Interim Measures of Zhuhai Municipality on the Responsibility and Supervision of Dog Owners

The Interim Measures for the Responsibility and Supervision of Dog Raising in Zhuhai City, which was deliberated and adopted at the 7th executive meeting of the municipal government on June 1 06, 2009, is hereby promulgated and shall come into force on August 1 09.

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with relevant laws and regulations, combined with the actual situation of this Municipality, for the purpose of regulating dog-raising behavior, safeguarding citizens' personal health and safety, maintaining social public order and city appearance and environment, and building a new ecological and civilized special zone.

Article 2 These Measures shall apply to dog-raising behavior and related activities within the administrative area of this Municipality.

Article 3 The public security department is the competent department of dog raising management in this Municipality, and is responsible for the supervision and management of dog raising. The public security department may entrust an organization that meets the conditions prescribed by laws and regulations to implement specific affairs of dog management.

Urban management administrative law enforcement, animal husbandry and veterinary, health, municipal gardens, prices, civil affairs, industry and commerce, environmental protection, construction and other relevant departments shall do a good job in dog management within their respective responsibilities.

The town people's government and the sub-district offices shall cooperate with the dog management.

The news media should strengthen social morality education and publicity of scientific knowledge of city appearance and environmental sanitation, and guide citizens to form good dog-raising habits.

Dog associations and other relevant non-governmental organizations should raise their awareness of self-discipline, formulate self-discipline conventions and consciously safeguard public order.

Article 5 Dog-raising activities in this Municipality shall follow the principle of "self-discipline of dog owners, management by supervisors, investigation and punishment by law enforcers, and supervision by all sectors of society".

Article 6 Dog owners have the right to raise dogs, but they should also respect social morality, public order and good customs, and respect the living habits of others.

Chapter II Code of Conduct for Dog Owners

Article 7 Dog owners, as the first responsible subject for raising dogs, should consciously improve their moral quality, adhere to the principle of health and civilization, and consciously abide by the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the Law of People's Republic of China (PRC) on Animal Epidemic Prevention, the Regulations of Zhuhai Special Economic Zone on the Administration of City Appearance and Environmental Sanitation, and the Measures for the Administration of Zhuhai Parks.

Article 8 The behavior of dog owners shall conform to the provisions on raising dogs in public places and specific non-public places, support normal production and business activities, and maintain health order.

Article 9 Dog owners shall regularly bring their dogs to animal epidemic prevention and control institutions, animal clinics and other units to carry out relevant immunization and health checks on dogs, prevent epidemics and ensure the health of dog owners and other citizens.

Article 10 The animal diagnosis and treatment institutions entrusted by the supervising agencies for animal health shall track and count the immunization of dogs, establish immunization files, and regularly report the immunization of dogs to the animal husbandry and veterinary departments for the record.

Twelfth dog owners should ensure that their dog-raising behavior does not affect the city appearance and environmental sanitation, and dog owners are not allowed to take their dogs to public green spaces and lawns to urinate. The feces produced by dogs in outdoor activities shall be cleaned up immediately and shall not damage the environmental quality.

Article 13 Dog owners shall take good care of dogs and shall not abandon or mistreat them.

Article 14 Dog owners should consciously abide by the laws and regulations on property management and the regulations on the management of residential quarters, take corresponding measures to prevent and eliminate dog-raising behaviors that disturb the people and affect the normal work, study and life of neighbors and others, and build a harmonious neighborhood relationship.

Fifteenth dog owners in residential buildings should take corresponding measures to reduce the noise generated by dog-raising activities and avoid interfering with the lives of neighbors and upper and lower residents.

Article 16 Dog owners shall actively cooperate with the town people's government, neighborhood offices, neighborhood (village) committees and realty service enterprises to track and investigate the basic situation of dogs, and take the initiative to report the basic situation of dog raising to realty service enterprises or neighborhood (village) committees for the record.

Article 17 This Municipality encourages dog owners not to raise aggressive and highly dangerous dogs such as large dogs and strong dogs. If it is kept, it should be kept in captivity or chained, and dogs should not be taken out for a walk.

The range and types of large dogs and strong dogs shall be announced separately by the animal husbandry and veterinary department with reference to the practices of neighboring cities.

Eighteenth dog owners should take measures such as tying a big chain and wearing a mask to prevent dogs from hurting people. Dogs should be led out by people with full capacity for civil conduct, or put into dog bags or cages, so as to avoid bringing dogs into crowded areas and actively avoid special groups such as the elderly, children, pregnant women and the disabled.

Advocate dog owners not to take the elevator when carrying dogs, or take the initiative to avoid the peak hours of elevator use, so as not to affect the normal use of elevators by others.

Nineteenth dog owners only cause harm or loss to others, dog owners should bear corresponding civil liability in accordance with the general principles of civil law and other laws and regulations.

Advocate dog owners to take out dog injury insurance.

Article 20 If a dog hurts others, the dog owner or dog manager shall immediately send the injured person to the immunization clinic recognized by the municipal and district disease prevention and control institutions or the municipal public health administrative department for diagnosis and treatment, and pay medical expenses in advance.

The municipal public health administrative department shall regularly announce the immunization of rabies vaccine to the public.

Article 21 Dog owners who fail to fulfill their duty of care, thus endangering the traffic safety of dogs and causing traffic accidents on urban roads and expressways, shall bear corresponding civil liabilities.

Chapter III Responsibilities of Supervisors

Article 22 This Municipality implements the principle that all social subjects should take care of each other and perform their duties, clarify the management responsibilities of supervisors, and promote healthy and civilized dog breeding.

Article 23 The term "supervisor" as mentioned in this chapter refers to the owner or manager of a place.

The places mentioned in this article include public places and specific non-public places.

Article 24 The owners and managers of public places in this Municipality shall take persuasion and dissuasion measures to prohibit dog owners from bringing dogs into public places. Where conditions permit, dogs can be set up to stay temporarily.

Twenty-fifth the following public places prohibit dog owners from carrying dogs, but blind people and severely disabled people carry guide dogs and disabled dogs to enter:

(a) Large public transport, such as buses and passenger ships;

(2) State organs, schools (including kindergartens and nurseries), places for children's activities and hospitals;

(three) theaters, museums, dance halls, stadiums, playgrounds and other public cultural places;

(four) public swimming pools, parks, public green spaces, hotels, restaurants, shops, markets, waiting rooms (boats);

(five) other public places as determined by the Municipal People's government.

When a dog owner takes a taxi with his dog, he shall obtain the consent of the taxi driver and ensure that the taxi environment is clean and tidy.

The administrative department of municipal gardens can set up public areas for dog activities in the parks under its management, and set up corresponding environmental sanitation facilities and billboards, indicating the regional scope, opening hours, warning matters and other contents.

Article 26 The owners or managers of public places should intensify publicity, publish relevant tips prohibiting dog owners from bringing dogs in an open and explicit way, and set up relevant signs and signs prohibiting dogs from entering.

Article 27 The owners or managers of non-public places other than those specified in Article 25 of these Measures have the right to prohibit dog owners from bringing dogs into the places they own or manage according to the actual situation.

Twenty-eighth municipal and district people's governments may, according to the actual situation, temporarily designate areas where dogs are not allowed to enter during major holidays or major activities.

Twenty-ninth dog owners forcibly enter public places and specific non-public places prohibited by these measures, and the owners or managers of public places and specific non-public places shall stop them. If it is ineffective, it shall be reported to the urban management administrative law enforcement department, which shall correct it.

In violation of the provisions of the first paragraph of this article, causing accidental death or injury to dogs, the dog owner shall bear the responsibility.

Thirtieth residential property service enterprises shall, according to the decision of the owners' meeting or the owners' committee, formulate a special statute of dog-raising behavior in an open, fair and equitable manner, and strengthen publicity and publish it in a prominent position in residential areas.

The administrative department in charge of construction shall actively guide and standardize the behavior mentioned in the preceding paragraph of the realty service enterprise, and provide a model text of the relevant statute.

Thirty-first residential property service enterprises should support and assist the dog owners in this residential area to organize and establish dog-raising self-discipline associations, and provide necessary conditions for their mutual supervision and self-discipline in raising dogs.

Thirty-second residential property service enterprises should determine the specific area and time for owners to raise dogs, and urge dog owners to do a good job in cleaning up the feces and garbage generated by dog activities.

Article 33 A residential property service enterprise shall establish and improve a dog dispute and contradiction resolution mechanism, timely resolve disputes and contradictions among owners of residential areas, and prevent disputes and contradictions from intensifying.

Article 34 The neighborhood (village) committee shall, in accordance with the principles of self-management, self-education and self-service, formulate a reasonable autonomy convention, do a good job in dog hygiene management and dog dispute mediation within its jurisdiction, and promote mutual respect and understanding among residents within its jurisdiction.

Article 35 People's mediation committees and mediation teams at all levels established in this Municipality shall track and analyze the characteristics of dog disputes and contradictions, establish a dog dispute mediation mechanism in a targeted manner, and timely resolve dog disputes through persuasion, education and persuasion.

Thirty-sixth dog sales operators should keep the business premises and its surrounding environment clean and tidy, take preventive measures to avoid dogs hurting people, and perform the same obligations and responsibilities as dog owners.

Chapter IV Responsibilities of Law Enforcement Officers

Article 37 The District People's Government (including the Economic Functional Zone Administrative Committee, the same below) shall put dog management into the work schedule and arrange certain urban maintenance funds for the daily management of dogs and the construction of simple pet toilets and other related supporting facilities within its jurisdiction.

Article 38 The District People's Government shall increase investment, strengthen the training on the prevention of infectious diseases, dog health, dog behavior characteristics and dog training methods of dog owners in this area, and popularize scientific, civilized, safe and hygienic dog-raising knowledge.

Article 39 The town people's government and subdistrict offices shall incorporate dog management into their work plans, and coordinate the residents' (village) committees in the implementation of dog number census and registration.

Fortieth this Municipality shall establish a dog joint law enforcement system in public security, urban management administrative law enforcement, animal husbandry and veterinary departments, establish a dog joint law enforcement coordination mechanism and an information communication mechanism, and regularly communicate and coordinate dog law enforcement issues.

Article 41 Where a dog barks and interferes with the normal life of others, or drives away a dog to hurt others, the public security department shall manage and punish it in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment.

In the process of inspection, the public security department found that the dog breeder did not listen to the dissuasion of the place supervisors stipulated in Article 25 and Article 27 of these Measures, and should stop him from entering the relevant places.

Forty-second urban management administrative law enforcement departments shall strictly implement the Regulations on the Administration of Urban Appearance and Environmental Sanitation of Zhuhai Special Economic Zone and the Measures for the Administration of Parks in Zhuhai, and perform the following duties according to law:

(a) to urge dog owners to consciously fulfill the responsibility of city appearance and environmental sanitation caused by dogs, and take the initiative to clean up the feces and garbage generated by outdoor activities of dogs;

(two) to investigate and deal with the behavior of dog owners that affect the city appearance and environmental sanitation.

Forty-third animal husbandry and veterinary administrative departments and animal health supervision institutions shall strictly implement the "People's Republic of China (PRC) Animal Epidemic Prevention Law" and do a good job in the supervision and implementation of dog epidemic prevention.

Article 44 When any unit or individual discovers or suspects that a dog is infected with rabies, it shall promptly report to the animal husbandry and veterinary administrative department. The animal husbandry and veterinary administrative department shall take timely measures and report in accordance with the relevant provisions of the state.

Forty-fifth education management departments should organize schools to strengthen the guidance of students' dog-raising behavior and popularize the popular science knowledge of civilized and hygienic dog-raising.

Forty-sixth public security departments should patrol and enforce the law in the main urban area and the urban-rural fringe, and clean up and dispose of homeless dogs and stray dogs.

Forty-seventh when a major epidemic that endangers personal health or life safety occurs, the relevant law enforcement departments may make an emergency decision with the authorization of the Municipal People's Government.

Forty-eighth public security, urban management administrative law enforcement departments, as well as the town people's government, street offices should establish a dog complaint acceptance system, announced the acceptance of complaints telephone.

Chapter V Social Supervision

Forty-ninth governments at all levels and relevant departments should encourage, support and guide all sectors of society to supervise illegal dog owners. Any unit or individual has the right to criticize, dissuade, report and complain about the illegal dog-raising behavior of dog owners.

Fiftieth public security, urban management administrative law enforcement departments and other illegal dog owners have not corrected after repeated investigations, and can inform their units in writing of their illegal facts and investigation results; If there is no unit, inform the neighborhood (village) Committee where the household registration is located.

Fifty-first news media in this Municipality shall strengthen the guidance of public opinion, increase the propaganda of civilized and healthy dog-keeping, and assist public security, urban management administrative law enforcement and other departments to publish the list of illegal dog-keepers regularly or irregularly.

Article 52 The realty service enterprise, neighborhood (village) people's committee and the unit where the illegal dog breeder works shall persuade and educate the illegal dog breeder in accordance with the owners' convention, neighborhood (village) people's autonomy convention and unit management system, and announce the name, illegal facts and investigation of the illegal dog breeder when necessary.

Fifty-third in violation of the provisions of article eleventh of these measures, the public security department shall impose a fine of more than 500 yuan per place.

Fifty-fourth public security departments should strictly implement the provisions of Article 75 of the People's Republic of China (PRC) Public Security Administration Punishment Law, and give a warning to dogs that interfere with the normal life of others; Those who fail to correct after warning, or allow dogs to intimidate others, shall be fined in 300 yuan.

Those who intentionally drive away dogs to hurt others shall be detained for more than five days and less than ten days and fined 300 yuan; If the circumstances are minor, they shall be detained for less than five days or fined 200 yuan.

Article 55 If a dog breeder refuses to listen to dissuasion and illegally brings a dog into a forbidden place, the urban management administrative law enforcement department shall order the dog breeder to make corrections and impose a fine on 200 yuan.

If the owners or managers of public * * * places and specific non-public * * * places fail to fulfill their management responsibilities, fail to clearly post a notice of no entry, and fail to effectively discourage dog owners from bringing dogs in, the urban management administrative law enforcement department shall order them to make corrections and impose a fine on 500 yuan.

Fifty-sixth dog owners do not vaccinate their dogs in accordance with the compulsory immunization plan for animal diseases, and the supervising agency for animal health shall order them to make corrections and give them a warning; Those who refuse to make corrections shall be dealt with by the supervising agency for animal health, and the required handling expenses shall be borne by the dog breeder, and a fine of 1000 yuan may be imposed.

Article 57 If a dog owner fails to dispose of infected dogs and their excreta in accordance with the provisions of the competent animal husbandry and veterinary department, or the dead bodies of dogs that have died or died of unknown causes, the supervising agency for animal health shall order the dog owner to carry out harmless treatment; If the dog owner refuses to implement it, it shall be handled by the animal health supervision agency, and the required handling expenses shall be borne by the dog owner, with a maximum fine of 3000 yuan.

Fifty-eighth dog owners have one of the following acts, and the supervising agency for animal health shall order them to make corrections; Refuses to correct, such as illegal dog owners belong to the unit, a fine of more than 1000 yuan 10000 yuan; Illegal dog owners who belong to individuals can be fined in 500 yuan:

(a) did not fulfill the obligation to report the dog epidemic;

(two) do not truthfully provide information related to dog epidemic prevention activities;

(3) refusing the supervision and inspection by the supervising agency for animal health;

(4) refusing animal epidemic prevention and control institutions to monitor animal epidemics.

Article 59 If the urban management administrative law enforcement department finds or receives the dog carried by the dog owner to urinate anywhere, the urban management administrative law enforcement department shall order the dog owner to make corrections and impose a fine on 200 yuan.

Sixtieth public security, urban management administrative law enforcement departments and their staff shall perform their duties of dog management according to law, enforce the law in a civilized manner, accept complaints from units and individuals on dog management according to law, and promptly investigate and deal with illegal acts.

If the complaint that should be accepted is not accepted, or the behavior that should be stopped and investigated is not stopped and investigated, resulting in serious damage to the legitimate rights and interests and public interests of citizens, legal persons or other organizations, or abuse of power, corruption, the directly responsible person in charge and other directly responsible personnel shall be punished by the department where they belong or the competent department at a higher level according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 61 If a citizen, legal person or other organization refuses to accept a specific administrative act of the relevant competent department, it may bring an administrative reconsideration or administrative lawsuit according to law.

Chapter VII Supplementary Provisions

Article 62 Military dogs, police dogs and dogs for scientific research shall be managed by the army and public security departments according to law, and these Measures shall not apply.

Article 63 These Measures shall come into force as of August 6, 2009.
