Regulations of Chongqing Municipality on Water Traffic Safety Management (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the management of water traffic safety, maintain the order of water traffic, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Regulations of People's Republic of China (PRC) on the Administration of Inland River Traffic Safety and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to navigation, berthing, operation and other activities in navigable waters and activities related to water traffic safety in non-navigable waters within the administrative area of this Municipality.

Water traffic safety management of fishing vessels and fishing port waters within the administrative area of this Municipality shall be implemented with reference to these regulations. Article 3 Water traffic safety management shall follow the principles of safety first, prevention first, convenience for the masses and management according to law, and implement comprehensive management to ensure safe, orderly and smooth water traffic. Article 4 People's governments of cities, districts and counties (autonomous counties) shall strengthen water traffic safety management, establish and improve the responsibility system for water traffic safety management, coordinate and solve major problems in water traffic safety management, formulate emergency rescue plans for water traffic safety accidents, implement personnel, equipment and funds, and ensure the normal development of emergency rescue work.

Township (town) people's governments and sub-district offices shall perform the following duties in the management of water traffic safety within their respective administrative areas:

(a) to establish and improve the village (neighborhood) committee and the ship owner and operator's responsibility system for ship safety;

(two) the implementation of ferry ships, crew and passengers quota safety management responsibility system and passenger ferry ship navigation management system;

(three) to be responsible for the administration of ship registration in towns and villages within their respective administrative areas;

(four) to determine the special water traffic safety management personnel;

(five) the organization of safety publicity, safety inspection, safety hidden dangers rectification inspectors, safety management personnel assessment;

(six) to urge the ship owners, operators and crew members to abide by the laws, regulations and rules relating to inland river traffic safety. Article 5 The traffic administrative department shall be responsible for the management of water traffic safety in navigable waters within the administrative area of this Municipality, and its maritime administrative agency shall specifically implement the supervision and management of water traffic safety in navigable waters under its jurisdiction.

The fishery administrative department is responsible for the implementation of safety supervision and management of fishing vessels and fishing port waters within the administrative area of this Municipality.

Public security, water conservancy, environmental protection, municipal administration, tourism, sports, gardens and other relevant administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of water traffic safety.

The Yangtze River maritime administrative agency shall, in accordance with its duties, supervise and manage the water traffic safety in the waters under its jurisdiction. Sixth water traffic safety management to implement the owner and operator responsibility system.

Owners and operators of ships and floating facilities shall strengthen the safety management of ships and floating facilities, establish and improve the safety management system, engage in navigation, berthing and operations and activities related to water traffic safety in accordance with regulations, and be responsible for the traffic safety of their ships and floating facilities. Seventh reservoirs, scenic spots, nature reserves, urban gardens and other non navigable waters management agencies and operators, responsible for the daily management and maintenance of water traffic safety in the waters under their jurisdiction.

Management agencies should strengthen the supervision and management of traffic safety in the waters under their jurisdiction; For water catering and entertainment operations, operators of water catering and entertainment should also be urged to establish and improve safety management systems and emergency rescue plans, and conduct regular drills.

Water catering and entertainment operators shall implement safety measures, set up obvious safety signs and isolation facilities in the waters they operate to ensure the safety of water catering and entertainment activities. Chapter II Ships, Floating Installations and Crew Article 8 Ships and floating installations shall apply to the ship registration authority for ship registration in accordance with the Regulations of the People's Republic of China on Ship Registration.

Sports and fishing vessels shall apply to the competent authorities for registration in accordance with the relevant provisions of the state.

A ship for self-use in a township shall apply for registration with the township people's government where the ship owner has his domicile or habitual residence.

Drifting boats (rafts) and other water catering and entertainment vessels in non-navigable waters such as reservoirs, scenic spots, nature reserves and urban gardens shall be registered with their management agencies. Article 9 The owners and operators of vessels and floating facilities shall perform the following obligations:

(a) establish and improve the internal safety supervision institutions, equipped with safety management personnel;

(2) manning the crew as required. Arrange the work on duty reasonably to ensure the rest time of the crew; Employ seafarers with certificates of competency or other certificates of competency; Conduct regular safety education and technical training for crew members; Do not instigate or force the crew to operate illegally;

(three) to formulate the dispatching, use, repair and maintenance system and operating rules for ships and floating facilities, and improve the safety production and labor protection measures;

(four) to supervise and inspect the safety work, eliminate the hidden dangers of production safety in time, and report the water traffic accidents according to the regulations;

(five) to organize the formulation and implementation of safety emergency rescue plans and conduct regular drills;

(6) Capital and technical investment needed to ensure safe production and safety management;

(seven) other duties as prescribed by laws and regulations. Article 10 The traffic administrative department shall plan and manage the setting of catering and entertainment barges in navigable waters.

In addition to the provisions of Article 9, the owners and operators of barges engaged in catering and entertainment in navigable waters shall also abide by the following provisions:

(a) in accordance with the provisions of the "Regulations of Chongqing Municipality on Waterway Management" and other laws and regulations, conduct navigation safety assessment;

(two) parking areas and parking methods in accordance with the provisions of the port and shipping management agencies;

(3) In accordance with the provisions of the traffic administrative department, equip with corresponding fire fighting, lifesaving and pollution prevention equipment, and set up auxiliary facilities to ensure the safe passage of ships and personnel;

(four) to prevent water pollution in navigable waters in accordance with the regulations on the prevention and control of water pollution in the Three Gorges reservoir area and river basins in Chongqing.
