In order to implement the spirit of "Guiding Opinions of General Office of the State Council on Comprehensively Promoting the Transformation of Old Urban Residential Areas" (No.23 [2020] of Guo Ban Fa, hereinafter referred to as "Guiding Opinions") and comprehensively promote the transformation of old urban residential areas in our province, with the consent of the provincial government, we hereby put forward the following implementation opinions:
I. General requirements
All localities should conscientiously implement the spirit of the Eighth Plenary Session of the Twelfth Provincial Party Committee in accordance with the guiding ideology and transformation principles determined in the Guiding Opinions, combine the transformation of old residential areas with tasks such as urban renewal, community construction, sponge city construction, and domestic waste sorting, do what they can, continuously improve their living conditions, and promote the construction of "* * * * * * * * *".
Second, the scope of transformation and objectives and tasks
(1) transformation scope. Cities, counties, former farms and secondary institutions of forest industry system are located, and old residential areas or single residential buildings that need to be transformed will be built before the end of 2000. C-class houses built after 2000 and identified as safe, as well as non-complete houses without separate kitchens and bathrooms, can be included in the scope of renovation.
(2) objectives and tasks. In 20021year, the province started to renovate old residential areas 1439, involving nearly 400,000 residents. Strive to basically complete the transformation of old residential areas within the scope of transformation by the end of the 14 th Five-Year Plan.
(3) Determine the scheme. All localities should find out the stock base, don't blindly compare with others, borrow money to set up stalls, scientifically compile the "14th Five-Year Plan" for the renovation of old residential areas, reasonably determine the annual renovation plan, and take residents' investment, the establishment of the owners' committee (property management committee) and the determination of the property management mode after the renovation as prerequisites for inclusion in the annual renovation plan.
Third, the type of transformation.
The transformation of old residential areas in our province is divided into basic, perfect and upgrading categories. The transformation of basic classes should be "changed to the extreme", the transformation of perfect classes should strive to "change to the appropriate time" and the transformation of advanced classes should strive to "change to the possible time".
(1) base class. In order to meet the residents' safety needs and basic living needs, the renovation mainly includes external wall insulation and painting, roof insulation and waterproofing, staircase painting and lighting, staircase window replacement, water supply, drainage, power supply, gas supply, heating, roads, fire protection, security, domestic waste sorting, mobile communication, radio and television and other infrastructure in and in contact with the community, as well as community lighting, fttp and overhead lines.
(2) Perfect category. In order to meet the needs of residents for convenience and improvement of life, the renovation mainly includes greening renovation of the community, installing elevators in qualified buildings, improving facilities suitable for the elderly in the community, barrier-free facilities, parking garages (yards), electric bicycles and car charging piles, logistics express boxes, cultural and leisure facilities, sports and fitness facilities, property buildings and other supporting facilities, as well as the replacement of some pipelines and outdoor windows exclusive to residents.
(3) promotion category. Enrich the supply of community services and improve the quality of life of residents, mainly including comprehensive service facilities, public health facilities, kindergartens, perimeter protection and other intelligent perception, 5G facilities, old-age care, nurseries, food aid, housekeeping, convenience markets, convenience stores, postal express terminal comprehensive service stations, public service rooms, emergency shelters, and emergency facilities that can meet disaster prevention and epidemic prevention.
Fourth, improve the organization and implementation mechanism.
(1) Strengthen organization and promote coordination.
1. Provincial overall coordination. Relevant departments directly under the provincial level should establish a coordination and promotion mechanism, implement departmental responsibilities and tasks, formulate transformation policies, review transformation plans, and coordinate and solve major problems.
2. Cities and counties promote implementation. The local government takes overall responsibility, determines the lead department, and sets up a working leading group composed of housing and construction, development and reform, finance, urban management, natural resources, public security, civil affairs, health and wellness, education, communication management, emergency management and other departments and professional business units to study important issues, clarify departmental responsibilities, and establish a working mechanism to jointly promote transformation.
3. The streets (towns) participate in the whole process. Street offices (town governments) should participate in the transformation and management of the whole project. Responsible for finding out the project situation, investigating residents' willingness and satisfaction with renovation, organizing residents to elect owners' committees or set up property management committees, guiding residents to determine the long-term management mechanism after renovation, and implementing residents' investment and supplementing special housing maintenance funds in conjunction with relevant departments.
(2) Organize residents to fully participate.
1. Give play to the leading role of Party building. All localities should establish and improve the grass-roots community governance model under the guidance of party building, give full play to the role of street (town) and community party organizations, and coordinate community residents to participate in the transformation.
2. Organize residents to participate in the whole process. All localities should build communication and discussion platforms, carry out various forms of grassroots consultations led by grassroots party organizations, and organize residents to participate in the whole process of scheme formulation, construction cooperation, follow-up management and effect evaluation.
(3) Strengthen the management of transformation implementation.
1. Implement the subject. All localities should clarify the main body of project transformation and establish a project implementation mechanism involving relevant enterprises and pipeline professional business units. Carry out the reform mode of general contracting and whole process engineering consulting service.
2. Overall planning and implementation. Actively promote the joint renovation of the district, promote the overall renewal of plots highly related to the renovation of the district, build a living environment with perfect functions, excellent quality and convenient living, and create a "5 minutes, 10 minutes, 15 minutes" living circle.
3. Professional business units participate. All localities should organize professional business units to do a good job in the claim of existing pipelines, the determination of renovation contents, the formulation of renovation plans, the clear property rights of facilities, and the implementation of maintenance responsibilities, and sign renovation agreements to ensure the simultaneous implementation of pipeline renovation and other renovation contents. It is necessary to provide support and convenience for the project implementation of professional business units, and it is forbidden to charge unreasonable and illegal fees. Without consultation, the existing facilities and equipment of professional business units shall not be dismantled and changed without authorization.
4. Protect the urban landscape. The renovation project involves historical and cultural blocks, immovable cultural relics and historical buildings. Strictly implement the requirements of protection and repair, and continue the urban characteristics and historical context.
5. Create characteristic communities. All localities should build a number of "complete residential areas" and "green communities" in accordance with the relevant requirements of the state, starting from 202 1 and combining the transformation of old residential areas with conditions.
(4) Strengthen quality and safety supervision.
1. Implement regulatory responsibilities. Implement the supervision responsibility of the department, strengthen the supervision and management of quality and safety in the whole process of engineering design, construction and acceptance, strengthen inspection and sampling, follow-up review, and strictly control the quality and safety of the project.
2. Implement the main responsibility. The responsible subjects of all parties involved in the construction should strengthen the quality and safety supervision and inspection of important links and key parts of the construction site in strict accordance with the relevant provisions on project quality and safety production, and eliminate hidden dangers of quality and safety in time. Carry out civilized construction management system and strengthen standardized management of construction site.
3. Strictly control the quality of materials. All localities should implement the quality inspection system for waterproof, thermal insulation and other building materials and components, regularly carry out on-site sampling inspection and testing, and investigate and deal with illegal acts according to law. We should choose new technologies, new processes and new materials that are economical, applicable and environmentally friendly. Encourage centralized procurement of bulk building materials.
4. Establish a publicity system. When organizing the project renovation, all localities will publicize the renovation information on the spot according to the requirements of the unified publicity template, and implement the 1 QR code 1 project, which will be supervised by all sectors of society.
5. Play a supervisory role. All localities should open channels for complaints and reports, and ensure residents' right to know, participate and supervise in the transformation. The audit department should strengthen the audit supervision of the funds related to the renovation project.
(5) Improve the long-term management mechanism.
1. Improve the follow-up management mechanism. All localities should guide the owners' congress and the owners' committee (property management committee) to formulate management statutes and rules of procedure according to law. It is necessary to clarify the payment standard of residential special maintenance funds, and establish and improve the system of payment, renewal, use and immediate delivery. Encourage related service facilities to be entrusted to property service enterprises by performing legal procedures, and enhance the "self-hematopoietic" function of the community.
2. Innovative property management mode. All localities should guide residents to negotiate and determine the reformed property management model, and promote the undertaking of the reformed property management by classified policies. Encourage property service enterprises to intervene in advance according to law, participate in the whole process of transformation, and undertake subsequent property management according to law. Encourage the implementation of the property service fee system after community transformation.
Fifth, improve the transformation financing mechanism.
(a) to fulfill the obligations of residents.
All localities should follow the principle of "who benefits, who contributes", and determine the policy that residents bear different proportions of reconstruction funds according to different reconstruction contents and regions, and contribute in various ways. All localities should formulate policies to help the needy. Formulate policies to support residents to withdraw housing provident fund for residents to pay for the renovation of old residential areas and the installation of elevators. Strengthen the management of the use of part of residents' investment.
(2) Strengthen financing for transformation.
All localities should raise funds for renovation through market-oriented financing, investment by professional business units, financial funds, and the use of state-owned housing sales income. It is necessary to guide financial institutions to support the transformation of old residential areas, adopt a market-oriented approach, and use corporate credit bonds and project income bills for bond financing. Actively strive for the National Development Bank, Agricultural Development Bank and other commercial banks to increase credit support for the transformation of old residential areas.
(3) Promote the participation of social forces.
Professional business units shall implement the relevant provisions of the Regulations on the Administration of Residential Property in Heilongjiang Province and participate in the transformation of relevant pipeline facilities and equipment. After the transformation, the property rights of franchise facilities and equipment shall be transferred to professional business units in accordance with legal procedures, and those that meet the relevant provisions shall be included in the cost of enterprises according to law, and they shall be responsible for the subsequent daily maintenance and management. It is necessary to attract social forces to invest in the transformation through government procurement, paid use of new facilities, and implementation of asset rights and interests.
(four) the implementation of tax relief policies.
1. Professional business unit policy. Professional business units participate in the renovation of old residential areas organized by the government, and the expenses incurred in the renovation of supporting assets such as facilities and equipment that they have obtained ownership can be used as the tax basis for the facilities and equipment, and depreciation is accrued according to regulations and deducted before enterprise income tax. The maintenance and management expenses incurred can be included in the pre-tax deduction of the current expenses of the enterprise according to the regulations.
2. Support the service policy. In the transformation of old residential areas, construction projects used to provide community pension, child care and housekeeping services are exempted from supporting fees for urban infrastructure; Exempt from deed tax, property tax, urban land use tax, real estate registration fee, cultivated land reclamation fee and land idle fee in accordance with state regulations; If it is impossible to build an air defense basement due to geological conditions and other reasons, the air defense basement construction fee will be exempted.
Sixth, determine the supporting policy support.
(1) Improve the efficiency of project approval.
1. Optimize the approval process. All localities should optimize and simplify the approval process and reduce the time limit for approval. The longest time limit for the whole process approval of the old residential renovation project shall not exceed 15 working days.
2. Conduct joint assessment and joint review. All localities should determine the lead department, organize relevant departments of administrative examination and approval, relevant professional business units and local streets (towns), conduct a joint evaluation of the renovation plan of old residential areas, and put forward revised opinions at one time. Except for projects as otherwise stipulated by the state, relevant departments can directly go through the examination and approval procedures for project establishment, land use, environmental assessment, planning, construction permit and so on according to the transformation plan determined by the joint evaluation and joint examination.
3. Simplify the approval process. According to the joint review opinions and the transformation plan determined by the joint review, the project proposal will no longer be approved; There is no need to apply for land planning permission for renovation projects that do not involve changes in land ownership or adjustment of planning conditions; Construction projects that are not listed in the Catalogue for Classified Management of Environmental Impact Assessment of Construction Projects do not need to go through EIA procedures; For low-risk projects that do not involve changes in the main structure of the building, if the project construction unit implements the notification commitment system, it may not conduct construction drawing review; There is no need to apply for a construction permit for new projects with a construction area of 500 square meters or less or a project investment of 6,543,800 yuan or less. Encourage a regional transformation project implemented by the same construction unit to be bundled, submitted for approval and implemented separately.
4. Reasonable determination of standards. Natural resources departments should clarify the standard requirements and strengthen the guidance and coordination of new construction land, new construction, renovation and expansion of public service facilities and municipal supporting infrastructure renovation projects. Because of the transformation and utilization of public space, the construction and transformation of various facilities involves the influence of sunshine spacing and the occupation of green space, which can be solved on the basis of widely soliciting residents' opinions. According to the actual situation, formulate relevant policies and standards for elevator installation, and support qualified buildings to install elevators.
5. Simplify the declaration procedures. Carry out joint acceptance of project completion with the participation of all contractors, streets (towns), owners' representatives and property service enterprises. For decoration projects that do not involve planning and fire control acceptance, the completion acceptance record form, acceptance report and project quality warranty signed by the construction unit can be submitted for the completion acceptance record.
(2) Integrate and utilize existing resources.
1. Revitalize existing resources. For the use of land in the community to install elevators and build various service facilities, it can be reasonably compatible or converted according to law without increasing land prices. Make effective use of vacant houses in institutions, enterprises and institutions, make overall use of public houses, community comprehensive service facilities, idle boiler rooms and other resources, and improve public service facilities such as pension and child care in old communities and surrounding communities. Conditional places can develop community services by renting and purchasing eligible houses such as commercial buildings on the ground floor of residential buildings.
2. Optimize control indicators. All localities should, in light of the actual situation, make use of scattered land around and non-residential low-efficiency land to carry out renovation projects, flexibly delimit land use boundaries, and optimize regulatory detailed planning adjustment procedures. Under the premise of not violating the relevant national mandatory standards and ensuring public interests and safety, the control indicators should be reasonably optimized in combination with historical reasons and actual conditions. If the renovation project contains demolition, reconstruction and reconstruction, the control indexes such as floor area ratio, green space ratio, control height and building density can be determined scientifically and reasonably on the premise of properly solving the needs of residents and the interests of neighboring parties.
(3) Clear land support policies.
1. Land supply policy. If the scattered land and non-residential inefficient land used in the transformation project meet the allocation conditions, the land shall be provided in accordance with the allocation method; Involving business purposes, the procedures can be optimized according to relevant regulations and transferred according to law.
2. Registration confirmation policy. In the whole renovation process, if idle houses and other stock houses are involved in the renovation and construction of various public service facilities, the procedures for changing the subject and nature of land use shall not be handled within a certain period of time. If the establishment of public service facilities requires real estate registration, the real estate registration agency shall actively handle it according to law.
Seven. Strengthen organizational guarantee
(1) Strengthen organizational leadership. All localities and departments should strengthen the organization and guidance to promote the transformation of old residential areas, implement the work responsibilities of the main person in charge personally and directly, actively study and transform major issues, and implement the responsibilities of organization, leadership, supervision and inspection.
(2) Do a good job in supervision and evaluation. The Provincial Department of Housing and Urban-Rural Development, in conjunction with relevant provincial departments, will strengthen supervision and inspection of local work, regularly report the situation, conduct performance evaluation, and the evaluation results will be included in the annual economic and social development index assessment of the city (prefecture).
(3) extensive publicity and guidance. All localities and relevant departments should strengthen social propaganda on the significance, experience and effectiveness of the transformation of old residential areas, guide residents to change their concepts, and change "I want to change" into "I want to change" to form a good atmosphere of broad social support and residents' active participation in the transformation.
The implementation opinions shall come into force as of the date of issuance and shall be valid until 65438+February 3, 20251. The original "Guiding Opinions of the General Office of the People's Government of Heilongjiang Province on Promoting the Transformation of Old Cities in the Province" (No.37 [2018] of Heizhengban) shall be abolished at the same time.
