Article 3 These Measures shall apply to all state organs directly under the municipal government, institutions that implement budget management, social organizations and relevant units that use fiscal funds to implement government procurement activities (hereinafter referred to as procurement units).

Financial funds refer to funds allocated centrally through the national budget; Funds collected by local governments and administrative institutions implementing budget management in accordance with relevant laws and regulations. Fourth municipal government procurement management committee is the leading body of government procurement, responsible for formulating procurement policies and regulations, coordinating and guiding government procurement. The municipal government procurement management committee consists of the government procurement management office (hereinafter referred to as the procurement office), the government procurement center (hereinafter referred to as the procurement center), the investment project management center and the construction project bidding management office.

The procurement office is the government procurement management organ, which is led by the Municipal Finance Bureau in business and performs the following duties: (1) implementing relevant policies and regulations on government procurement; Formulate relevant rules and regulations and management measures for government procurement; Compiling government procurement catalogue and budget; Reply to the plans and budgetary estimates of government procurement projects; Responsible for the allocation and management of government procurement funds; Statistics, analysis, management and monitoring of the whole process of political procurement.

The procurement center is the executive body of government procurement and is led by the procurement office. Responsible for the establishment of government procurement project library and corresponding information system, organize the implementation of government procurement, sign procurement contracts or agreements, and check and accept procurement results. Chapter II Principles, Procedures and Methods of Government Procurement Article 5 Government procurement shall follow the principles of openness, fairness, impartiality, competition and efficiency, safeguard public interests, and improve the efficiency of administrative work and the efficiency of the use of financial funds. Sixth government procurement should be conducive to the development of regional economy, giving priority to the procurement of new industrial products with low energy consumption, low pollution and meeting the requirements of the national industrial policy. Article 7 Anyone who meets the requirements for bidding and purchasing shall be invited for public bidding. The tendering agency shall, according to the procurement plan, make the tender through market investigation, openly develop the tender, scientifically evaluate the tender and award the tender fairly, and carry out bidding and procurement. Article 8 When purchasing the materials needed for the project, the products produced by enterprises in this Municipality shall be given priority under the condition that the product quality, price and function are basically the same. Goods that cannot be produced by enterprises in this Municipality or whose quality, price and function really cannot meet the needs can be purchased outside the city; In the case that the project cost and quality are roughly equal, priority is given to the construction enterprises in this city. For projects that cannot be constructed by construction enterprises in this city, you can choose construction enterprises outside the city; When the service cost and quality are roughly the same, the public service enterprises in this city are given priority, and the service projects that cannot be served by the public service enterprises in this city can be selected outside the city. Article 9 Government procurement is divided into bidding procurement, inquiry procurement and negotiation procurement according to procurement methods.

Any competitive procurement project with a large single purchase amount or a large batch purchase amount shall be organized by the government procurement center. The overall bidding of a single or overall project shall be reported to the Procurement Office in advance, and the pre-tender estimate of the project shall be examined and approved by the investment project management center in conjunction with the procurement center. Bidding and procurement shall be organized by the procurement center, or entrusted by the procurement center to an intermediary agency with bidding qualification. The whole bidding process should strictly implement the relevant provisions of the Bidding Law of People's Republic of China (PRC) and these Measures.

Non-competitive procurement projects shall be procured by comparing the quotations provided by more than three suppliers with the quality and performance of goods and articles.

For some small and scattered projects, emergency projects, etc. The purchasing center or purchasing unit can negotiate with multiple suppliers and choose the best purchase. Tenth government procurement is divided into centralized procurement and decentralized procurement according to management methods.

If the purchase quantity and amount exceed a certain amount and the purchase varieties are relatively concentrated, centralized procurement will be implemented, and the procurement center will sign a contract or agreement with the supplier to implement the procurement.

If the purchase quantity and amount are below a certain amount, there are many kinds of purchases, or centralized procurement is not suitable for some reason, decentralized procurement will be implemented, and the procurement unit will sign a contract or agreement with the supplier to implement the procurement.

The specific scope of decentralized procurement includes: the single amount is small and the procurement items are scattered; Although there is a certain amount, the procurement items are very scattered (such as maintenance items and items that need to be decentralized in a single project with a large amount); Special causes and emergencies; The funds invested by the government in enterprises include technological transformation, environmental protection subsidies and science and technology. Eleventh government procurement methods and management measures shall be decided by the procurement office. Chapter III Government Procurement Budget and Plan Article 12 The preparation of government procurement budget and plan shall conform to the requirements of the national economic and social development plan, fully combine the market price and the quality of purchased goods, and reduce the procurement cost. The government procurement budget must be compiled according to the budget arrangement of the fiscal year. For other funds, it must be compiled on the premise of ensuring the source of funds, distinguishing the nature of funds and clarifying the use of funds.
