Measures of Shenyang Municipality on the Administration of Residential Quarters

Chapter I General Provisions Article 1 In order to strengthen the management of residential quarters, ensure the rational use of houses and public facilities, maintain public order in residential quarters and improve the quality of living environment, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of our city. Article 2 The term "residential quarters" as mentioned in these Measures refers to residential quarters (including non-residential houses in the region) with housing as the main body and supporting corresponding facilities with a construction area of over 20,000 square meters. Article 3 The management of residential quarters shall follow the principle of combining residents' autonomy with professional services, and implement socialized and professional management. Fourth owners and property users have the right to participate in the management of residential quarters and the obligation to abide by the public order of residential quarters. Article 5 The municipal real estate management department is the administrative department in charge of residential district management in this Municipality, responsible for the organization, coordination and business guidance of residential district management in this Municipality, uniformly formulating specific policies and management norms related to residential district management, and supervising and inspecting the management and service work of residential district management committees and property management enterprises.

The real estate management department of each district is the business management department of residential area management in this district, which coordinates, guides and inspects the management of residential areas.

City planning, urban construction, transportation, health, public security, urban management, posts and telecommunications, water supply, power supply, gas and other departments and units shall, according to their respective responsibilities, strengthen the management, supervision and guidance of residential quarters.

The District People's Government shall, in accordance with laws, regulations and relevant provisions of the state, conduct comprehensive management of residential quarters, and supervise and inspect the management of residential quarters. Article 6 A residential community shall set up a community management committee (hereinafter referred to as the management committee) to represent the interests of the owners and users and be responsible for the daily management of the residential community.

CMC can entrust property management companies to implement community management. Chapter II Management Institutions and Responsibilities of Residential Quarters Article 7 The Management Committee of Residential Quarters shall be established by the municipal and district real estate management departments. The CMC consists of representatives elected by the owners and users, members of residents' committees and representatives sent by relevant administrative departments and service units. Article 8 Responsibilities of the CMC:

(a) to formulate the articles of association of the management committee and safeguard the legitimate rights and interests of owners and property users;

(two) accept the supervision of the property owners and users in residential areas, and accept the supervision, inspection and guidance of the neighborhood offices and relevant departments where the residential areas are located;

(three) through the conclusion of the contract, decide to hire or renew the property management enterprise;

(four) to consider the annual management plan of residential quarters formulated by the property management enterprises and the major measures for the management, maintenance and service of residential quarters;

(five) according to the opinions and requirements of the owners and property users, inspect and supervise the daily work of property management enterprises and the use of community management funds;

(six) according to the actual situation of residential areas, formulate and organize housing property owners and users to sign residents' conventions. Article 9 A property management enterprise refers to an economic entity with corresponding qualifications, legally established, legal person status and engaged in property management business. Property management enterprises shall operate independently, conduct independent accounting and be responsible for their own profits and losses. Tenth residential property management should implement the principles of fair competition, survival of the fittest and liberalization of development. Eleventh city real estate management departments to conduct a unified qualification examination of the city's property management enterprises. Property management enterprises must go to the departments of industry and commerce, taxation and other departments for licenses before they can engage in business activities. Twelfth property management companies shall perform the following duties:

(three) the annual management plan and major management, maintenance and service measures shall be submitted to the CMC for deliberation and implementation after approval by the CMC;

(four) can entrust a franchise company to carry out special management;

(five) can implement a variety of business, with its income to supplement the management of residential areas. Thirteenth property management companies to carry out residential management business, must sign a management contract with the community management committee. The contract shall be reported to the municipal and district real estate management departments for the record. Fourteenth property management companies to carry out residential area management business, responsible for the following matters in the community:

(a) Repair and maintenance of buildings and ancillary facilities;

(two) street lamps, scenic spots, landscaping, manhole, septic tanks, roads, parking lots, letter boxes and other public facilities maintenance;

(three) environmental sanitation cleaning and cleaning, cleaning and dismantling manhole and septic tank;

(four) to maintain the order of cultural and entertainment venues;

(five) the management of convenience service outlets and garages;

(6) Maintaining public safety and traffic order;

(seven) the management of all kinds of files in residential quarters;

(eight) other matters stipulated in the contract. Fifteenth property management companies can carry out a variety of paid convenience services. Sixteenth residential housing and supporting facilities maintenance, by the property management companies and professional management departments responsible for the following division of responsibilities:

(a) power supply facilities: within the household line, the property management enterprises or housing property units are responsible; Outside, the electric power department is responsible for.

(2) Gas pipeline: The gas department is responsible for gas supply safety. The branch line, indoor pipeline and ancillary facilities (except gas meter) of the gas pipe network to the courtyard shall be responsible by the gas department, and the expenses shall be borne by the property right unit.

(3) Tap water pipeline: the property right unit is responsible for the water facilities (excluding water meters) in the main water gate of the user's household pipeline; Outside, the water company is responsible for.

(4) Sewer pipes: Septic tanks and pipes (excluding municipal pipes) within the red line of residential areas shall be the responsibility of property management enterprises; Outside, the municipal department is responsible for.

(5) Telecommunication pipelines: The property right unit is responsible for the telephone embedded pipelines in the building, and the telecommunication department is responsible for other pipelines.

(6) Heating pipeline: the heating department is responsible.

(seven) sanitation facilities and garbage removal by the sanitation department.

Community management committee can directly or entrust property management companies to organize and coordinate professional units for maintenance in time. Professional units can also entrust property management companies with paid maintenance (except gas facilities).
