Eighth financial, housing and urban and rural construction, transportation, water, land and resources, information and other administrative supervision departments shall supervise the trading activities of public resources in this industry according to law, and mainly perform the following duties:

(1) Examining and filing transaction documents, and supervising important transaction links such as answering questions, bid opening, bid evaluation, bid selection and auction;

(two) to investigate and deal with complaints, and to deal with and punish the illegal acts of project units, bidders (bidders), trading institutions and bid evaluation experts;

(three) in conjunction with the municipal public resources transaction management department to build and manage the enterprise (supplier) library and transaction institution library;

Article 9 The Municipal Public Resource Trading Center is a legal entity of the Municipal Public Resource Trading Administration. It is the centralized trading place, professional service platform and market service subject of the city's public resources trading activities, and mainly performs the following duties:

Chapter III Scope of Transactions

Eleventh public resources transactions to implement the directory system and dynamic management. (three) the transfer of land use rights and mining rights;

(four) the transfer of state-owned property rights, equity and intellectual property rights;

(five) the right to operate special industries, urban roads, roads, bridges, streets, large-scale outdoor commercial advertising, passenger lines and taxis;

(6) Bidding for intermediary services such as planning, land and engineering consulting, agency and evaluation;

(seven) the disposal of assets confiscated by judicial organs and administrative law enforcement departments;

(eight) other projects that should be included in the catalogue of public resources trading projects as stipulated by the state, province and city.

The items listed in the first paragraph of the preceding paragraph shall be traded in the public resource trading center after the implementation of these measures; Items listed in items 2 to 8 shall be traded in the Municipal Public Resource Trading Center gradually, and the specific time shall be decided by the Municipal Public Resource Trading Management Committee.

Thirteenth the following public resources shall not enter the city public resources trading center:

(a) prohibited by laws, regulations and rules;

Chapter IV Trading Methods

After the circumstances listed in the preceding paragraph disappear, the relevant administrative supervision departments decide to resume or terminate the transaction as appropriate.

Twentieth any of the following circumstances, after the approval of the relevant administrative supervision departments, the transaction procedures shall be terminated:

(1) During the transaction, judicial organs, administrative law enforcement organs and arbitration institutions confirm that the project unit has no right to handle the public resources entrusted by it;

Twenty-first construction projects and government procurement projects shall be evaluated by random sampling method, the lowest evaluated bid price method or the comprehensive evaluation method according to the categories and characteristics of the projects.

The municipal public * * * resource transaction management department shall, jointly with the relevant administrative supervision departments, formulate classified bid evaluation methods and templates for construction projects and government procurement projects.

Other transactions shall be handled in accordance with relevant laws and regulations.

Chapter VI Transaction Supervision

Twenty-second public resources transactions should be supervised by the department. Administrative supervision departments such as finance, housing, urban and rural construction, transportation, water affairs, land and resources, and informatization. Responsible for supervising the trading activities within the jurisdiction in accordance with relevant regulations, and investigating and handling illegal acts according to law. Those suspected of committing a crime shall be transferred to judicial organs for handling.

Twenty-third bidders (bidders) or other interested parties believe that the transaction documents, transaction process and transaction results infringe upon their legitimate rights and interests, they can raise objections to the project units and trading institutions in writing within the statutory time limit. Twenty-fourth bidders (bidders) or other interested parties think that the trading activities do not conform to the provisions of laws and regulations, they can complain within the prescribed time limit.

The Supervision Bureau of the Municipal Commission for Discipline Inspection set up a complaint acceptance center in the discipline inspection team and supervision room of the municipal public resource transaction management department, which is responsible for accepting, registering, assigning, supervising and filing complaints.

Twenty-fifth the relevant administrative supervision departments shall investigate the complaint, make a decision within the prescribed time limit, and notify the complainant, the respondent and other parties related to the complaint in writing.

Need inspection, testing, appraisal and expert review, the time required is not counted.

Article 26 If a party refuses to accept the complaint handling decision of the administrative supervision department or the administrative supervision department fails to handle it within the time limit, it may apply for administrative reconsideration or bring an administrative lawsuit to the people's court according to law.

Article 29 The relevant administrative supervision departments shall, jointly with the municipal public resources transaction management department, formulate a "blacklist" system for enterprises and project key position managers with serious bad behaviors, and prohibit enterprises and personnel listed in the "blacklist" from participating in transactions within the city within a certain period of time.

The project key position management personnel mentioned in the preceding paragraph mainly refer to the project manager with corresponding professional qualifications and the person in charge of engineering technology with corresponding titles, as well as the construction, quality, safety and cost management personnel with corresponding post qualifications; Chief supervision engineer, chief supervision engineer's representative, professional supervision engineer and supervisors with corresponding qualifications provided by supervision enterprises in construction projects.

Thirtieth supervisory organs shall supervise the objects of supervision related to public resources trading activities according to law.

Thirty-first audit institutions shall conduct audit supervision over public resources trading projects according to law.

Chapter VII Legal Liability

Thirty-second project units and their staff have the following acts, which shall be ordered by the relevant administrative supervision departments to make corrections and may also be fined; If it constitutes a violation of discipline, the directly responsible person in charge and other directly responsible personnel of the unit shall be punished; Suspected of a crime, transferred to judicial organs:

(1) Invited bidding or other procurement methods should be adopted according to law (open bidding);

(two) to restrict or exclude potential bidders (bidders) with unreasonable conditions;

(3) colluding with the project design unit, the unit preparing the bill of quantities, trading institutions, bidders (bidders) or members of the bid evaluation committee;

(four) other acts in violation of relevant laws and regulations.

Thirty-third bidders (bidders) and their staff have the following acts, the relevant administrative supervision departments shall order them to make corrections and may also impose a fine; If the circumstances are serious, record bad records until they are included in the "blacklist"; Suspected of a crime, transferred to judicial organs:

Thirty-fourth trading institutions and their staff have the following acts, the relevant administrative supervision departments shall impose fines and confiscate the illegal income; If the circumstances are serious, suspend or even cancel the qualification of trading agent; Suspected of a crime, transferred to judicial organs:

(1) disclosing information or materials related to trading activities that should be kept confidential;

(two) colluding with the project unit and the bidder (bidder) to harm the national interests, social public interests or the legitimate rights and interests of others;

(3) Concealing or destroying the transaction documents that should be kept, or forging or altering the transaction documents.

(four) other acts in violation of relevant laws and regulations.

(six) other acts in violation of relevant laws and regulations.

Article 38 State organs, institutions and their staff who violate the provisions of these Measures by neglecting their duties, revealing secrets, abusing their powers, engaging in malpractices for selfish ends, and soliciting and accepting bribes in public resources trading activities shall be investigated and dealt with by the competent authorities or supervisory organs according to law; Those suspected of committing a crime shall be transferred to judicial organs for handling.

Chapter VIII Supplementary Provisions

Thirty-ninth Wuwei County, Wuhu County, Fanchang County and Nanling County may refer to these measures.

Fortieth these Measures shall come into force as of April 20 1 April 41day, and the Municipal Resources Exchange Bureau shall be responsible for the interpretation.
