Staff members included in the scope of civil servants must meet the following conditions at the same time: (1) perform public duties in accordance with the law; (2) be included in the national administrative establishment; (3) have wages and benefits borne by the state finance. ?Article 4 stipulates that staff members other than service personnel in the following agencies are included in the scope of civil servants: (1) Agencies of the Communist Party of China at all levels; (2) People’s congresses at all levels and their standing committees; ( 3) Administrative agencies at all levels; (4) Committees of the Chinese People’s Political Consultative Conference at all levels; (5) Supervisory agencies at all levels; (6) Judicial agencies at all levels; (7) Procuratorates at all levels; (8) All democratic parties and agencies at all levels of the Federation of Industry and Commerce. Article 5 stipulates that the persons included in the scope of civil servants in the organs of the Communist Party of China at all levels: (1) leaders of the central and local party committees and disciplinary inspection committees; (2) working departments of the central and local party committees at all levels , staff of offices and dispatched agencies; (3) Central and local disciplinary inspection commissions at all levels and their staff assigned to party and state agencies or dispatched agencies; (4) Work of sub-district, township and town party committees personnel. ?Article 6 stipulates that the persons included in the scope of civil servants in the People's Congresses at all levels and their standing committees are: (1) Leaders of the Standing Committees of the People's Congresses at or above the county level, chairmen and vice-chairmen of the township and town People's Congresses ; (2) Staff members of the working bodies and offices of the Standing Committees of the People's Congresses at or above the county level;

(3) Staff members of the working bodies of the special committees of the People's Congresses at or above the county level. ?Article 7 stipulates that the personnel included in the scope of civil servants in administrative agencies at all levels: (1) leaders of the people's governments at all levels; (2) staff of the working departments and dispatched agencies of the people's governments at or above the county level; (3) ) Staff members of township and town people's government agencies.
