Article 1 These Measures are formulated in accordance with the relevant provisions of the Measures for the Qualification Identification of Welfare Enterprises issued by the Ministry of Civil Affairs, with a view to standardizing the qualification identification of welfare enterprises, uniformly arranging the employment and employment of disabled persons, and safeguarding the legitimate rights and interests of disabled workers.

Article 2 The term "welfare enterprises" as mentioned in these Measures refers to enterprises registered in the administrative department for industry and commerce according to law, in which the number of disabled employees accounts for more than 25% (inclusive) of the total number of employees and the number of employees is not less than 10 (inclusive).

Article 3 Disabled employees placed by welfare enterprises shall be persons with visual, hearing, speech, physical, intellectual and mental disabilities who hold the People's Republic of China (PRC) Disabled Persons' Card, or persons with disabilities who hold the People's Republic of China (PRC) Disabled Persons' Card in disabled soldiers (1 8).

Article 4 The civil affairs department of the people's government at the provincial level is the qualification accreditation organ of welfare enterprises (hereinafter referred to as accreditation organ).

Article 5 An enterprise applying for the qualification recognition of a welfare enterprise shall meet the following conditions:

(1) The enterprise has signed a labor contract or service agreement of more than 1 year (inclusive) with each disabled employee who has been placed in employment according to law, and each disabled employee who has been placed in employment actually works full-time in this unit without repeated employment;

(2) The average number of disabled employees actually placed in employment one month before the enterprise applies for qualification recognition accounts for more than 25% (inclusive) of the total number of employees in the unit, and the number of disabled employees is not less than 10 (inclusive);

(three) one month before the enterprise applies for qualification recognition, it actually paid the salary not lower than the minimum wage standard of the county (city, district) through banks and other financial institutions;

(4) The enterprise shall pay social insurance such as basic old-age insurance, basic medical insurance, unemployment insurance and industrial injury insurance paid by the local county (city, district) people's government in full monthly for each disabled employee one month before applying for qualification recognition;

(five) the enterprise has jobs and posts suitable for each disabled employee;

(6) Roads and buildings in the enterprise meet the national barrier-free design specifications.

Article 6 An enterprise applying for the qualification recognition of welfare enterprises shall apply to the civil affairs department at the county level and fill in the Application Form for the Qualification Recognition of Welfare Enterprises in Shanxi Province (in quintuplicate). The civil affairs department at the county level shall complete the preliminary examination within five working days from the date of receiving the application form and related materials, and report the preliminary examination opinions and all application materials to the municipal civil affairs department of the district; The municipal civil affairs department with districts shall complete the examination within 5 working days from the date of receiving the application materials, and submit the examination opinions and all materials to the Provincial Civil Affairs Department; The Provincial Civil Affairs Department shall complete the examination and confirmation within 10 working days from the date of receiving the application materials, and put forward written opinions.

Enterprises directly under the municipal jurisdiction shall apply to the municipal civil affairs department of the district for the qualification identification of welfare enterprises, and after preliminary examination and review, they shall be reported to the provincial civil affairs department for identification; Provincial enterprises to apply for welfare enterprise qualification, should apply to the provincial civil affairs department, the provincial civil affairs department for preliminary examination, review and identification.

Article 7 When an enterprise applies for the accreditation of welfare enterprises, it shall submit the following materials to the accreditation authority:

(a) Shanxi province welfare enterprise qualification certificate;

(2) A copy of the business license and tax registration certificate of the enterprise;

(3) A feasibility report suitable for the employment of the disabled;

(four) a copy of the labor contract signed between the enterprise and each disabled employee;

(five) the roster of employees of welfare enterprises and the roster of disabled employees of welfare enterprises;

(six) the province's "People's Republic of China (PRC) * * and China Disabled Card" or "People's Republic of China (PRC) * * and China disabled soldiers Card (1 to 8)" disabled workers;

(seven) proof that the enterprise pays wages to each disabled employee through banks and other financial institutions;

(eight) the social insurance fee payment record issued by the social security department for each disabled employee;

(nine) the list of disabled employees in welfare enterprises, and the registration form for the payment of wages and insurance for disabled employees in welfare enterprises;

(ten) the internal roads and buildings of the enterprise meet the barrier-free design specifications.

Eighth in the audit process, the civil affairs department at the county level shall assign two or more staff to conduct on-site verification. When the cognizance organ deems it necessary, it may also directly or assign two or more staff members of the municipal civil affairs department with districts to conduct on-the-spot verification, and at the same time issue verification materials signed by two people.

Article 9 When conducting on-site verification, the audit and certification authority shall focus on the following contents:

(a) to verify the documents of the disabled, and if necessary, to request the issuing authority to examine the authenticity of the documents of the disabled, in which the disability certificate is confirmed by the county-level disabled persons' Federation and the disabled soldiers certificate is confirmed by the county-level civil affairs department;

(two) according to the enterprise application register to verify the total number of employees, the number of disabled employees and the proportion of disabled people;

(three) the types and positions of disabled workers;

(4) Barrier-free facilities for roads and buildings within the enterprise.

Article 10 Upon examination, the certifying authority shall certify those who meet the qualification conditions of welfare enterprises, and issue the Social Welfare Enterprise Certificate and the Shanxi Welfare Enterprise Qualification Certificate. Those who do not meet the qualification conditions of welfare enterprises shall not be recognized, and the reasons shall be explained in writing to the applicant.

"Social welfare enterprise certificate" and "Shanxi welfare enterprise qualification certificate" are issued by the civil affairs department that accepts the application and signed by the legal representative of the applicant enterprise or its authorized person.

The municipal civil affairs departments with districts shall affix the seal of "Employed" on the documents of disabled persons provided by welfare enterprises recognized by the recognition authorities, or entrust the civil affairs departments at the county level to affix the seal of "Employed" on the documents of disabled persons recognized by enterprises.

Eleventh welfare enterprises identified by the identification authority, "Shanxi Province Welfare Enterprise Qualification Identification Form" (in quintuplicate) and other related materials, after the identification is completed, the identification authority shall return the application to the civil affairs department step by step. Civil affairs departments at all levels should organize and file relevant materials.

Article 12 The civil affairs department that accepts the application shall issue a written examination and confirmation opinion (letter) to the competent tax authorities at the same level according to the examination and approval opinions of the Shanxi Province Welfare Enterprise Qualification Confirmation Form, and attach a copy of the Shanxi Province Welfare Enterprise Qualification Confirmation Form and the social welfare enterprise certificate examined and confirmed by the confirmation authority.

Thirteenth "social welfare enterprise certificate" is a certificate to identify the nature of social welfare enterprises and enjoy the national preferential policies for social welfare enterprises. "Social welfare enterprise certificate" is valid only after it is stamped by the Provincial Civil Affairs Department.

"Social welfare enterprise certificate" is valid for 3 years.

Article 14 If the number of disabled employees or on-the-job employees actually placed in a unit recognized as a welfare enterprise by an organ changes, it shall apply to the county-level civil affairs department for verification within 15 days from the date of the change.

If it still meets the conditions of tax refund and tax reduction, it is only necessary to submit the Application Form for Personnel Resettlement Change of Welfare Enterprises in Shanxi Province and the materials in Items (4), (5), (6), (7) and (8) of Article 7 of these Measures when re-applying for recognition.

The civil affairs department at the county level shall complete the audit within 7 working days after receiving the application for verification, and report the audit opinions and related materials to the municipal civil affairs department of the district. After the examination by the civil affairs department of the city divided into districts, if the qualification conditions of welfare enterprises are still met, it shall issue a written confirmation opinion to the applicant within 7 working days after receiving the materials ("Confirmation of Personnel Placement of Welfare Enterprises in Shanxi Province") and report it to the confirmation authority for the record. For those who do not meet the qualification conditions of welfare enterprises, the civil affairs department at the county level shall put forward specific treatment opinions within 7 days and report them to the identification organ step by step. The cognizance organ shall cancel its welfare enterprise qualification, withdraw its social welfare enterprise certificate, and notify the competent tax authorities in writing.

Article 15 If an applicant refuses to accept the decision of an authorized institution, he may bring an administrative reconsideration in accordance with the Administrative Reconsideration Law of People's Republic of China (PRC) or bring an administrative lawsuit in accordance with the Administrative Procedure Law of the People's Republic of China.

Article 16 The municipal civil affairs departments with districts shall, jointly with the competent tax authorities, conduct annual inspections on welfare enterprises in the first quarter of each year, or entrust the county-level civil affairs departments to conduct annual inspections jointly with the competent tax authorities.

Article 17 When the competent tax authorities and the Disabled Persons' Federation submit the "People's Republic of China (PRC) * * and disabled soldiers Certificate" (1 level to 8) held by the disabled persons placed in the unit to the recognition organ for verification, the recognition organ shall confirm and reply within 5 working days. If it belongs to the household registration in other provinces, the recognition organ shall confirm and reply within 10 working days.

Eighteenth civil affairs departments at all levels shall not charge any fees to welfare enterprises for qualification identification, verification and annual inspection.

Nineteenth "social welfare enterprise certificate" style by the Ministry of Civil Affairs unified system, "Shanxi Province welfare enterprise qualification form", "Shanxi Province welfare enterprise personnel placement change confirmation" style by the provincial civil affairs department.

Article 20 These Measures shall come into force as of the date of promulgation. "Shaanxi Provincial Department of Civil Affairs on the relevant issues concerning the examination and approval of new welfare enterprises" (Letter No.203 [2004] of the Provincial Department of Civil Affairs) shall be abolished at the same time. If the relevant documents previously released are inconsistent with the provisions of these Measures, the provisions of these Measures shall prevail.
