How to write the house lease contract?
Party A: (Lessor)
Party B: (Lessee)
According to the Contract Law and the regulations of the state and local governments on house leasing, the following agreement is reached on house leasing through friendly negotiation between both parties:
Article 1 Party A guarantees that it has complete ownership and right to use the house leased to Party B.. Party B guarantees to know the whole picture of the house and take the present situation as the standard.
Article 2 The leased house is located with a construction area of square meters, with intact doors and windows, and normal supply of water, electricity, gas and heating (cubic meters on the natural gas meter and degrees on the electricity meter). Lease period of the house: from the date of 20 10 to the date of 20 10.
Article 3 The rent is RMB yuan per month (since the management fee and garbage fee of the family residence shall be borne by Party B).
Article 4 The rent shall be paid once every six months; Party B shall pay Party A six months' rent in advance from the effective date of this contract. The rent for the next half year shall be paid within 10 days before the expiration of the half year. The rent shall be paid in cash, and Party A shall issue a receipt to Party B when collecting the rent. Party B shall also pay Party A a deposit of RMB yuan and the first rent. After the expiration of the contract, if Party B has no damage to the current situation of the house, the deposit will be returned to Party B in full. If there is any damage, it shall be deducted according to the actual damage degree or the original price of the damaged goods. If there is any deficiency, Party B will make up for it. This deposit bears no interest.
Article 5 During the lease term, Party B shall bear the gas fee, water and electricity fee, heating fee, telephone fee, cable TV fee, network usage fee and public security fee. Necessary for normal life;
Article 6 During the lease term, Party B shall not sublet the house to a third party, otherwise Party A has the right to unilaterally terminate the contract and take back the house, and may hold Party B liable for breach of contract.
Article 7 During the lease period, Party A shall be responsible for the normal maintenance of the house, or entrust the lessee to maintain it on its behalf, and the maintenance expenses shall be borne by Party A. Party A shall ensure that the house can meet the needs of Party B's normal use and residence.
Article 8 During the lease period, if the house suffers from natural damage or man-made damage not caused by Party B, or the roof leaks, which affects Party B's normal living and life, Party A shall carry out maintenance within seven days from the date of receiving Party B's notice, and Party B shall have the right to carry out maintenance on its own after seven days. The repair costs shall be borne by Party A. ..
Article 9 During the lease term, if Party A really needs to take back the house for self-occupation, it must notify Party B in writing one month in advance. After the termination of the contract, Party A shall pay liquidated damages, which shall be calculated as 5% of the total rent payable during the remaining lease term.
Article 10 During the lease term, if Party B needs to cancel the lease, it must notify Party A in writing one month in advance. If both parties reach an agreement to terminate the contract, Party B shall pay Party A liquidated damages, which shall be calculated at 5% of the total rent payable during the remaining lease term.
Article 11 During the lease period, if Party B changes the structure and use of the house without Party A's consent and intentionally or negligently causes damage to the leased house and equipment, it shall be responsible for restoring the original state or compensating for economic losses. If Party B needs to decorate the wall, install windows and security doors, it must obtain the consent of Party A in advance.
Article 12 When the contract expires, the equipment and articles installed by Party B in the house can be transferred to Party A at a discount. If both parties fail to reach an agreement, Party B shall dismantle the house by itself within seven days after the expiration of the contract and restore the house to its original state. If it exceeds seven days, Party A has the right to keep it free of charge or dismantle it by itself, and the expenses for dismantling it shall be borne by Party B within a reasonable amount.
Article 13 If this contract is terminated or expired in advance according to this contract, Party B shall move out all equipment and articles within 15 days after receiving the formal written notice from Party A, unless otherwise agreed by both parties. If it is really difficult for Party B to find another house in the short term or there are other special circumstances, Party A allows Party B to postpone for 30 days, but Party B shall pay the rent in one lump sum according to the rent agreed in this contract. If the house remains surplus within 7 days after the relocation, and both parties fail to reach an agreement, Party B shall be deemed to have given up the ownership and Party A shall handle it.
Article 14 If Party B does not move after the lease expires or the contract is terminated, Party B shall compensate Party A for the economic losses suffered as a result.
Article 15 If Party B needs to renew the lease upon expiration, it shall notify Party A in writing 30 days in advance, and Party A shall raise an objection or negotiate with Party B to renew the lease within 30 days after receiving the written notice. If Party A fails to give a written reply within 30 days from the date of receiving Party B's written notice, it shall be deemed that Party B agrees to renew the lease by default, and this contract will be automatically renewed for one year from the day after the 30th date.
Article 16 Disputes arising from the performance of this Agreement shall be settled by both parties through consultation. If negotiation fails, they can bring a lawsuit to the court where the house is located.
Article 17 This Agreement shall come into force as of the date of signature by both parties. Where there are other provisions in this contract or laws and administrative regulations, such provisions shall prevail.
Article 18 If Party B fails to pay the rent payable on time, it shall pay 20% of the rent payable as liquidated damages to Party A every day from the overdue date. If Party B is in arrears with the rent for more than 20 days, Party A unilaterally terminates the contract, and has the right to take back the house and hold Party B liable for breach of contract.
Article 19 This Agreement is made in quadruplicate, with Party A and Party B holding two copies respectively, all of which have the same legal effect.
Article 20 If there are any matters not covered in this Agreement, both parties may make supplementary provisions through consultation, which have the same effect as this Agreement. If the supplementary terms are inconsistent with the terms of this contract, the supplementary terms shall prevail.
Article 21 This Agreement shall come into force as of the date of signature by both parties.
