Provisions on Vacant Houses in the New Property Law

Legal analysis: Vacant house refers to the house that the owner neither lives nor rents after the developer sells the house to the owner. In the past, the public service charges for vacant houses were agreed by the owners' committee after being approved by the owners' meeting, and were within the scope of government guidance prices announced by the local price authorities. Therefore, the specific needs to be determined in combination with relevant local laws and regulations.

Legal basis: Article 42 of the Regulations of People's Republic of China (PRC) Municipality on Property Management, the owner shall pay the property service fee according to the stipulations of the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement. The property service fee shall be paid by the property developer before the property is actually delivered to the buyer for possession, and shall be paid jointly by the owner and the buyer after the actual delivery.
