "blood donation certificate".

It is forbidden to forge, alter, transfer, lease, lend or fraudulently use the Certificate of Free Blood Donation.

Article 14 citizens of this province donate blood without compensation. If blood donors and their spouses, parents and children use blood anywhere, they shall pay the cost of blood use to medical institutions, and submit the blood donation certificate, resident identity card, blood donation certificate and blood invoice issued by medical institutions to the blood station that issued the blood donation certificate for reimbursement according to the following standards:

(1) If the total amount of blood donated is more than 900 ml (inclusive, the same below), the donor himself shall reimburse the expenses of unlimited clinical blood for life; If the total amount of blood donation exceeds 600 ml and is less than 900 ml, the expenses of three times the clinical blood consumption will be reimbursed; If the total amount of blood donation is less than 600 ml, the expenses of twice the amount of blood donated for clinical use shall be reimbursed;

(two) in addition to the blood donors in accordance with the provisions of the preceding paragraph, the spouses, parents and children of blood donors can also reimburse the same amount of clinical blood expenses.

Before the implementation of these measures, the reimbursement standards implemented in various places are more favorable than those stipulated in this article, and continue to be effective for citizens who donate blood without compensation. After the implementation of these measures, the municipal and state people's governments may, according to local actual conditions, formulate standards superior to those stipulated in this article.

Fifteenth citizens who donate blood without compensation, the relevant units can give appropriate subsidies.

Citizens who have donated blood many times and units and individuals who have made remarkable achievements in mobilizing and organizing citizens to donate blood without compensation shall be commended and rewarded by the people's governments at or above the county level and the Red Cross Society.

Sixteenth blood stations and relevant units and their staff shall protect the privacy and other personal information of unpaid blood donors according to law.

Article 17 It is forbidden to illegally organize others to sell blood. It is forbidden to hire others to donate blood.

Eighteenth health administrative departments of the people's governments at or above the county level shall organize the establishment of blood donors database and rare blood group citizen database, and gradually realize the province's network management.

Chapter IV Blood Collection

Article 19 Blood shall be collected by blood stations.

A blood station is a public health institution that collects and provides blood for clinical use for non-profit purposes. People's governments at or above the county level shall bring blood stations into the local public health system.

The establishment of a blood station shall be approved by the health administrative department of the State Council or the health administrative department of the provincial people's government in accordance with the relevant provisions of the state. Without approval, no unit or individual may set up a blood station.

Twentieth blood stations in business activities in accordance with the law to collect fees should be deposited in the financial accounts, into the budget management. The expenses required for blood station work and the expenses for reimbursement of blood for clinical use by unpaid blood donors, their spouses, parents and children shall be guaranteed by the people's government at the same level.

Blood collection vehicles and emergency blood delivery vehicles in blood stations are exempt from road maintenance fees and vehicle tolls.

Article 21 Blood stations shall announce the addresses and contact information of blood stations and their branches to the public, set up fixed blood collection points or send mobile blood collection vehicles according to needs, so as to facilitate citizens to donate blood without compensation, and local people's governments and relevant units shall provide convenient conditions.

The establishment of branches, fixed blood collection points or the dispatch of mobile blood collection vehicles in blood stations shall be carried out in accordance with the standards and procedures stipulated by the administrative department of health of the State Council.

Twenty-second medical personnel who collect blood should have the qualification for blood collection. Medical personnel who are not qualified for blood collection are prohibited from engaging in blood collection.

Blood collection should strictly abide by the relevant operating rules and regulations, and use drugs, in vitro diagnostic reagents and disposable blood collection equipment that meet the requirements of the state. Disposable blood collection equipment must be destroyed in accordance with regulations after use.

Blood stations shall test the collected blood in accordance with state regulations. Blood that has not been tested or failed to pass the test shall not be provided to medical institutions.

Article 23 The health administrative department of the county (city) people's government shall, according to the needs, designate the second-class hospitals within its jurisdiction to set up a central blood station. The central blood station stores blood for clinical use according to the clinical blood use plan approved by the health administrative department of the county (city) people's government.

The health administrative department of the county (city) people's government shall, according to the needs, set up blood storage points in central hospitals in remote areas. Blood storage points shall formulate plans for storing blood for clinical use in accordance with the scope approved by the health administrative department of the county (city) people's government, and provide blood for medical clinical use.

Other medical institutions above the second level shall set up their own blood storage facilities to properly store the blood for clinical use in their own medical institutions.

Blood storage facilities in central blood stations, blood storage points and other medical institutions shall meet national standards and ensure the quality of blood storage.

Chapter V Blood for Clinical Use

Article 24 Blood for clinical use in medical institutions shall be provided by blood stations or central blood stations and blood storage points, and blood from central blood stations and blood storage points shall be provided by blood stations. Except as provided in Article 29 of these Measures, no other unit or individual may provide it.

Twenty-fifth medical institutions should negotiate with local blood stations or central blood stations and blood storage points to formulate a blood use plan declaration and supply system.

If the amount of blood used for elective surgery exceeds 8,000 ml, the medical institution shall report to the blood station before 7 days.

Twenty-sixth medical institutions should follow the principle of rationality and science in clinical blood use, and should not waste or abuse blood.

Medical institutions should carry out component blood transfusion, and the proportion of component blood transfusion should meet the requirements stipulated by the health administrative department of the State Council.

Blood stations are responsible for the preparation and supply of blood varieties needed by medical institutions clinically.

Twenty-seventh medical institutions shall, in accordance with the provisions of the state, test blood for clinical use, and shall not use blood that does not meet the standards prescribed by the state for clinical use.

Medical institutions must use disposable blood transfusion instruments in clinic and destroy them according to regulations after use.

Twenty-eighth blood stations to supply blood to medical institutions, collect blood collection, inspection, separation, storage, transportation and other expenses in accordance with state regulations. When citizens use blood for clinical use, they only pay for blood collection, inspection, separation, storage and transportation, and the specific charging standards shall be implemented in accordance with relevant state regulations.

Twenty-ninth medical institutions to collect blood temporarily shall meet the following conditions:

(a) emergency blood to save the patient's life, and there is no other medical measures to replace it;

(2) local blood stations, central blood stations and blood storage points have no blood supply, and the health administrative department cannot adjust them in time;

(3) It has the conditions for cross-matching and rapid detection of hepatitis B virus surface antigen, hepatitis C virus antibody, HIV antibody and syphilis.

When a medical institution takes blood temporarily, it shall truthfully inform the blood users or their families of the possible risks of temporary blood collection and blood transfusion before blood collection, solicit their opinions, and report the situation to the health administrative department of the people's government at or above the county level within 10 days after temporary blood collection.

When collecting blood temporarily, medical institutions shall abide by the operating rules and regulations of blood collection.

Chapter VI Supervision and Administration

Thirtieth people's governments at or above the county level and their health administrative departments shall supervise and inspect the implementation of the annual implementation plan for voluntary blood donation within their respective administrative areas. Article 31 The health administrative department of the people's government at or above the county level shall strengthen the supervision and inspection of the implementation of the national blood donation laws, regulations, rules, technical standards and operating rules by blood stations, central blood stations, blood storage points and medical institutions, and promptly investigate and deal with illegal acts.

Thirty-second health administrative departments of the people's governments at or above the county level shall establish a system of reporting and complaining about illegal blood collection and supply, and safeguard the legitimate rights and interests of unpaid blood donors and other parties.

Thirty-third blood stations should establish and improve the financial management system, and accept the supervision and inspection of the financial and auditing administrative departments.

Chapter VII Legal Liability

Article 34 If, in violation of the provisions of Article 7 of these measures, the relevant units fail to perform the obligation of mobilizing and organizing blood donation without compensation, or in violation of the provisions of Article 21 of these measures, they fail to provide assistance to blood collection in blood stations, the relevant people's government or the administrative department of health shall order them to make corrections.

Thirty-fifth in violation of the provisions of these measures, the "People's Republic of China (PRC) blood donation law" provides for punishment, in accordance with its provisions.

Thirty-sixth blood stations or medical institutions that disclose the privacy of unpaid blood donors and cause damage to unpaid blood donors shall bear legal responsibility according to law.

Thirty-seventh fraudulent reimbursement of blood expenses, shall be ordered by the administrative department of health to return; Violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law", shall be given public security punishment according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 38 Where the health administrative department of the people's government at or above the county level and its staff neglect their duties, abuse their powers or engage in malpractices for selfish ends in the supervision and management of blood donation and blood use, they shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
