Provisions on the Administration of Prohibiting Fireworks and Firecrackers in Yutai County

Article 1 In order to strengthen the management of fireworks and firecrackers, ensure public safety and the safety of citizens' lives and property, and purify the urban air environment, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council, the Regulations on the Management of Fireworks and Firecrackers in Jining and other laws and regulations.

Article 2 These Provisions shall apply to the restricted areas of Yutai County, Zhenjie and Huangzhang Chemical Industrial Zone.

(1) Yutai county is east to Yuhe River, west to Y 199 (Yutun-Menglou line), south to Y209 (Shuangxin-Da Zhu Zhuang line) and north to Binhu Road.

Including Gu Ting Community, Heping Village, Aiguo Village, Jianshe Village, Yunan Village, Zhoutang Village, Duan Dong Village, Duan Xi Village, Jiangzhuang Village, lizhuang village Village, Baliwan Village, Wangziliang Village, Miaoji Village, Shenlong Village, Wangzhuang Village, Yang Lou Village, Shuanghan cun Village, Tulou Village, Ligengbu Village and Jiangzhuang Village. Guanyu Community, Garden Club, Zhanqian Community, Xiaoxian Community, Hu Ling Community, Yu Fang Community, Canal Community, Chineydy Community, Jiefang Neighborhood Committee, Xinhua Neighborhood Committee, Xinmin Neighborhood Committee, Mitan Village, Central Village, Taolou Village, Qianjin Village, Yun Bei Village, Mashizhuang Village, Qishengtang Village, Shengli Village, He Lin Village, Danie Village, Gaozhuang Village and other Hanlin Communities in Tangma Town. Menglou Village, Panzhuang Village, Zhang Miao Village, Shilou Village, Dou Liyan Village, Liuzhuang Village, Houyan Village and Gengzhuang Village in Wang Lu Town.

(2) Laozhai Town is adjacent to Shuanghe Coal Mine in the east, Yanji Irrigation and Drainage Station in the west, Paifang Street in Laodong Village and Laoxi Village in the south and Ding Sheng Industry and Trade in the north. Including Shuanghe Village, yan ji cun and Laobei Village.

(3) Tangma Town is east to Shuangzhu Road; West to Qingnian Road; Nanzhi town residents supply and marketing gas station; North to South Ring Road. Including Juanpenglou Village, Tangma Village, Zhenhua Village, Suizhuang Village, Zhuangzong Village, Chen Bing Village and Zheng Zhuang Village.

(4) Wang Lu Town is east to the junction of 25 1 provincial highway in Liu Zhuang, west to Huihe River, south to Mishi Street water system, and north to Daoxiang Street. Including Tangchen Village and Wang Lu Village.

(5) Huang Zhang is east to Chendian Village, west to Liulou Village, south to Chen Da Village and north to farmers' market. Including Wang Hu Jiayuan, Jinghang Jiayuan, Dong Zhang Community, Chen Da Village, Liulou Village, Jiejia Village and Chendian Village.

(6) Qinghe Town is east to the front street of Qinghe Town Health Center, west to Laowanfu River embankment, south to Laowanfu River Bridge, and north to Sinopec gas station. Including Qinghe Village and Zhang Youfang Village.

(7) Luotun Town is east to Luotun Grain Institute, west to Luotun West Main Canal, south to Luotun Village Boundary and north to Quzhuang Village. Including Luotun Village and Quzhuang Village.

(8) Li Ge is east of Huayuan Road, west of Zhongwangcun Road, south of PetroChina gas station and north of Sinopec gas station. Including lige village.

(9) Yucheng Town is east to Dai Ying Road, the landscape field, west to the West Ring Road, south to the intersection of Hui River and Jinyu River, and north to the North Ring Road. (10) Wang Miao is east to Zhangji Village, west to New Vegetable Market, north to Zhangji Road and Miaopu Road, and south to Zaocao Line and Wang Miao Middle School. Include Zhangji village, Wang Miao village and Mazhuang village.

(1 1) Huang Zhang Chemical Industry Zone is east to Xingye Road and Fukang Avenue, west to Luhua West Road and Zhang Wu Highway, south to Binhu No.4 Road and north to Xinghua Road.

Article 3 Fireworks and firecrackers are prohibited throughout the year.

If it is really necessary to hold a fireworks party or other large-scale fireworks display activities in the area where fireworks and firecrackers are prohibited, the organizer shall apply to the public security department for approval before implementation.

Article 4 The county government will incorporate the prohibition of setting off fireworks and firecrackers into the creation of civilized cities and the comprehensive management of social security, implement the responsibilities step by step, and establish a linkage working mechanism between relevant departments and towns and streets.

Article 5 The public security department is the competent department that prohibits the discharge of fireworks and firecrackers, is responsible for the safety management of fireworks and firecrackers, and does the following work:

(a) take the lead in organizing the county emergency management bureau, county comprehensive administrative law enforcement bureau, county market supervision and management bureau and other departments to carry out special activities to prohibit the discharge of fireworks and firecrackers in urban areas, township streets and Huangzhang Chemical Park.

(two) to stop and investigate the illegal discharge of fireworks and firecrackers; Collect and properly dispose of fireworks and firecrackers involved; Investigate and deal with illegal transportation (carrying) of fireworks and firecrackers, and cooperate with relevant departments to crack down on illegal sales of fireworks and firecrackers; Handle public security cases and criminal cases involving fireworks and firecrackers according to law, and severely crack down on illegal and criminal acts that hinder relevant functional departments from performing their duties according to law in the work of banning fireworks and firecrackers.

(three) signed a "no illegal fireworks guarantee" with the hotels, hotels and wedding companies within the jurisdiction.

(four) according to the arrangement of the county government, do a good job in the safety supervision of large-scale fireworks display activities in the city.

Sixth relevant towns, villages, organs, organizations, enterprises, institutions and other organizations are responsible for doing a good job in the work of prohibiting the discharge of fireworks and firecrackers in their respective jurisdictions and units, and establishing a liaison system.

The relevant towns, villages and residential areas shall set up publicity columns prohibiting the discharge of fireworks and firecrackers; Such as moving to a new house, opening a business, laying the foundation stone, capping, etc. Within the jurisdiction, inform the door in time to prevent illegal fireworks.

Seventh the following places and areas prohibit the discharge of fireworks:

(1) Important military facilities;

(2) cultural relics protection units;

(three) key fire control units such as inflammable and explosive goods storage places;

(four) stations, squares, parks, shopping malls, theaters, hospitals, kindergartens, schools, nursing homes and other crowded places;

(5) Power transmission and transformation facilities;

(six) other places and areas stipulated by the county government.

Places and areas where fireworks and firecrackers are prohibited shall be set up by the property owner or the user unit with warning signs clearly prohibiting fireworks and firecrackers, and shall be responsible for the care.

Article 8 The wholesale and retail of fireworks and firecrackers are prohibited throughout the year in the forbidden zone.

In violation of the provisions of the preceding paragraph, the emergency management bureau shall be punished according to law. Constitute a violation of public security management, the county public security bureau to give administrative penalties for public security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 9 It is strictly prohibited to set off fireworks bombs and A-and B-level combined fireworks, and to set off fireworks and firecrackers that do not meet the Safety and Quality Standards for Fireworks and Firecrackers (GB10631-2013) and are illegally produced and sold. In the time and area where discharge is allowed, individuals can discharge C and D fireworks and firecrackers marked "Personal Discharge".

Tenth fireworks should be set off in accordance with the discharge instructions, and comply with the following provisions:

(1) It is forbidden to throw or set off fireworks and firecrackers at crowds, vehicles and buildings.

(two) fireworks shall not be set off outside buildings, roofs and balconies.

(three) shall not hinder the safe passage of pedestrians and vehicles.

(four) shall not infringe upon the property of the state, the collective and the individual or the personal safety of others.

(5) Minors should be accompanied by guardians or other adults when setting off fireworks and firecrackers.

Eleventh without permission, no unit or individual may produce, operate, store or transport fireworks, and may not hold fireworks parties or other fireworks display activities.

Article 12 Where fireworks and firecrackers are set off in a prohibited time, place or area, or in a prohibited way, the public security department shall order it to stop setting off according to Article 19 of the Regulations on the Administration of Fireworks and Firecrackers in Jining City, and impose a fine of more than 200 yuan and less than 500 yuan; Those who violate the administration of public security shall be punished according to law.

Thirteenth units or individuals engaged in celebrations, weddings and other services throughout the year in areas where fireworks are prohibited shall not provide related services for illegal fireworks. In violation of the provisions, the public security department shall order it to make corrections according to the provisions of Article 15 of the Regulations on the Administration of Fireworks and Firecrackers in Jining City, and impose a fine of 1000 yuan to 5000 yuan.

Fourteenth in the area where fireworks and firecrackers are prohibited, the realty service enterprise shall urge the owners to abide by the relevant provisions of these regulations, and do a good job in reminding and preventing the discharge of fireworks and firecrackers; The illegal discharge of fireworks and firecrackers in the property management area should be discouraged. If it is ineffective, it should be reported to the public security department in a timely manner.

In the area where fireworks and firecrackers are prohibited, restaurants, hotels and other operators who undertake banquets and other services shall inform consumers not to set off fireworks and firecrackers illegally; Illegal discharge of fireworks and firecrackers at banquets and other activities should be discouraged. If dissuasion is ineffective, it shall report the case to the public security department in time.

Fifteenth in the time allowed to set off fireworks and firecrackers, fireworks and firecrackers in the region, the relevant units and individuals shall timely and properly handle the discharge residue.

Sixteenth fireworks caused losses to the state and collective property or caused personal injury or property losses to others, the actor shall be liable for compensation according to law; If it constitutes a violation of public security administration, it shall be dealt with by the public security department according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Seventeenth illegal production, management, transportation and storage of fireworks, which constitutes a violation of public security management, shall be given administrative penalties for public security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 18 These Provisions shall come into force on June 1 1 day, 2020, and shall be valid until June1day, 2025. The Notice of the People's Government of Yutai County on Printing and Distributing the Provisions on the Administration of Restricting the Discharge of Fireworks and Firecrackers in Yutai County (word [2019] No.25) shall be abolished at the same time.
