Measures of Chengdu Municipality on the Administration of Residential Quarters

Chapter I General Provisions Article 1 In order to strengthen the management of residential quarters in our city, improve the management and service level, and create a clean, civilized, safe, convenient and comfortable living environment for residents, these measures are formulated in accordance with the People's Republic of China (PRC) Urban Planning Law, the Regulations on the Administration of Urban Appearance and Environmental Sanitation, the Regulations on the Administration of Urban Construction Planning in Chengdu and other relevant laws and regulations. Article 2 The term "residential quarters" as mentioned in these Measures refers to residential quarters and residential groups with a construction land scale of more than 50,000 square meters formed through unified planning, rational municipal administration, comprehensive development and supporting construction. Article 3 These Measures shall apply to the residential quarters within the urban planning area of Chengdu.

All units, residents and units and individuals living in residential areas shall abide by these measures in carrying out various activities. Article 5 The municipal and district people's governments shall be responsible for the unified leadership of residential quarters within their respective administrative areas. All levels of urban construction management, planning, real estate, city appearance and sanitation, municipal administration, public utilities, environmental protection, landscaping, public security, industrial and commercial administration, postal services, telecommunications, education, health and other departments are responsible for the supervision and management of residential quarters according to their duties, and cooperate with sub-district offices to do a good job in the management of residential quarters. Sixth new residential areas should implement property management, and the daily management of residential areas should be undertaken by property management enterprises. During the construction of residential quarters, the development unit established or hired a property company to participate in the construction period management and signed a contract. After the handover of the residential area, the subdistrict office or the residential area management committee shall, in accordance with the principle of equal competition, select the best property company to contract property management.

The term "property management" as mentioned in these Measures refers to the service and management of the use, maintenance, environmental sanitation and public order of houses in residential areas by property management companies registered by the administrative department for industry and commerce. Seventh residential residents have the right to participate in the management of residential areas, and bear the obligation of rational use of houses and public facilities, and abide by the regulations on the management of residential areas. Chapter II Planning and Construction Article 8 The planning and construction of residential areas shall be incorporated into the national economic and social development plan of our city and subject to the overall urban planning. Article 9 The planning and design of residential areas shall conform to the Code for Planning and Design of Urban Residential Areas in People's Republic of China (PRC) and the relevant provisions of the state. Roads, pipelines, public green spaces, primary and secondary schools, kindergartens, street offices, police stations, farmers' markets, parking garages, and municipal public infrastructure such as medical and health care, culture and sports, business services, finance, postal services, telecommunications, and sanitation. Must go through planning and design.

The level of municipal public infrastructure and public facilities in residential quarters must correspond to the size of the resident population, and be planned, constructed and put into use simultaneously with the residence. Tenth residential street names should be named by the place name management agencies in the planning and design. Eleventh planning and design of residential areas need to be approved by the municipal construction administrative department in conjunction with relevant departments and the local people's government. The construction of residential quarters must be formed in accordance with the approved planning and design scheme.

Two or more development units to participate in the development and construction of residential areas, by the municipal and District People's governments to determine a development unit to take the lead, and signed a corresponding letter of responsibility, in accordance with the ground first, municipal public infrastructure first, superstructure, public facilities and housing construction synchronous principle of implementation of construction.

The municipal construction administrative department, the municipal planning administrative department and the district people's government shall manage and supervise the construction of residential quarters. Twelfth real estate development enterprises and enterprises undertaking the task of building residential quarters must carry out development and construction in accordance with the relevant provisions of the state.

The construction of residential quarters should be subject to bidding and equal competition. Thirteenth approved residential district planning and design, must be strictly implemented. The following acts are prohibited during construction:

(1) changing the approved construction planning and design without authorization;

(2) changing the nature of land use without authorization;

(three) the red line map of construction land transfer;

(4) changing the architectural design without authorization;

(five) less or no municipal public infrastructure and public facilities. Fourteenth approved residential district planning and design needs to be partially changed, and must be approved by the municipal construction administrative department and the municipal planning administrative department. The municipal construction administrative department and the municipal planning administrative department shall solicit the opinions of the local people's government when examining and approving. Chapter III Acceptance and Handover Article 15 Comprehensive acceptance must be conducted for the completion of residential quarters. Acceptance of the work by the construction unit to submit a written application, the municipal construction administrative department is responsible for the District People's government, street offices and other relevant departments to form a comprehensive acceptance team, in accordance with the relevant provisions of the acceptance. The acceptance of residential areas, by the municipal administrative department of construction issued a "residential comprehensive acceptance certificate".

The residential areas built by stages can be accepted by stages, and comprehensive acceptance can be carried out after all the projects are completed. Residential quarters, municipal public infrastructure and public facilities that have passed the acceptance by stages can be put into use by stages if they meet the functional requirements.
