Interim Measures of Lu 'an Municipality on the Supervision and Administration of Elevator Safety

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce elevator accidents, and ensure personal and property safety, these measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Regulations of the State Council on Safety Supervision of Special Equipment and the Measures of Anhui Province on Supervision and Administration of Elevator Safety, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the installation, renovation, maintenance, use, maintenance, inspection, safety assessment, emergency rescue, supervision and management of elevators within the administrative area of this Municipality.

The term "elevator" as mentioned in these Measures refers to mechanical and electrical equipment that is driven by power and uses boxes running along rigid guide rails or steps running along fixed lines to lift or transport people and goods in parallel, including manned (cargo) elevators, escalators and moving sidewalks. Except for elevators installed in non-public places and used only by a single family. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership over elevator safety work, establish and improve the coordination mechanism for elevator quality and safety work, implement necessary working funds, urge relevant departments to perform their duties according to law, coordinate and solve problems in elevator safety management in a timely manner, and formulate special maintenance funds for property for the maintenance, renovation and renewal of old elevators.

Lu 'an Economic and Technological Development Zone Management Committee shall, in accordance with its duties, implement elevator safety supervision and management within its scope of duties.

Township (town) people's governments and sub-district offices shall, in accordance with their duties, strengthen supervision and inspection of the use of elevators within their respective administrative areas, assist relevant departments to perform their duties of elevator safety supervision and management according to law, incorporate elevator management into the service quality assessment of property service enterprises, and co-ordinate elevator maintenance, renovation, renewal and fund-raising in residential areas. Article 4 The department responsible for the safety supervision and management of special equipment of the people's governments of cities and counties (districts) (hereinafter referred to as the safety supervision and management department of special equipment) shall be responsible for the safety supervision and management of elevators within their respective administrative areas.

The administrative department of housing and urban-rural construction is responsible for the supervision and management of elevator specifications and quantity configuration, the design review of elevator machine room, hoistway and pit, the quality supervision of elevator machine room, hoistway and pit, and the supervision and management of property special maintenance funds jointly with relevant departments, urging the construction unit to perform elevator safety management duties before the elevator is delivered for use.

The administrative department in charge of property management is responsible for urging the property service enterprises to perform elevator management duties, and guiding the owners to use the special property maintenance funds to repair, transform and update the elevators according to law.

The emergency management department is responsible for the comprehensive supervision and management of elevator safety, organizing or participating in the investigation and handling of elevator safety accidents according to the authorization of the government at the same level, and supervising the implementation of accident investigation and handling and accountability.

Development and reform, public security, education, finance, economy and information technology, transportation, commerce, health, tourism, public resources transaction supervision and other relevant departments shall, in accordance with their respective responsibilities, cooperate in elevator safety supervision and management. Fifth special equipment safety supervision and management departments should strengthen the publicity and education of elevator safety knowledge, and enhance public safety awareness and self-protection ability.

Elevator users should guide the public to take the elevator safely and civilized.

Schools and kindergartens should strengthen elevator safety knowledge education, and enhance students' and children's awareness of safe and civilized use of elevators. Article 6 The elevator industry association shall establish an industry self-discipline mechanism, formulate and improve industry norms, carry out industry information analysis and research and service quality evaluation, provide education, training and consulting services, participate in industry integrity management, and promote the healthy development of the industry. Seventh encourage elevator installation, renovation, maintenance, use, maintenance and other units and testing institutions to take out elevator safety liability insurance.

Elevator users in schools, kindergartens, hospitals, stations, footbridges, shopping malls, stadiums, tourist attractions, exhibition halls and other public gathering places shall take out elevator safety liability insurance in accordance with relevant regulations. Chapter II Installation, Renovation and Maintenance Article 8 When designing elevator equipment, a construction engineering design unit shall implement relevant state regulations and standards. Do not meet the requirements, the construction drawing review agency shall not issue a review document. Article 9 The construction unit shall purchase and configure elevators in accordance with relevant safety technical specifications and standards, and perform the following obligations:

(1) Civil works such as elevator machine room, shaft, pit, embedded guide rail support, etc. It shall conform to the national standards and the design requirements of construction projects; The shaft shall meet the technical conditions for elevator installation and operation; Pit should be flat, anti-leakage, no water;

(two) the selection and configuration of elevators should adapt to the requirements of building structure and use, and meet the requirements of first aid, fire fighting and barrier-free access;

(three) the computer room should be equipped with air conditioning and other ventilation and cooling facilities;

(4) realizing the signal coverage of the public mobile communication network in the elevator car or installing an elevator fault monitoring system;

(five) timely transfer of elevator safety technical files to the elevator owner;

(six) to undertake the warranty responsibility of civil engineering such as elevator room, shaft and pit during the warranty period of the building.

If the first item of the preceding paragraph does not meet the national standards and the design requirements of construction projects, the safety supervision and management department of special equipment shall not handle the registration of elevator use, and the administrative department of housing and urban and rural construction shall not complete the acceptance for the record.
