Legal analysis: In principle, the property fee after the house is rented shall be borne by the owner. If there is an agreement between the owner and the lessee, the property fee shall be paid according to the agreement of both parties. The tenant can refuse the landlord to pay the property fee. If there is no evidence, the tenant is not obliged to pay the property fee and can recover the deposit through legal means.

Legal basis: Article 41 of the Regulations on Property Management in People's Republic of China (PRC), the owner shall pay the property service fee according to the agreement in the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.
