The problem of rural homestead land

(5) Strict application conditions for homesteads. Resolutely implement the legal provisions of "one household, one house". Rural villagers can only own one homestead per household, and the area must not exceed the standards stipulated by the province (autonomous region, city). All localities should formulate unified rural homestead area standards and homestead application conditions based on local realities. Those who do not meet the application conditions shall not be approved for homesteading.

Rural villagers who have sold, rented or donated their original houses to others and then apply for homestead shall not be approved.

(6) Standardize the application and approval procedures for rural homestead land. If rural villagers need to use homestead land to build houses, they should apply to the collective economic organization and publish it in the collective economic organization or villagers' group. If there is no objection after the expiration of the announcement period, it will be reported to the township (town) for review and then to the county (city) for approval. For homestead sites approved in accordance with the law, rural collective economic organizations or villagers' groups should publish the approval results in a timely manner.

Since the situation in different places is different, the homestead area standards and application conditions set by each province are also different. The general regulations are: rural villagers applying for homestead must meet one of the following conditions: 1. Current housing Affecting the construction planning of the township (town) village and requiring relocation and reconstruction; 2. Except for one child left by a rural household, the other children really need to establish a new household and the existing homestead is lower than the standard for household division; 3. After being approved by the competent department Approved, farmers who have moved in from other places have no housing; 4. Technical personnel recruited by collective organizations are required to settle in the local area and their household registration has been moved; 5. Retired, retired, resigned cadres and employees, retired military personnel, overseas Chinese, and their family members, Compatriots from Hong Kong, Macao and Taiwan who have returned to their hometowns to settle down with legal certificates and need to build a house but do not have a homestead.
