Regulations of Haikou Municipality on the Administration of Housing Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Construction Law of People's Republic of China (PRC) and other relevant laws and regulations and in the light of the actual situation of this Municipality, with a view to strengthening the management of housing safety, ensuring the safety of housing use and safeguarding the safety and public interests. Article 2 These Regulations shall apply to the safety management of legally built houses in the main urban area of this Municipality.

Fire safety of houses, safety management of elevators, water supply, power supply, gas supply and other professional facilities and equipment, disposal of illegal buildings, and safety management of houses in military protected areas, places for religious activities, cultural relics protection units, scenic spots and nature reserves shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The term "house safety management" as mentioned in these Regulations includes house use safety management, house safety appraisal management, dangerous house management, termite control management and other safety management activities. Article 4 The municipal housing administrative department is the competent department of housing safety in this Municipality, and is responsible for organizing the implementation of these Regulations.

The district housing administrative department is responsible for the supervision and management of housing safety within its jurisdiction in accordance with the division of responsibilities, and accepts the supervision and guidance of the municipal housing administrative department in business.

City and district housing administrative departments may entrust their subordinate housing safety management institutions and termite control management institutions to be responsible for the specific work of housing safety management.

Neighborhood offices and town people's governments shall assist the municipal and district housing administrative departments to carry out the relevant work of housing safety management within their respective jurisdictions.

Land, planning, production safety, finance, public security, urban management and other administrative departments shall, in accordance with their respective responsibilities, coordinate in the management of housing safety. Article 5 The municipal and district people's governments shall incorporate special funds for housing safety management such as housing safety appraisal management and termite control management into the fiscal budget at the same level to ensure the needs of housing safety supervision and management.

The municipal and district people's governments shall provide housing security assistance to families with special difficulties, and give appropriate subsidies to their housing security appraisal, dangerous housing management and termite control. Sixth city housing administrative departments should strengthen the guidance and supervision of housing safety appraisal, termite control industry organizations, and support industry organizations to carry out their work according to law. Industry organizations shall assist the municipal and district housing administrative departments to do a good job in housing safety management, strengthen industry self-discipline management, and accept social supervision. Seventh any unit or individual has the right to report and complain about acts that endanger the safety of houses. City, district housing administrative departments, relevant administrative departments, sub-district offices and Town People's governments shall promptly accept and investigate according to their respective responsibilities. Chapter II Safety Management of House Use Article 8 The construction unit shall, in accordance with the provisions of laws and regulations and the stipulations of the contract, undertake the warranty responsibility and the responsibility for handling the house quality defects during the warranty period. Among them, the warranty and governance responsibility of the foundation and main structure of the building shall be borne by the construction unit within the service life of the building specified in the statutory design documents, except for the damage caused by improper use, third party infringement or force majeure.

Before the new house is delivered for use, the construction unit shall submit the housing quality guarantee, housing instruction and other relevant documents to the transferee, and clearly inform the transferee of the basic situation of the house, design service life, performance index, decoration limit, use and maintenance requirements, warranty scope and duration.

Units such as survey, design, construction and supervision of housing construction projects shall bear the responsibility for housing safety in accordance with the provisions of the contract signed with the construction unit and relevant laws and regulations. Article 9 The owner of a house is responsible for the safety of the house. Housing is owned by the state or the collective, and its management unit is the person responsible for housing safety.

If the owner of the house is missing and the ownership is unclear, the custodian and actual user of the house shall be the person responsible for the safety of the house.

The confirmation of the owner of the house shall be subject to the records in the real estate register. A natural person, legal person or other organization that has not registered the ownership of the house but legally occupies the house shall bear the responsibility for housing safety according to law in any of the following circumstances:

Article 10 If the person responsible for housing safety cannot be determined in accordance with Article 9 of these regulations, the municipal and district housing administrative departments shall implement temporary escrow according to the division of responsibilities and assume the responsibility for housing safety.
