Regulations of Luoyang Municipality on Gas Management (revised on 20 15)

Chapter I General Provisions Article 1 In order to strengthen the management of gas in this Municipality, standardize the operation and use of gas, safeguard the legitimate rights and interests of gas users and gas trading enterprises, safeguard the safety of citizens' lives and property and public interests, and promote the healthy development of gas industry, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Urban Gas and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to related management and service activities such as gas planning and construction, emergency support, gas operation service, gas use, gas safety management and supervision, and gas safety accident prevention and treatment within the administrative area of this Municipality. Article 3 The municipal and county (city) people's governments shall strengthen their leadership over gas work, incorporate the construction and development of gas industry into the national economic and social development plan, increase investment in gas construction, establish a work coordination mechanism, a gas emergency reserve system and a gas accident emergency disposal mechanism, and deal with major issues in gas management in a timely manner. Fourth city housing and urban and rural construction management department (hereinafter referred to as the municipal gas management department) is responsible for the city's gas management, and its subordinate gas management agencies are responsible for daily management.

County (city) housing and urban and rural construction (urban management, municipal utilities) management department is responsible for the gas management within their respective administrative areas.

The people's governments of municipal districts, township (town) people's governments and sub-district offices shall, in accordance with the requirements of higher-level government departments, cooperate with relevant departments to do a good job in gas safety management within their respective jurisdictions.

Development and reform, industry and information technology, public security, land and resources, environmental protection, transportation, commerce, industry and commerce, quality and technical supervision, production safety supervision, planning, meteorology and other relevant departments shall, according to their respective responsibilities, do a good job in gas management. Fifth city, county (city) gas management departments and gas trading enterprises should strengthen the publicity of gas laws, regulations and knowledge of gas safety use, enhance public awareness of gas safety, and improve gas safety use skills.

Radio, television, newspapers, internet and other media should publicize the safety and economical use of gas for public welfare. Chapter II Gas Planning, Construction and Emergency Protection Article 6 The municipal and county (city) gas management departments shall, jointly with relevant departments, formulate gas development plans in their respective administrative areas according to the national economic and social development plans, the overall land use plans, the urban and rural planning, the energy planning and the gas development plans at the next higher level, and organize their implementation after being approved by the people's government at the same level. And report to the gas management department of the people's government at the next higher level for the record.

After the approval of the gas development plan, which involves the spatial layout and land demand, it should be included in the detailed planning of the city. Article 7 In the construction of new urban areas, the renovation of old urban areas and the construction (renovation and expansion) of urban roads, gas facilities shall be built in accordance with the gas development plan or land for the construction of gas facilities shall be reserved.

Supporting the construction of gas facilities, should be synchronized with the main project of the construction project planning, synchronous design, synchronous construction, synchronous acceptance, synchronous transfer of construction files.

Without legal procedures, the reserved land for the construction of gas facilities shall not be changed. Eighth new (renovation, expansion) gas facilities construction projects shall carry out safety pre-evaluation and acceptance evaluation according to law, and equipped with corresponding safety facilities. Safety facilities must be designed, constructed and put into production and use simultaneously with the main project. The safety evaluation report shall be reported to the gas management department for the record. Ninth gas facilities construction project survey, design, construction, supervision and other activities should be undertaken by units with corresponding qualifications, and accept the supervision of engineering quality supervision institutions according to law.

When carrying out engineering design, the construction unit shall strictly follow the national technical specifications to ensure the safe distance between the surrounding buildings and gas facilities. Tenth gas facilities after the completion of the construction project, the construction unit shall organize the completion acceptance according to law, and within fifteen days from the date of completion acceptance, the completion acceptance will be reported to the gas management department for the record. Without acceptance or unqualified acceptance, it shall not be put into use.

After the gas facilities construction project is qualified according to law, the construction unit shall hand over the construction project files to the urban construction archives management institution in accordance with the regulations. Eleventh city and county (city) people's government shall establish and improve the gas emergency reserve system.

The development and reform department shall, jointly with the gas management department, formulate a gas emergency reserve plan, and determine the layout, total amount and activation requirements. According to the actual situation of gas supply, planning and construction of emergency gas source reserve facilities. The plan was implemented after being approved by the people's government at the same level.

The gas management department shall, jointly with relevant departments, monitor and warn the gas supply and market demand of all kinds of gas, and report to the people's government at the corresponding level in a timely manner when finding a major imbalance between supply and demand. Chapter III Gas Operation and Service Article 12 A licensing system shall be implemented for gas operation. The gas management department shall announce the conditions and procedures for the gas business license and simplify the examination and approval procedures.

The gas business license is valid for five years. If an extension is needed, the gas business enterprise shall apply to the original license issuing department 30 days before the expiration of the validity period of the license, and apply for a new license after passing the examination. Thirteenth city, county (city) people's government or its authorized gas management department shall, in accordance with the provisions of relevant laws and regulations, through the market competition mechanism, select pipeline gas investment enterprises or operating enterprises by tender, and sign a franchise agreement. The franchise agreement shall specify the content, area, scope, validity period and service standard of the franchise.

The franchise of pipeline gas shall follow the principles of openness, fairness, justice and public interest priority.
