With regard to illegal buildings, the illegal owners have violated the rights of other owners. From the perspective of legal rights and obligations, the property management company is not a party, but this does not mean that the property management company has no obligation. According to Article 46 of the Property Management Regulations,

Obligatory property service enterprises that stop and report illegal acts shall stop acts that violate laws and regulations such as public security, environmental protection, property decoration and use within the property management area, and report to the relevant administrative departments in a timely manner. After receiving the report from the realty service enterprise, the relevant administrative department shall stop the illegal act or deal with it according to law.

To sum up, the reasonable complaint of the property should be to send a rectification letter first to limit the rectification time. For the illegal construction that fails to be rectified as scheduled, the property service enterprise shall immediately contact the illegal construction department and be punished by the government department. If it is a lawsuit against an illegal construction unit or individual, it shall be initiated by the owners' committee.
