Regulations of Wulanchabu Municipality on Property Management

Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, and create a good living and working environment, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Property Management of Inner Mongolia Autonomous Region, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the use, maintenance and service of properties within the administrative area of this Municipality and their related supervision and management activities. Article 3 Property management adheres to the principle of territorial management, and implements a management mode of professional property management, supplemented by owner's self-management and Gacha villagers' committee and community residents' committee, which is limited to single buildings or small-scale old residential quarters. Article 4 The property administrative department of the Municipal People's Government shall be responsible for the supervision and management of property management activities in the whole city.

The property administrative department of the people's government at the county level shall be responsible for the supervision and management of property management activities within its jurisdiction, and accept the professional guidance and supervision of the property administrative department of the Municipal People's government.

Development and reform, planning, finance, ecological environment, urban management, public security, civil affairs, health, market supervision and management, fire protection, natural resources, civil air defense and other departments, as well as water supply, power supply, heating, gas supply, communications and other professional business units, in accordance with their respective responsibilities to do a good job in related property management activities.

Sumu Township People's Government and sub-district offices are responsible for organizing, guiding and coordinating the work of the owners' meeting in the realty service area within their respective jurisdictions, urging the owners' meeting to perform their duties according to law, coordinating the relationship between community construction and realty service, and handling disputes over realty service.

Gacha villagers' committees and community residents' committees assist Sumu Township People's governments and sub-district offices in property management. Article 5 People's governments at all levels should strengthen property management, introduce corresponding reward and subsidy policies, support property service enterprises to evaluate first and create excellence, develop and expand, guide the establishment of a professional, socialized and market-oriented property management mechanism, explore the implementation of an open and block-style property service model, promote industry self-discipline, strengthen supervision after the event, and promote the healthy development of the industry by establishing a credit platform and a "red blacklist" system. Article 6 The rights and obligations of owners and property service enterprises, the responsibilities of owners' congress and owners' committee, the management and use of special property maintenance funds, and the collection standards of property service fees shall be implemented in accordance with the regulations of the State Council and Inner Mongolia Autonomous Region on property management. Seventh in a property management area, the construction area of the property that has been delivered for use has reached more than 50%, or the construction area of the property that has been delivered for use has reached 30% and has been delivered for use for more than two years, the owners' meeting shall be prepared.

In accordance with the provisions of the preceding paragraph, the construction unit shall inform the property administrative department of the people's government at the county level in writing within thirty days; Representatives of the owners may jointly submit an application for the establishment of the owners' meeting to the Township People's Government of Sumu or the sub-district office. Article 8 The property administrative department of the people's government at the county level, the subdistrict office and the Sumu Township People's Government shall, within 30 days from the date of receiving the notice or application, organize the establishment of the preparatory group for the meeting of the owners' congress. Article 9 The preparatory group for the meeting of the owners' congress shall make the following preparations:

(a) to determine the time, place, form and content of the owners' meeting;

(two) to draft the rules of procedure and management regulations of the owners' congress;

(three) to confirm and publicize the list of owners, the number of owners, the area of exclusive parts and the number of voting rights;

(four) to draft the voting rules of the owners' meeting according to law;

(five) to formulate the methods for the selection of candidates for members of the owners' committee and determine the list of candidates;

(six) other preparations for the convening of the owners' meeting.

The contents of items 1 to 4 of the preceding paragraph shall be published in the property management area fifteen days before the owners' meeting is held. Tenth owners' meeting shall be held in accordance with the rules of procedure of the owners' meeting, not less than once a year. Eleventh owners' meeting can be in the form of collective discussion, but also in the form of written comments.

In the form of collective discussion, all owners shall be notified fifteen days before the meeting is held, and Gacha villagers' committee and community residents' committee where the property is located shall be notified at the same time.

Send the opinions to every owner in the form of written opinions; Can not be delivered, announced in the property management area. If a vote is required, the voting opinions shall be signed by the owner himself or the entrusted agent. If the owner fails to vote within the prescribed time limit, it shall be deemed as abstention. Twelfth owners' meeting has been established, but due to objective reasons, the meeting can be held according to the building and unit, and the method of producing owners' representatives is stipulated by the rules of procedure of the owners' meeting.

The decision of the owners' meeting is binding on all owners. Thirteenth owners' committee to discuss and decide on property management matters, it shall convene a committee meeting, and seven days before the meeting, the matters studied at the meeting will be published in written form in the property management area.

Matters decided by the owners' committee shall be agreed by more than half of all members.
