Regulations of Guizhou Province on Property Management (revised in 2020)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners, property users, property service enterprises and other managers, improve the living environment and promote social harmony, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management and relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Regulations shall apply to property management and related supervision and management activities within the administrative area of this province.

The term "property management" as mentioned in these Regulations refers to the activities of the owners, property service enterprises or other managers to maintain, conserve and manage the houses and their supporting facilities and related sites, and to maintain the environmental sanitation and related order in the property management area. Article 3 Property management activities shall follow the principles of consistency of rights and obligations, and the combination of owner autonomy and government guidance and supervision. Article 4 Owners may entrust property service enterprises or other managers to implement property management, or they may manage themselves.

Encourage owners to entrust professional, socialized and market-oriented property service enterprises to implement property management. Fifth provincial people's government housing and urban and rural construction administrative departments responsible for the supervision and management of property management activities in the province.

The housing administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas.

Planning, natural resources, market supervision, price, urban management, ecological environment, public security, civil affairs and other relevant departments shall be responsible for the supervision and management of property management according to their respective responsibilities. Article 6 Sub-district offices and Township People's governments shall, jointly with the housing administrative departments of the people's governments at the county level, guide the owners within their respective jurisdictions to establish owners' congresses and elect owners' committees according to law, urge the owners' congresses and owners' committees to perform their duties according to law, mediate property management disputes according to law, and coordinate the relationship between property management and community construction.

Neighborhood (village) committees assist neighborhood offices and township people's governments in carrying out property management-related work. Article 7 Property management associations shall strengthen industry self-discipline, standardize industry behaviors, promote property service enterprises and employees to operate according to law and provide honest services, and promote the healthy development of the property management industry. Chapter II Property Management Areas and Related Configuration Article 8 The division of property management areas shall be conducive to the implementation of property management, based on the scope of the red line map determined by the construction land planning permit, and comprehensively consider factors such as equipment and facilities, building scale, number of owners, community layout and natural boundaries.

The supporting equipment and facilities of the property are used by * * * and should be divided into a property management area; Supporting equipment and facilities can be used independently and can be divided into different property management areas. Article 9 When a construction unit applies to the planning administrative department for a construction project planning permit, it shall also apply to the county-level housing administrative department where the construction project is located for the division of property management areas. The planning administrative department shall, when examining and approving the planning and design scheme of construction projects, consider the needs of implementing property management, and solicit the opinions of the housing administrative department on the division of property management areas, and the housing administrative department shall give a reply within 5 days.

The housing administrative department at the county level shall, according to the planning and design scheme of the construction project examined and approved by the planning administrative department, timely issue a decision on the division of property management areas to the construction unit, and inform the neighborhood offices and Township People's governments where the construction project is located in writing.

The construction unit shall publicize the contents of the decision on the division of property management areas at the house sales site. Article 10 Where the property that has been completed and delivered for use has not been managed, and it is necessary to divide the area to implement property management, the county-level housing administrative department where the property is located shall, jointly with the neighborhood offices and the Township People's governments, solicit the opinions of the owners and neighborhood committees, divide the property management areas, and make an announcement in the corresponding areas.

Property management has been implemented and the owner has no objection to the management scope. The county-level housing administrative department where the property is located can directly confirm the existing management scope as the property management area. Eleventh county-level housing administrative departments shall establish regional property management files.

The regional archives of property management shall specify the geographical location, boundaries, total construction area, the number of exclusive parts, some main information of the owners and construction units and other matters that need to be specified. Twelfth property management area shall not be changed without authorization.

If it is really necessary to change the property management area according to the needs of property management, the construction unit or the owner whose exclusive part accounts for more than half of the total construction area and more than half of the total number before obtaining the sales license may apply to the county-level housing administrative department where the property is located.

The housing administrative department shall make a decision within 30 days from the date of accepting the application. Decided to change, for new property projects, the original decision on the division of property management areas shall be revoked, and the decision on the division of property management areas shall be re-made to the construction unit; Property that has been completed and delivered for use shall be changed in the corresponding area. If it decides not to change, it shall explain the reasons in writing to the applicant. Thirteenth construction units should be based on the property management area as a unit in accordance with the following requirements for free allocation of property services:

(1) If the total construction area is less than 6,543,800 square meters, the property service room shall be shared according to the proportion of 3‰ of the total construction area, with a minimum of 90 square meters; If the total construction area exceeds 6.5438+10,000 square meters, the allocation of property service rooms will start from 300 square meters, and the part with the construction area exceeding 6.5438+10,000 square meters will be increased by 2‰, and the part exceeding 500,000 square meters will be increased by 654.38+ 0 ‰.

(2) Houses with a calculated construction area higher than the ground shall have basic conditions such as water supply and power supply facilities and can be directly put into use.

The planning administrative department shall, when examining and approving the planning and design scheme of the construction project, specify the location and area of the property service house in accordance with the provisions of the preceding paragraph. The construction unit shall publicize the location and area of the property service room at the house sales site.

The office space of the owners' committee is transferred from the property service space. If the total construction area in the property management area is less than 654.38+10,000 square meters, it shall not be less than 15 square meters; If the total construction area is over 6,543,800 square meters, it shall not be less than 60 square meters.
