Regulations of Qingyuan Manchu Autonomous County on Property Management (202 1 Revision)
(a) responsible for the supervision and management of property service quality and enterprise credit;
(two) responsible for the development of property management agreements, service contracts, service standards and other model texts and norms;
(three) business guidance, training, supervision and management of property service enterprises and employees;
(four) to supervise and manage the use and maintenance of the property;
(five) the establishment of property management complaints acceptance system, investigate and deal with illegal acts in property management according to law;
(six) to guide, assist and supervise the transfer and takeover of property within the jurisdiction;
(seven) other duties that property management should perform. Article 4 Other administrative departments of Autonomous County shall, according to their respective duties, be responsible for the supervision and management of related activities within the property management area.
The following departments are responsible for specific affairs:
(a) the comprehensive law enforcement department of urban management is responsible for illegal construction, setting up stalls, occupying and damaging green space, cutting down, moving and pruning trees, burning leaves, garbage and other wastes without authorization. ;
(two) the public security organs shall be responsible for investigating and dealing with illegal acts affecting public safety and public order in the property community according to law, and supervise and inspect the monitoring and public security;
(three) the administrative department of market supervision is responsible for the supervision and inspection of the safe operation of special equipment such as elevators;
(four) the price administrative department is responsible for the supervision and inspection of property service charges;
(five) the emergency management department is responsible for the supervision and inspection of fire safety. Fifth Autonomous County Township People's government shall perform the following duties of property management:
(a) to organize, guide and coordinate the establishment of the owners' meeting, the election of the owners' committee, and the selection of property service enterprises;
(two) to supervise and manage the work of the owners' committee;
(three) to coordinate the property management disputes between the owners, the owners' committee and the property service enterprises;
(four) to coordinate the relationship between property service enterprises and community residents' committees;
(five) other duties that should be performed by the property management department. Article 6 The community residents' committee shall be specifically responsible for supervising the owners' congress and the owners' committee to implement the owner's self-management according to law, and cooperate with the property administrative department of the Autonomous County to conduct daily management and assessment of the service activities of the property service enterprises within its jurisdiction. Article 7 The working funds of the owners' committee shall be drawn from part of the owners' income or borne by all owners, and the specific measures and standards shall be decided by the owners' congress. Eighth due to regional changes in property management and other reasons, resulting in the dissolution of the owners' assembly or the owners' committee, before the dissolution, the Township People's government where the property is located shall organize the liquidation of the property.
If the owners' congress or owners' committee has not been established in the property management area, the property service enterprise stops service or other major and urgent property management events occur, and the owners need to agree to decide to dismiss or hire the property service enterprise or other matters, the local township people's government shall organize the owners to agree to decide relevant matters, and the community residents' committee shall perform the duties of the owners' committee on their behalf. Article 9 When a construction unit sells a house, it shall take the temporary management statute as an annex to the house sales contract, and when a buyer purchases a new house, it shall sign the temporary management statute in writing and be bound by it. Article 10 A realty service enterprise shall not charge the owners any fees other than the realty service contract. Eleventh large-scale maintenance plan of the property service area shall be submitted to the owners' meeting for consideration, and the maintenance project, cost budget, source of funds, cost range and results of the use of funds shall be publicized in the community.
Maintenance projects in line with the conditions for the use of special housing maintenance funds, property services companies should assist owners in using special housing maintenance funds in accordance with the relevant provisions. Twelfth property service enterprises shall, within 05 days from the date of signing the property service contract, report the property service contract to the property administrative department of the autonomous county for the record. Thirteenth property service enterprises in the signing of the property service contract, shall pay the property service performance bond to the property administrative department of the Autonomous County. Property service performance bond shall be paid to the administrative department of urban and rural planning and construction of Autonomous County in accordance with the property service fee charged by the total construction area of the property community for three months. The performance bond of the realty service enterprise shall not be less than 50,000 yuan, and if the bond is less than 70% of the payable amount, it shall be fully supplemented. The performance bond shall be deposited by enterprises, supervised by the government and stored in special accounts.
If a realty service enterprise fails to provide services in accordance with the realty service contract or terminates the realty service without authorization in accordance with the contract, it shall be liable for breach of contract. If the contract expires without renewal or early termination, the property service performance bond shall be returned to the property service enterprise according to the contract agreement and purpose after the handover of the property site and the property file is correct. Article 14 Where the realty service contract is not renewed upon expiration, or the realty service contract is dissolved in accordance with the law or in advance, the realty service enterprise shall perform the following obligations:
(a) the transfer of property files, property services related information and property services to the owners' committee, and if the owners' committee is not established, the community residents' committee shall perform its duties instead of the owners' committee;
(two) the avoidance of property service personnel in the property management area;
(3) Settle the property service fees and related fees collected in the early stage with the owners' committee and hand them over;
(4) Other matters stipulated by laws and regulations.
