Can the owner sue for more than three years in arrears with property fees?

Owners who default on any amount of property fees may be prosecuted. Whether the owner will be prosecuted for defaulting on property fees has nothing to do with the amount of property fees owed. In such civil cases, the general statute of limitations is two years. During these two years, the property can file a lawsuit at any time, asking the owner to pay the property fee and compensate for the losses. Legal basis: Article 41 of the Regulations on Property Management.

The owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.

Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.
