Identification standard of illegal buildings on the top floor

Legal analysis: (1) Buildings built without application or approval and without obtaining the planning permit for construction land and the planning permit for construction projects; (2) changing the buildings built according to the provisions of the construction project planning permit without authorization; (three) buildings built without changing the nature of use; (four) buildings that have not been demolished into permanent buildings after the expiration of the temporary building construction period; (5) Buildings constructed by forging relevant materials to defraud the permission of the competent department.

Legal basis: Article 65 of People's Republic of China (PRC) Urban Real Estate Management Law violates the provisions of Article 30 of this Law and engages in real estate development and operation without obtaining a business license. The administrative department for industry and commerce of the people's government at or above the county level shall order it to stop the real estate development business, confiscate its illegal income and may also impose a fine.
