Regulations of Jinan Municipality on the Administration of Automobile Maintenance

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Road Transportation and relevant laws and regulations, combined with the actual situation of this Municipality, in order to standardize the operation of automobile maintenance, protect the legitimate rights and interests of the parties involved in automobile maintenance and maintain the order of the automobile maintenance market. Article 2 Units and individuals engaged in automobile maintenance and operation within the administrative area of this Municipality shall abide by these regulations. Article 3 The traffic administrative departments of cities, counties (cities), Licheng District and Changqing District shall be responsible for organizing and leading the management of automobile maintenance within their respective administrative areas; Automobile maintenance management agencies are responsible for the specific implementation of automobile maintenance management. Article 4 Departments of industry and commerce administration, price, quality and technical supervision, environmental protection, labor and social security, public security, safety production supervision and urban management administrative law enforcement shall, according to their respective functions and duties, do a good job in the management of automobile maintenance according to law. Fifth automobile maintenance management should follow the principles of openness, fairness, justice and convenience. Encourage automobile maintenance operators to implement intensive, specialized and chain-like operation, promote the network construction of maintenance services, and promote the rational division of labor and coordinated development of automobile maintenance industry. Article 6 Automobile maintenance operators shall operate according to law, be honest and trustworthy, and compete fairly. Chapter II Business License Article 7 This Municipality implements the system of automobile maintenance business license. The automobile maintenance business license shall be implemented in accordance with the classification standards of automobile maintenance business enterprises stipulated by the state. Article 8 Automobile maintenance business licenses include: Class I, Class II and Class III automobile maintenance business licenses and dangerous goods transport vehicle maintenance business licenses. The specific licensing items are as follows:

(1) Class I automobile maintenance business license refers to all businesses that can engage in automobile maintenance completion inspection and Class II automobile maintenance business license.

(2) The second-class automobile maintenance business license refers to all businesses that can engage in automobile repair, assembly repair, daily maintenance, first-class maintenance, second-class maintenance, minor repair, maintenance rescue and third-class automobile maintenance business license.

(3) Class III automobile maintenance business license refers to the ability to engage in engine maintenance, body maintenance, electrical system maintenance, automatic transmission maintenance, fuel injection pump and injector maintenance, radiator (water tank) maintenance, air conditioning maintenance, body cleaning maintenance, painting, tire dynamic balance and repair, four-wheel alignment detection and adjustment, oil supply system maintenance and oil product replacement, crankshaft grinding, cylinder boring and grinding, and vehicle decoration (tarpaulin, cushion and interior decoration).

(four) the license for the maintenance and operation of dangerous goods transport vehicles refers to all automobile maintenance and operation licenses that can transport flammable, explosive, corrosive, radioactive and highly toxic substances. Article 9 Units and individuals applying to engage in automobile maintenance business shall, in accordance with the provisions of the state, have venues, factories, equipment, facilities, technicians, maintenance management systems and environmental protection measures that are suitable for business operations.

Automobile maintenance technicians engaged in machine maintenance, electrical appliances, sheet metal, painting, vehicle technical evaluation, price settlement, business reception and quality inspection shall obtain corresponding qualification certificates in accordance with relevant national and provincial regulations.

Engaged in automobile maintenance business shall not use the venues of primary and secondary schools and kindergartens, and shall not engage in dangerous goods transport vehicle maintenance and automobile maintenance business that produces noise, harmful gases and other pollution in densely populated areas such as residential areas and commercial areas. Tenth in Lixia District, Shizhong District, Huaiyin District, tianqiao district administrative region to apply for car maintenance and management units and individuals, to the city car maintenance management agencies to apply; Units and individuals applying to engage in automobile maintenance and management within the administrative areas of counties (cities), Licheng District and Changqing District shall apply to the local county-level automobile maintenance and management institutions. The following materials shall be submitted when applying:

(1) an application;

(2) The original and photocopy of the applicant's identity certificate;

(three) the list of technical personnel to be employed and the professional title certificate, technical skill qualification certificate and qualification certificate;

(four) the original and photocopy of the certificate of the right to use the business premises;

(five) the original and photocopy of the list of equipment and facilities and the certificate of equipment qualification;

(six) the system text of quality management, safety production management, vehicle maintenance file management, equipment management, parts management and environmental protection measures;

(seven) other materials required by the state. Article 11 When accepting an application, the automobile maintenance management institution shall inform the applicant of all the contents that need to be corrected at one time if the application materials submitted by the applicant are incomplete.

After accepting the application, the automobile maintenance management institution shall issue a notice of acceptance to the applicant, and review, verify and make a decision on the application materials within fifteen working days from the date of acceptance. In line with the conditions, it shall issue an automobile maintenance business license to the applicant; Do not meet the requirements, it shall issue a decision not to approve.

The automobile maintenance business license shall specify the enterprise category and the specific matters of the licensed business. Twelfth automobile maintenance business license to implement the validity system. The validity period of the maintenance business license for Class I and Class II automobiles and dangerous goods transport vehicles is six years; Class III automobile maintenance business license is valid for three years.

If the automobile maintenance business license of an automobile maintenance operator needs to be extended after the expiration of the validity period, it shall apply to the automobile maintenance management institution that made the license decision 30 days before the expiration of the validity period. The automobile maintenance management institution shall complete the examination and make a decision within fifteen working days from the date of receiving the application for renewal. In line with the conditions, directly handle the replacement procedures; Do not meet the conditions, it shall issue a decision not to continue; If no decision is made within the time limit, it shall be deemed as an extension. If an automobile maintenance operator fails to apply for license extension within the time limit, the automobile maintenance management institution shall cancel its automobile maintenance business license.
