Measures of Kunming Municipality on the Administration of Automobile Maintenance

Chapter I General Provisions Article 1 In order to strengthen the management of automobile maintenance in Kunming, improve the quality of maintenance, ensure the good technical condition of vehicles, maintain the safety of road transportation, and protect the legitimate rights and interests of both automobile maintenance operators and customers, these measures are formulated in accordance with the Regulations of Yunnan Province on the Administration of Road Transportation and other relevant provisions, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to enterprises or households (hereinafter referred to as automobile maintenance operators) engaged in automobile maintenance (including automobile beauty and automobile rescue), motorcycle maintenance, automobile comprehensive performance testing and passenger vehicle safety inspection within the administrative area of this Municipality, as well as operators engaged in passenger and freight transportation. Third city traffic administrative departments in charge of the city's automobile maintenance management, county (city), district traffic administrative departments in charge of the area of automobile maintenance management.

Industry and commerce, public security, quality and technical supervision, environmental protection, planning, taxation, labor and other departments should assist in the management of automobile maintenance according to their respective responsibilities. Fourth city, county (city), the main responsibilities of the district automobile maintenance management department are:

(a) to implement the relevant national, provincial and municipal laws, regulations, guidelines and policies, and formulate industry development plans according to local conditions;

(two) responsible for the examination and approval of automobile maintenance road transport business license and technical level audit;

(three) responsible for automobile maintenance technology and information exchange;

(four) to supervise and inspect the quality of automobile maintenance;

(five) responsible for the technical management of operating vehicles, supervise the regular secondary maintenance of operating vehicles, and evaluate the technical level of safe operation of vehicles;

(six) technical training management of automobile maintenance practitioners;

(seven) mediation of automobile maintenance quality disputes. Chapter II Qualification Management Article 5 Classification of automobile maintenance technical qualifications:

(a) a class of automobile maintenance enterprises can engage in automobile overhaul, assembly overhaul, automobile maintenance and special repair;

(two) two kinds of automobile maintenance enterprises, can engage in automobile maintenance, special repair;

(three) three types of automobile maintenance operators can engage in minor repairs and special maintenance of automobiles.

Special repairs include car beauty, car rescue repair, car quick repair, car body repair, painting, paint mixing, tarpaulin, seat cushion and interior decoration repair, electrical appliances, instrument and battery repair, radiator and oil tank repair, tire repair, four-wheel alignment repair, window glass repair and installation, air conditioning repair, heater repair, fuel injector, fuel injection pump, carburetor repair, crankshaft grinding, cylinder boring and grinding, and auto parts repair.

Motorcycle maintenance is divided into motorcycle repair and motorcycle maintenance. Article 6 Automobile maintenance operators must meet the national, provincial and municipal automobile maintenance opening standards and have facilities and technical conditions suitable for their business categories:

(1) Having a special maintenance site, workshop and parking lot;

(two) engineering and technical personnel, quality inspection personnel, skilled workers and management personnel should have the corresponding qualification certificates and certificates;

(3) Having special equipment for automobile maintenance, general equipment, testing equipment and measuring instruments;

(4) Having liquidity suitable for its category;

(five) the establishment of automobile maintenance quality management system;

(six) have the conditions for safe production, establish safe operation procedures, equipped with perfect fire safety facilities;

(seven) in line with the requirements of environmental protection, there are corresponding waste oil, waste water, waste gas and waste treatment equipment. Article 7 Whoever engages in the following automobile maintenance shall also meet the following conditions:

(a) to undertake the maintenance of special vehicles, it shall have corresponding special equipment and facilities;

(two) to undertake automobile rescue and maintenance, it shall be equipped with tractors, rescue and maintenance engineering vehicles and communication tools;

(3) Class I and II automobile maintenance operators and operators undertaking automobile exhaust emission control shall be equipped with detection, diagnosis and maintenance equipment and professional technicians for automobile exhaust emission control. Eighth units and individuals engaged in automobile and motorcycle maintenance, automobile comprehensive performance testing and passenger vehicle safety inspection shall submit a written application to the local automobile maintenance management department with relevant business information. In line with the operating conditions, the automobile maintenance management department shall give approval within 15 days from the date of accepting the application, and issue the automobile maintenance road transport business license. Operators can only operate after obtaining the business license and tax registration certificate with this certificate. Among them, a class of automobile maintenance operators should first go through the environmental protection examination and approval procedures with the competent administrative department of environmental protection, and then submit a written application to the automobile maintenance management department. Do not meet the operating conditions, the automobile maintenance management department shall inform the reasons for disapproval.

After obtaining the relevant license, the automobile maintenance operator shall go through the public security management filing formalities with the public security organ within 15 days. Article 9 Where the business address, enterprise name, legal representative or person-in-charge of an automobile maintenance operator is changed or the enterprise is restructured, it shall go through the relevant formalities at the administrative department for industry and commerce and report to the automobile maintenance management department.

If an automobile maintenance operator goes out of business, it shall file a record with the automobile maintenance management department and go through the relevant formalities with the industrial and commercial and tax departments.

Where an automobile maintenance operator establishes a branch, it shall report to the automobile maintenance management department and go through the relevant formalities. Article 10 The technical qualification of automobile maintenance shall be subject to the annual inspection system. The automobile maintenance management department shall, according to the changes in the technical conditions of the operators, approve the lifting of the technical qualification category of maintenance. Those who fail to participate in the annual review on schedule or fail to pass the annual review shall not continue to operate.
