In order to strengthen the demand management of government procurement projects, standardize the operation process of centralized government procurement projects, and improve the performance of government procurement projects, these rules are formulated in accordance with the Measures for the Management of Government Procurement Demand (Caiku [2022] No.21,hereinafter referred to as the Measures) and in combination with the actual work of the Center.

I. Demand formulation

(a) The procurement requirements formulated by the purchaser must be clear, standardized and accurate. If the technical and commercial requirements are not objective, the indicators are not quantified, and the continuous interval is not divided, the purchaser shall be notified to revise and improve.

(2) For projects that cannot specify the requirements in detail and require suppliers to provide design scheme, solution or organization scheme, such as development planning, risk assessment, design scheme and feasibility study report. , need to explain the basic needs of the target, such as functions, application scenarios, goals, etc. And make the objective quantitative indicators as clear as possible.

(3) If the procurement requirements are unified in specifications, standards and national specifications, national standards, industry standards, local standards and other standards and specifications can be adopted as technical requirements, or higher technical requirements can be put forward according to the project objectives.

Second, the demand survey

(1) When the purchaser submits the demand, it shall also submit the project demand survey document (if the relevant target survey has been conducted within one year before the demand preparation, the original survey document is only required).

(two) the form of demand survey can be consultation, demonstration, questionnaire survey, feasibility study report, etc.

(3) The demand investigation report mainly focuses on industry development, market supply, historical transaction information of similar procurement projects, and possible subsequent procurement such as operation and maintenance, upgrade, spare parts and consumables.

(4) Need to provide demand survey items:

Goods and services procurement projects with RMB 65,438+0.65,438+0 million, and engineering procurement projects with RMB 30 million;

2 procurement projects involving public interests and high social concern, including public services provided by the government to the public;

3. Projects with complex technology and strong professionalism, including information construction projects requiring customized development and imported product procurement projects.

Third, the procurement implementation

(1) The supplier qualification conditions put forward by the purchaser are directly related to the function and quality of the procurement target and the supplier's performance ability, and are the necessary conditions for fulfilling the contract. Except for specific professional qualifications, technical qualifications, equipment and facilities, performance, professionals and their management ability, it is generally not regarded as a qualification condition.

(two) performance as a qualification condition, should comply with the provisions of the "Regulations on the implementation of the government procurement law" twentieth, and the number of no more than two.

(3) No performance requirements shall be put forward for the procurement of innovative products supported by government procurement policies.

(four) general equipment, property management and other procurement projects with objective and clear procurement requirements and unified specifications and standards are generally purchased by the lowest bid evaluation method.

(five) procurement projects with objective and clear procurement requirements, complex technology or strong professionalism, such as large-scale equipment and consulting services, can be purchased by comprehensive scoring method.

(6) For projects purchased by comprehensive scoring method, objective but unquantifiable indicators in demand shall not be used as scoring items, and different scores shall be set when quantifying scoring items.

(7) For projects that require suppliers to provide design schemes, solutions or organizational schemes, the importance and priority of different technical routes, organizational forms and related indicators can be clarified, and objective and quantitative evaluation factors, scores and weights can be set.

(8) The price factor score for goods procurement through public bidding is not less than 30 points, and the price factor score for service items is not less than 10 points; The price score of competitive negotiation items is 30-60 points for goods and 0-0-30 points for services.

(9) Unless it is impossible to accurately describe the procurement requirements in written form or it is necessary to make subjective judgment on the samples to confirm whether they meet the procurement requirements, the bidder shall not be required to provide samples. It is really necessary to provide a description of the production standards and requirements of the samples, as well as the evaluation methods and evaluation standards. When making samples of non-standard products, it is necessary to set aside time for making samples.

(10) Try to provide photos, samples, pictures or videos instead of samples. Samples are not allowed to provide complete machines. The sample score is 5~ 10, and the number should not exceed 5 in principle.

Fourth, supervision and management.

(1) The document preparation manager shall conduct non-discriminatory review, competitive review and procurement policy review on the procurement requirements submitted by the purchaser. If it does not meet the requirements, it shall remind the purchaser to revise and improve it in time.

(two) if the purchaser fails to determine the bid evaluation method as required, the document preparation manager shall notify the purchaser to make adjustments.

(3) If the procurement method is not determined in accordance with the present Measures, it is suggested that the original determining unit modify it.

(four) the purchaser who refuses to accept the revised proposal shall suspend the implementation of its procurement projects and report to the government procurement supervision department at the same level, and the financial department shall deal with it according to the provisions of these measures.

(five) demand management involves contract performance, risk prevention and control and other related content, in accordance with these measures and the relevant laws and regulations of government procurement.

(six) these rules shall come into force as of May 7, 2022.
