Handling Results of Law Enforcement Conflicts in Linwu, Hunan Province

Handling result of law enforcement conflict in Linwu, Hunan Province: Yongxing County Court of Hunan Province 1 1 year. After the judgment of the first instance, all four appealed. On May 15, Chenzhou Intermediate People's Court rejected the appeal in the second instance and upheld the original judgment.

On July 13 and July/20 17, law enforcement officers of urban management in Linwu County had a dispute with the local melon farmer Deng Zhengjia and his wife. In the conflict, Deng Zhengjia fell to the ground and died. This incident has aroused widespread concern in society. After the incident, the staff of the urban management bureau involved were detained, and Chen Hu, director of the urban management bureau, and Zou Hongwei, deputy secretary of the party group, were dismissed.

It was found through court trial that Liao Weichang and others patrolled a section of Jiefang South Road in Chengguan Town, Linwu County at around July 13 17, 1965, and found that Deng Zhengjia and his wife had not set up a stall to sell watermelons in the area designated by the urban management, and they "temporarily detained" four watermelons and a steelyard in the case of unsuccessful persuasion. Mr. and Mrs. Deng Zhengjia stopped them, and the staff of the Urban Management Bureau told Mr. and Mrs. Deng Zhengjia to go to the Urban Management Bureau to deal with them, and then left.

On the same day 1 1, the defendant Liao Weichang and others patrolled near the designated area of farmers' self-production and marketing on Linwu Avenue, and his wife Huang, who was transferred here to sell watermelons, found that Huang had insulted Liao Weichang and others. Liao Weichang and others ignored it and went to the opposite side to deal with other illegal vendors.

Because Huang has been insulting Liao Weichang and others, Liao Weichang photographed the situation with his mobile phone. Huang held up a watermelon and smashed Liao Weichang, poked Liao Weichang with a scale, and Liao Weichang, Luo Weiping, Xia and others grabbed the scale together. Liao Weichang hit him in the head and face first, then Luo Weiping and Xia also hit him. Deng Zhengjia fell to the ground dead. After forensic identification, Deng Zhengjia's abnormal rupture of blood vessels at the junction of cerebellum and pontine sulcus of brain stem caused subarachnoid hemorrhage and death.

According to the court, after the incident, the defendants Liao Weichang, Luo Weiping and Xia went to Linwu County Public Security Bureau to voluntarily surrender and truthfully confessed their crimes.

After the trial, the court held that the actions of the four defendants had constituted the crime of intentional injury. In the crime of joint intentional injury, Liao Weichang and Cheng Yuanqi are the principal offenders. Luo Weiping and Xia played a secondary role and were accomplices. After the incident, the four defendants voluntarily surrendered to the public security organs and truthfully confessed their crimes, all of which surrendered themselves.
