The State Council's "Regulations on Property Management" does not stipulate how to collect the property management service fee before the owner or user moves in after the property is sold.

Some provinces and cities stipulate:

For the vacant property that has not been occupied for a long time (for more than six months in a row) and the vacant property that has not been used for a long time after the owner has checked in, the owner shall file a written record with the property service enterprise and pay the vacant property fee according to 70% to 90% of the stipulated or agreed service standard. The specific proportion shall be formulated by the local price and real estate management department.

Delivered to the owner:

The property fee shall be collected from the month when the property is delivered to the owner. But the vehicle management fee should be paid in full. For the property and parking space that has not been occupied or used for more than one month, the owner shall submit a written application to the property service enterprise in advance, and after confirmation, pay the management fees such as motor vehicle parking service fees or parking space utilities, sanitation fees, etc. according to the prescribed standard of 70%.

It is the owner's obligation to pay the property fee, but it may not be paid in the following circumstances.

1. If the house quality problem is not delivered, the property fee shall be paid by the developer.

2. Lease the house, and the contract indicates that the property fee shall be paid by the tenant.

3. If the property management company fails to perform the service responsibilities of the contract, all owners can refuse to pay, but there must be strong evidence.

4. If the property management company arbitrarily expands the charging scope, raises the charging standard and charges repeatedly, the owner may refuse to pay.

5. If the property management company increases the charging items without the consent of the owner, the owner may refuse to pay.
