Measures of Shandong Province on Safety Supervision and Management of Agricultural Machinery

Chapter I General Provisions Article 1 In order to strengthen the safety supervision and management of agricultural machinery, give full play to the role of agricultural machinery in agricultural production, and ensure the safety of people's lives and property, these measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 The term "agricultural machinery" as mentioned in these Measures refers to tractors and their supporting farm tools (including trailers), combine harvesters, internal combustion engines, threshers, shredders, hay cutters and other agricultural and sideline products processing machinery and other machinery engaged in agricultural production. Third units and individuals that own and use agricultural machinery within the administrative area of this province must abide by these measures. Article 4 The administrative departments of agricultural machinery at or above the county level shall be in charge of the safety supervision and management of agricultural machinery within their respective jurisdictions, and their subordinate agricultural machinery safety supervision and management institutions (hereinafter referred to as agricultural machinery supervision institutions) shall be responsible for the implementation of these Measures.

The township agricultural machinery management service station undertakes the safety supervision and management of the township agricultural machinery. Fifth agricultural machinery safety supervision and management work should implement the policy of safety first and prevention first, and adhere to the principles of serving the construction of high quality, high yield and high efficiency agriculture, serving agricultural mechanization and serving farmers. Sixth main responsibilities of agricultural machinery supervision organs:

(a) to be responsible for the inspection, certification, assessment and licensing of agricultural machinery and its drivers and operators;

(two) publicity of agricultural machinery safety supervision and management regulations, safety education for drivers and operators;

(three) to carry out safety inspection on agricultural machinery driving or operating outside urban roads and highways, and investigate and deal with illegal acts;

(four) responsible for the statistics of agricultural machinery accidents and the handling of agricultural machinery accidents outside the road;

(five) to carry out the supervision and management of agricultural socialization services in various places;

(six) to establish and improve the agricultural machinery and drivers and operators files.

Agricultural machinery supervision organs need to carry out agricultural machinery safety inspection on the road, according to the relevant provisions of the state. Article 7 When performing official duties, the staff of agricultural machinery supervision organs shall carry certificates and wear signs. Eighth tractors engaged in both farmland operations and transportation are engaged in transportation on the road, which shall be managed by the public security traffic management department in accordance with the laws and regulations on road traffic safety management and road transportation management.

The tractor safety technical inspection, driver's test and road driver's license as mentioned in the preceding paragraph shall be handled by the provincial public security organ entrusted by the provincial agricultural machinery management department and have the right to supervise and inspect. Chapter II Management of Agricultural Machinery Article 9 Units producing agricultural machinery shall be responsible for the quality of agricultural machinery. Agricultural machinery produced must be qualified by the appraisal department before it can be sold. Tenth tractors, combine harvesters and threshers shall be subject to license management.

Before the agricultural machinery under license management is put into use, it shall go through the settlement and license application procedures with the local agricultural machinery supervision organ. Agricultural machinery without license and license is not allowed to be put into use.

When issuing licenses, agricultural machinery supervision organs shall inspect agricultural machinery. Eleventh the implementation of license management of agricultural machinery, ownership transfer or lease to use outside the county or change the name of the head of the household, must go to the agricultural machinery supervision organs for registration of change. Twelfth agricultural machinery warehousing and scrapping shall go through the warehousing and scrapping procedures with the agricultural machinery supervision organ. Agricultural machinery that has been sealed and scrapped shall not be used. Thirteenth agricultural machinery license shall not be lent, altered or forged. Fourteenth agricultural machinery license plate must be installed in the designated location, and keep clear.

Agricultural machinery driving license or work permit shall be carried randomly. Fifteenth of the certified agricultural machinery to implement the annual inspection system. Those who pass the inspection shall be issued with inspection marks; Without inspection or inspection unqualified, are not allowed to continue to use. Sixteenth agricultural machinery must be kept in good condition, safety equipment and mechanical devices must be complete and effective. Seventeenth tractor suspension, traction supporting agricultural tools, must match the tractor power. The trailer must be equipped with a braking device, and it is not allowed to expand or raise the trailer box board without authorization. Eighteenth agricultural machinery in flammable sites, must be equipped with fire cover. Nineteenth crawler tractors, combine harvesters through crowded or dangerous areas, there should be a special person to protect the line. Chapter III Management of Drivers and Operators Article 20 Drivers and operators of agricultural machinery must receive training in accordance with regulations, pass the examination by agricultural machinery supervision organs, and obtain driver's licenses and operation certificates before driving and operating. Twenty-first agricultural machinery drivers and operators need to drive, operate agricultural machinery driving (operation) other than the driver's license and operation certificate, and shall go through the formalities of increasing driving at the agricultural machinery supervision organ. Twenty-second drivers and operators in the local area or this license record changes, must go through the registration formalities with the agricultural machinery supervision organs. Twenty-third driver's license and operation certificate shall not be lent, altered or forged. Twenty-fourth agricultural machinery drivers and operators must accept the inspection of agricultural machinery supervision organs in accordance with the provisions. Those who did not take the exam or failed the exam shall not continue to drive and operate. Twenty-fifth agricultural machinery drivers and operators must comply with the following provisions:

(a) driving and operating agricultural machinery, the driver must carry a driver's license and driving license; Operators must carry their operation certificates and work certificates.

(two) are not allowed to give agricultural machinery to unlicensed personnel to drive and operate.

(three) are not allowed to drive and operate agricultural machinery that does not conform to the driver's license and operation certificate.

(four) are not allowed to drink driving and operating agricultural machinery.

(five) are not allowed to drive and operate agricultural machinery with incomplete safety devices or mechanical failure.

(six) are not allowed to drive or operate agricultural machinery when suffering from diseases that hinder safe operation or excessive fatigue.

(seven) when driving tractors and combine harvesters, smoking, eating, chatting or other behaviors that hinder safe driving are not allowed.

When driving and operating agricultural machinery, in addition to the provisions of the preceding paragraph, drivers and operators of agricultural machinery must also abide by the safety operation rules of agricultural machinery.
