Measures of Suzhou Municipality on the Administration of Rail Transit

Chapter I General Provisions Article 1 In order to standardize the management of rail transit, ensure the smooth progress and safe operation of rail transit planning and construction, and safeguard the legitimate rights and interests of passengers and rail transit operators, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "rail transit" as mentioned in these Measures refers to the public * * * passenger transport system of urban rapid rail such as subway and light rail.

The term "rail transit facilities" as mentioned in these Measures refers to ancillary facilities such as rail transit tracks, tunnels, overhead lines (including bridges), stations (including entrances and exits, passages and wind pavilions), vehicles, equipment, electromechanical systems, and related facilities set up to ensure the operation of rail transit. Article 3 These Measures shall apply to the planning, investment, construction, operation, comprehensive development, facility protection and related management activities of urban rail transit within the administrative area of this Municipality. Article 4 Rail transit shall follow the principles of unified planning, diversified investment, priority development, standardized operation, safety and convenience. Article 5 The Municipal People's Government shall set up a deliberation and coordination body for rail transit, which shall be responsible for the overall coordination of major issues involved in rail transit management.

The municipal transportation department is the administrative department of rail transit in this Municipality, responsible for the organization, implementation, supervision and management of these measures, and specifically undertakes the supervision and management of rail transit operation.

The competent department of urban and rural planning is responsible for the preparation, supervision and management of urban rail transit planning.

The municipal construction administrative department is responsible for the supervision and management of the construction of rail transit in this Municipality.

Municipal development and reform, economy and information technology, finance, land, public security, environmental protection, civil defense, landscaping, city appearance and municipal administration, safety supervision, water affairs, price, auditing and other departments shall, according to their respective functions and duties, do a good job in the management of rail transit.

The people's governments of county-level cities (districts) along the rail transit and their relevant departments shall do a good job in rail transit management according to their respective responsibilities. Article 6 The rail transit business units determined by the Municipal People's Government shall, in accordance with the provisions of these Measures, organize the construction, operation and related comprehensive development of rail transit.

With the approval of the Municipal People's Government, rail transit business units can engage in comprehensive land development, commerce, advertising and other business activities within the scope and space of rail transit land determined by urban planning. Seventh rail transit construction funds to implement the combination of government investment and multi-channel financing. Land revenue included in the plan for the balance of funds for rail transit construction shall be used for rail transit construction in accordance with relevant regulations.

Citizens, legal persons and other organizations are encouraged to invest in the construction and operation of rail transit, and the legitimate rights and interests of investors and operators are protected by law. Article 8 All units and individuals have the obligation to support and cooperate with the planning and construction of rail transit, and shall not interfere with the construction and operation of rail transit projects.

Power supply, communication, water supply, fuel supply and other related units should give priority to ensuring the demand of rail transit for electricity, communication, water and fuel, and ensure the normal construction and operation of rail transit. Chapter II Planning and Construction Management Article 9 Rail transit planning shall be incorporated into the overall urban planning and linked with railway, highway and other public transport planning.

Rail transit planning includes rail transit network planning, detailed planning of each line of rail transit network and related special planning. Tenth rail transit network planning and detailed planning of each line of rail transit network shall be organized by the municipal urban and rural planning department in conjunction with the municipal transportation and other relevant departments and submitted to the Municipal People's government for approval.

The approved rail transit plan shall not be changed at will, and if it is really necessary to change it, it shall be submitted for approval in accordance with the prescribed examination and approval procedures. Eleventh urban and rural planning departments shall, according to the detailed planning of each line of the approved rail transit network, do a good job in land use control and management along the rail transit and around the station. When examining and approving other construction project plans that need to be connected with rail transit entrances and exits, wind pavilions, cooling towers and other ancillary facilities, the necessary space planning and design requirements for connecting rail transit shall be put forward.

When planning land for rail transit stations, land for public transportation and public facilities such as transfer hubs or bus stops, motor vehicles and non-motor vehicle parking lots shall be reserved according to the requirements of urban planning, passenger flow, passenger transfer demand and land use conditions.

The land for municipal facilities in urban planning of rail transit shall not be changed without legal procedures. Article 12 Before going through the procedures for transferring and allocating land related to rail transit construction, the land for ancillary facilities such as rail transit entrances and exits, wind pavilions and cooling towers shall be included in the supply scope of rail transit construction land according to the planning and design requirements. Thirteenth rail transit engineering construction should be carried out in accordance with the basic construction procedures stipulated by the state.

The survey, design, construction and supervision of rail transit construction projects shall abide by laws and regulations, implement relevant technical standards and norms, and abide by the provisions on the protection of surrounding buildings and other related facilities. Fourteenth municipal construction and other relevant administrative departments shall, in accordance with the provisions of relevant laws and regulations, supervise and manage the quality and construction safety of rail transit projects. Fifteenth rail transit construction required for power supply, communication, water supply, drainage, heat, gas and other pipelines and buildings (structures) and other facilities files, after the application of rail transit business units, the relevant departments and property units shall provide timely.

If the information about pipelines and facilities is false or missing, relevant departments and property rights units should take the initiative to coordinate and communicate with rail transit business units to avoid damaging pipelines and facilities in engineering investigation or construction.

During the construction of rail transit projects, rail transit business units shall investigate, record and dynamically monitor the existing buildings and facilities along rail transit, and take measures to protect the safety of power supply, communication, water supply, drainage, heat and gas pipelines and buildings and other facilities along the line.
