Provisions on the Administration of Motorcycles in Shantou Special Economic Zone

Article 1 In order to strengthen urban road traffic management, maintain traffic order, reduce environmental pollution, and ensure traffic safety and smoothness, these Provisions are formulated in accordance with relevant laws and regulations and in combination with the reality of Shantou Special Economic Zone (hereinafter referred to as the Special Zone). Article 2 Motorcycles mentioned in these Provisions refer to two-wheeled or three-wheeled motor vehicles equipped with internal combustion engines and designed at a speed of more than 20 kilometers per hour, including two-wheeled motorcycles, three-wheeled motorcycles and mopeds. Article 3 These Provisions shall apply to the management of motorcycles within the special zone. Article 4 The Municipal People's Government shall uniformly lead, organize and coordinate the management of motorcycles in the Special Zone.

The municipal public security department is responsible for the implementation of these provisions.

Municipal transportation, environmental protection, urban management, industry and commerce departments shall manage motorcycles according to their respective responsibilities. Article 5 The government vigorously supports and develops public transport, gives priority to the development of public transport, and encourages and advocates citizens to take public transport. Article 6 The management of motorcycles in the Special Zone shall follow the principle of controlling the total business volume and gradually reducing it. From the date of implementation of these Provisions, except for the circumstances specified in Article 7, the entry formalities for motorcycles will no longer be handled; Except under the circumstances specified in Article 8, motorcycles registered outside the Special Zone shall not be transferred to the Special Zone. Article 7 The Municipal People's Government may, according to the needs of urban development and management, conduct public auction of motorcycle license plates. The number of license plates auctioned each year shall not be less than 20% of scrapped motorcycles in the previous year, and all the proceeds from the auction shall be used for the construction of urban public transport in the Special Zone. The specific measures for public auction of motorcycle license plates shall be formulated separately by the Municipal People's Government.

Public security, municipal and other departments need to update or add official motorcycles for law enforcement, patrol, emergency rescue, emergency rescue, etc. , should be approved by the Municipal People's government, for motorcycle license plate, add special signs, and according to the provisions of the equipment and use. Article 8 If a resident of the Special Zone buys a motorcycle outside the Special Zone and registers it outside the Special Zone before199965438+February 12, the owner can go through the formalities of transferring the motorcycle to the Special Zone with his ID card and relevant materials. Article 9 The technical conditions for the safe operation of motorcycles and the exhaust and noise emission standards must comply with the relevant provisions of the state, provinces and special zones. If the pollutants discharged from the tail gas exceed the prescribed standards after inspection, they shall be maintained and treated in accordance with relevant regulations. Article 10 It is forbidden to drive scrapped motorcycles on the road.

It is forbidden to drive the rear three-wheeled motorcycle on the road. Eleventh motorcycles hanging the number plate outside the special zone are prohibited from entering the downtown area; Motorcycles that need to pass through the special zone should follow the route designated by the public security organs.

The scope of the urban central area shall be delineated and announced by the Municipal People's Government.

The public security traffic management department shall set up a sign prohibiting the passage of motorcycles with license plates outside the special zone at the intersection entering the central area of the city. Twelfth prohibit fraudulent use, borrowing the military and armed police motorcycle license plate; It is forbidden for people with local driver's licenses to drive motorcycles with military and armed police licenses. Thirteenth prohibit the use of motorcycles to operate passenger transport. Fourteenth motorcycles should be parked in parking lots (spots) according to regulations, and shall not occupy urban roads and other public places. Measures for the administration of motorcycle parking lots (spots) shall be formulated separately by the Municipal People's Government. Fifteenth motorcycle in any of the following circumstances, the owner shall, within 30 days from the date of scrapping, to the public security traffic management department for vehicle scrapping procedures:

(1) mopeds, two-stroke motorcycles and three-wheeled motorcycles have been registered for 10 year;

(2) Four-stroke two-wheeled motorcycle has been registered 14 years;

(three) the vehicle is seriously damaged or in poor technical condition for various reasons and cannot be repaired;

(four) the motor vehicle still fails to meet the requirements of the national motor vehicle safety technical conditions after repair and adjustment;

(five) after the motor vehicle is repaired or adjusted or the exhaust pollution control technology is adopted, the pollutants discharged still exceed the prescribed emission standards.

After the expiration of the service life of the four-stroke two-wheeled motorcycle specified in Item (2) of the preceding paragraph, if its performance meets the motor vehicle safety technical conditions and pollutant emission standards specified by the state, province and special zone, its use may be postponed, but the longest extension of service life shall not exceed 3 years.

After the motorcycle is scrapped, its body and license plate number are invalid at the same time. If the motorcycle owner fails to go through the scrapping procedures within the time limit specified in the preceding paragraph, the traffic management department of the public security shall forcibly scrap and cancel the files. Sixteenth motorcycles that have reached the retirement age before the implementation of these Provisions can be scrapped within 12 months after the implementation of these Provisions. Seventeenth in violation of the provisions, one of the following acts, given the following penalties by the public security traffic management department:

(a) in violation of the provisions of the first paragraph of Article 10, scrap motorcycle driving on the road, take back the motorcycle license plate and motor vehicle driving license, and order the owner to go through the scrapping procedures, and may be fined in 300 yuan;

(two) in violation of the provisions of the second paragraph of article tenth, after a three-wheeled motorcycle on the road, a fine in 300 yuan. Illegally assembled or unlicensed three-wheeled motorcycles that cannot explain the legal source are on the road, and their vehicles are confiscated;

(three) in violation of the provisions of the first paragraph of article eleventh, the motorcycle with the number plate outside the special zone enters the central area of the city, and is fined 100 yuan;

(4) Whoever, in violation of the provisions of Article 12, fraudulently uses or borrows the motorcycle number plate of the army or the armed police or drives the motorcycle number plate of the army or the armed police with a local driver's license shall be fined 500 yuan;
