Article 9 of the Measures for the Administration of Food Business License: To apply for a food business license, one should first obtain the qualifications of a legal subject such as a business license. Enterprise legal person, partnership enterprise, sole proprietorship enterprise, individual industrial and commercial households, etc. The applicant is the subject specified in the business license. For canteens of government agencies, institutions, social organizations, private non-enterprise units, enterprises and other tendering units, the applicant shall be the subject specified in the registration certificate or business license of the registration certificate of government agencies, institutions and social organizations as legal persons.

Measures for the investigation and punishment of unlicensed operation

Article 2 No unit or individual may engage in unlicensed business in violation of laws, regulations and the provisions of the the State Council decision.

Thirteenth engaged in unlicensed business, the administrative department for Industry and Commerce shall be punished in accordance with the provisions of relevant laws and administrative regulations. If the laws and administrative regulations do not clearly stipulate the punishment for operating without a license, the administrative department for industry and commerce shall order it to stop the illegal act, confiscate the illegal income and impose a fine of 1000 yuan.

Article 14 Whoever knowingly provides business premises for an operator, or provides transportation, warehousing, storage and other conditions, shall be ordered by the administrative department for industry and commerce to stop the illegal act, confiscate the illegal income, and may be fined up to 5,000 yuan.

Fifteenth any unit or individual engaged in unlicensed business, credit records by the investigation department, and shall be publicized in accordance with the provisions of relevant laws and regulations.

Article 16 Whoever obstructs the investigation department from investigating unlicensed business activities and constitutes a violation of public security administration shall be punished by the public security organ in accordance with the provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment.
