Chapter I General Provisions

Article 1 In order to strengthen the management of special maintenance funds for property in our city and ensure the maintenance and normal use of shared parts and facilities, the Measures for the Administration of Special Maintenance Funds for Residential Buildings and the Measures for the Administration of Special Maintenance Funds for Property in Jilin City are formulated in accordance with the Property Law of People's Republic of China (PRC) and the actual situation of this city.

Article 2 These Measures shall apply to the deposit, use, management and supervision of Yanji property special maintenance funds. The so-called property special maintenance fund (hereinafter referred to as special maintenance fund) refers to the funds specially deposited by the owner for the maintenance, renewal and transformation of property * * * facilities and equipment (hereinafter referred to as * * * facilities and equipment) after the warranty period expires.

Article 3 Special maintenance funds shall be stored in special accounts for special purposes, which shall be decided by the owners and supervised by the government.

Article 4 The property administrative department of Yanji City shall, jointly with the financial department, be responsible for guiding and supervising the deposit, use and management of special maintenance funds in this Municipality, and designate an institution to be responsible for the daily management of special maintenance funds.

Chapter II Deposit of Special Maintenance Funds

Article 5 The owners of the following properties shall deposit special maintenance funds in accordance with the provisions of these Measures:

(1) residence, except that it is owned by one owner and has no facilities and equipment used with other properties.

(2) Non-residential buildings in residential quarters or non-residential buildings connected with single residential structures outside residential quarters.

(3) Independent non-residential houses sold outside residential quarters.

Article 6 The first special maintenance fund shall be deposited by the owner according to the construction area of the property owned by him. According to the deposit standard of special maintenance funds for the first phase of the property, the average installation fee for multi-storey buildings is 5% per square meter, and that for small and high-rise buildings is 6% per square meter. In previous years, it was paid at 2.5% of the house price. Yanji city property department in conjunction with the municipal finance department can timely put forward the adjustment plan for the deposit standard of special maintenance funds, which will be promulgated and implemented after being approved by the Municipal People's government. The average construction and installation cost is calculated by the municipal property department in conjunction with the municipal finance department according to the actual construction and installation project cost completed in that year, and published regularly.

Article 7 Before handling the initial registration of house ownership, the construction unit shall deposit special maintenance funds in accordance with the total construction area of the property and the provisions of Article 6 of these Measures. The special maintenance funds are divided into down payment and supplementary payment, which will be collected from the owners when the property is delivered. The construction unit shall explain and stipulate this content to the purchaser as the terms of the purchase contract, and the special maintenance funds for unsold properties shall be collected from the owner when the property is sold.

Article 8 In 2008, the maintenance fund was publicly selected as the special maintenance fund management bank through bidding, and special maintenance fund users and regular special accounts were opened in the special maintenance fund management bank.

Article 9 To collect special maintenance funds, the maintenance fund management institution shall issue special bills under the unified supervision of the financial department, and the owners shall submit special bills deposited with special maintenance funds when handling the registration of house ownership.

Tenth before the establishment of the owners' congress or the owners' congress has not decided to implement the independent management of the owners, the special maintenance funds shall be managed by the maintenance fund management institution.

Eleventh owners should manage the special maintenance funds by themselves and authorize the property management company to manage them. The owners' meeting shall be convened. Proprietary part accounts for more than two-thirds of the total construction area and accounts for more than two-thirds of the total number of owners in the property management area. After the owners agree, the owners' meeting shall authorize the property company to be responsible for the daily management of special maintenance funds. The owners' committee shall handle the transfer procedures of special maintenance funds with the following materials to the local maintenance fund management institution, and report to the local property authorities for the record:

(a) a written report of the owner's independent management of special maintenance funds.

(two) the resolution of the owner authorizing the special maintenance fund of the property company.

(three) after the transfer of special maintenance funds by the account management unit.

(four) the use of special maintenance funds, the way to continue to raise funds and the emergency withdrawal plan.

(five) special maintenance fund account management system.

(six) other materials related to special maintenance funds.

The maintenance fund management institution shall, within 10 working days from the date of receipt of the above materials, notify the special account management bank to transfer the principal of the special maintenance fund and the regular value-added income to the special maintenance fund account opened by the owners' committee or the property management company in the special account management bank, and hand over the income and expenditure accounts and other relevant information to the owners' committee or the property management company.

Article 12 If the balance of the special maintenance fund of the owner's sub-account is less than 30% of the initial deposit amount, the owner shall continue to pay the maintenance fund in accordance with the following provisions.

(1) Where the special maintenance funds are in escrow, the maintenance fund management institution shall issue a notice of renewal of the special maintenance funds to the owners and send a copy to the owners' committee and community organizations, and the owners shall deposit the maintenance funds into the special maintenance fund account within 90 days from the date of receiving the notice of renewal.

(2) Where the special maintenance funds are managed independently, the owners' committee shall notify the owners of the renewal of maintenance funds according to the renewal plan adopted by the owners' congress; The owner shall deposit the maintenance funds into the special maintenance fund account according to the requirements of continuous traffic information.

(three) special maintenance funds can be collected by the realty service enterprise, the owners' committee or community organizations; The unit responsible for collection and delivery shall timely collect and deliver the details of special maintenance funds, publish them in the property management area, and send a copy to the maintenance fund management center.

Article 13 For the property that has not been established before the implementation of these Measures or has not been deposited with the first special maintenance fund in accordance with the regulations, our unit shall issue the Notice of Supplementary Construction of Special Maintenance Fund to the owners, and send a copy to the owners' committee, community organizations or property management companies. The owner shall, within 90 days from the date of receiving the notice of supplementary construction, deposit the maintenance funds into the special maintenance fund account in accordance with the deposit standards and methods stipulated in these Measures.

Fourteenth owners fail to renew or pay special maintenance funds in accordance with the provisions, the owners' committee or community organizations shall urge them to deposit; If the owners still fail to deposit it after being urged, the owners' committee may bring a lawsuit to the people's court according to law.
