Measures of Changchun Municipality on Property Management of Residential Quarters
The term "property" as mentioned in these Measures refers to all kinds of houses, public supporting facilities and public * * * venues within the use scope of residential areas. Fourth Changchun City Real Estate Management Bureau is the administrative department in charge of property management in this Municipality, and its main responsibilities are:
(a) publicity and implementation of national, provincial and municipal laws, regulations and rules on property management;
(two) responsible for guiding the establishment of residential property management committee;
(three) in conjunction with the relevant departments to formulate the collection methods, standards and management regulations of special funds for property management in residential quarters;
(four) the development of property management contracts, conventions and other model texts;
(five) responsible for the qualification examination of property management enterprises;
(six) to participate in the demonstration and completion acceptance of the development and construction scheme of new residential quarters;
(seven) supervision, inspection and guidance of property management activities.
Construction Committee, Planning Committee, planning, urban construction, public utilities, civil affairs, health, environmental protection, public security, finance, prices, radio and television, electricity, telecommunications and other departments (hereinafter referred to as the relevant departments) and the people's government where the residential area is located shall, according to their respective functions and duties, be responsible for the relevant supervision and guidance of residential property management. Article 5 Property management enterprises shall gradually implement socialized and professional management mode and follow the principles of independent operation, paid service, self-financing and meager profit operation. Chapter II Residential Property Management Committee Article 6 A residential property management committee (hereinafter referred to as the CMC) shall be established.
Under the guidance of the administrative department of property management, the CMC is composed of representatives elected by the owners and users of houses in residential areas, and the total number of members is odd. Administrative Committee election measures shall be formulated separately by the Municipal People's government.
The director and deputy director of the CMC shall be elected by the CMC from among its members.
The residential area management committee established before the implementation of these Measures shall be directly reorganized into the residential area property management committee within the time limit approved by the property management administrative department; If the reorganization is indeed difficult, the CMC may be re-elected with the approval of the property management administrative department. Article 7 The Central Military Commission decides on issues and implements the principle that the minority is subordinate to the majority. Article 8 The rights of the CMC:
(a) to formulate the articles of association of the management committee and safeguard the legitimate rights and interests of owners and property users;
(two) decided to hire or renew the appointment of property management companies, on behalf of housing property owners, users to sign residential management contracts;
(three) to consider the use plan of special funds for property management and residential maintenance reserve;
(four) to consider the annual management plan of the property management enterprise system, and to decide on the major issues of the maintenance and management services of residential quarters;
(five) to inspect and supervise the property management of residential quarters by property management enterprises. Article 9 The obligations of the CMC:
(a) to safeguard the legitimate rights and interests of the owners and users of housing property rights and accept their supervision;
(two) shall not employ enterprises that do not have the qualification of property management to manage residential quarters;
(three) to protect and improve the environmental quality of residential quarters;
(four) accept the supervision and guidance of the administrative department of property management, relevant departments and the people's government where the residential area is located;
(five) to assist the property management enterprises to implement the relevant management work. Article 10 The CMC shall formulate the residential community convention through the owners' assembly and the users' assembly of the residential community.
The residential district convention is binding on all owners and users of houses, and is supervised and implemented by the management committee and property management enterprises. Chapter III Property Management Enterprises Article 11 Property management enterprises shall carry out property management of residential quarters in accordance with these Measures and the entrusted management contract of residential quarters.
The entrusted management contract shall include management items, management standards, management fees, rights and obligations of both parties, contract term and liability for breach of contract. The term of the entrusted management contract shall generally not exceed three years. After the expiration of the contract, if the CMC renews the contract, it shall re-sign the entrusted management contract.
The entrusted management contract shall be formulated by the administrative department of property management. Article 12 A property management enterprise shall meet the following conditions:
(1) Having a fixed office and business premises;
(2) Monetary funds with a registered capital of more than RMB 300,000;
(3) Having a legitimate business charter;
(four) there are a corresponding number of relevant professional and technical personnel required for property management;
(five) other conditions stipulated by the administrative department of property management. Thirteenth the establishment of a property management enterprise, must hold the application form and relevant materials to the property management administrative department for qualification examination, after passing the examination and obtaining the property management qualification certificate, can be entrusted to engage in residential property management business.
Property management enterprises established before the promulgation of these Measures shall, within 90 days from the date of promulgation of these Measures, apply to the property management administrative department for qualification examination and obtain the property management qualification certificate.
"Property Management Qualification Certificate" shall be subject to the annual examination system.
