Regulations of Nanchang Municipality on the Classification and Management of Domestic Waste

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Law of the People's Republic of China on the Promotion of Circular Economy, and the Regulations on the Administration of City Appearance and Environmental Sanitation, and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the classified delivery, classified collection, classified transportation, classified treatment and related supervision and management activities of domestic garbage within the administrative area of this Municipality.

The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated by units and individuals in their daily life or activities providing services for their daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations.

The management of industrial solid waste, construction waste, medical waste and animal carcasses shall be implemented in accordance with relevant laws, regulations and rules, and these Regulations shall not apply. Article 3 Domestic garbage in this Municipality is divided into the following four categories:

(1) Recyclable refers to domestic garbage suitable for recycling, including discarded paper, plastic, metal, glass, fabric, etc. ;

(2) Hazardous waste refers to the domestic garbage of domestic hazardous waste listed in the National Hazardous Waste List, including abandoned lamps and mercury products (thermometers, sphygmomanometers, etc.). ), batteries, medicines, films, paper, daily chemicals, paints, pesticides, disinfectants, mineral oil and other containers.

(3) Kitchen waste refers to perishable domestic waste containing organic matter, including discarded food materials, leftovers, expired food, melons, peels, Chinese medicine residues, tea residues, etc. And organic wastes such as vegetables, fruits, carrion, meat scraps, aquatic products and internal organs of livestock and poultry discarded by supermarkets, farmers' markets and agricultural products wholesale markets;

(4) Other garbage refers to other domestic garbage except recyclables, hazardous wastes and kitchen garbage. Article 4 The classified management of domestic waste shall adhere to the principles of government promotion, participation of the whole people, market operation, overall planning of urban and rural areas, suiting measures to local conditions and simplicity, and implement reduction, recycling and harmless management. Article 5 The municipal and county (district) people's governments shall strengthen the unified leadership over the classified management of domestic waste, establish a coordination mechanism for the classified management of domestic waste, and strengthen and co-ordinate the capacity building of classified management of domestic waste.

The municipal and county (District) people's governments shall incorporate the classified management of domestic waste into the national economic and social development plan, speed up the establishment of a domestic waste management system of classified delivery, classified collection, classified transportation and classified treatment, realize the effective coverage of the domestic waste classification system, and incorporate the special funds for domestic waste classification into the overall arrangement of the fiscal budget at the corresponding level. Sixth city and county (District) people's government department in charge of urban management is the competent department of domestic waste classification management within their respective administrative areas, responsible for the organization, coordination, guidance and supervision of domestic waste classification management.

The competent agricultural and rural departments of the people's governments of cities and counties (districts) shall, in accordance with the prescribed duties, supervise and manage the classified delivery, classified collection, classified transportation and classified treatment of rural domestic garbage within their respective administrative areas.

The competent commercial department of the people's government of the city or county (District) is responsible for the supervision and management of the recycling business activities of recyclable materials and the recycling of waste electrical and electronic products.

City, county (District) people's government real estate departments responsible for urging property service enterprises to carry out the work of domestic waste classification, the classification of domestic waste into the model text of the property service contract.

The competent department of ecological environment of the people's government of the city and county (District) is responsible for the supervision and management of the transportation and treatment of hazardous wastes and the supervision and management of the prevention and control of environmental pollution by domestic garbage disposal enterprises.

The education department of the people's government of the city and county (District) is responsible for promoting the classification of domestic waste in schools, and supervising and guiding the knowledge of domestic waste classification into the campus and classroom activities.

Municipal and county (District) people's government development and reform, finance, natural resources, urban and rural construction, administrative examination and approval, science and technology, state-owned assets, public security traffic control, Wenguang New Brigade, transportation, market supervision, government administration, health and other departments shall, according to their respective functions and duties, do a good job in the classified management of domestic waste. Seventh township (town) people's government, street offices responsible for the daily management of domestic waste classification within their respective jurisdictions.

Village (neighborhood) committees shall do a good job in the publicity of domestic waste classification, organize village (neighborhood) people to incorporate domestic waste classification into village rules and regulations, and cooperate with township (town) people's governments and sub-district offices to carry out domestic waste classification management. Article 8 Units, families and individuals shall fulfill their obligations of reducing the amount of domestic waste at the source and putting it in different categories according to law, and assume the responsibilities of the producers of domestic waste.

Organs, enterprises and institutions should play a leading role in the classification of domestic waste.

The relevant departments of the municipal and county (District) people's governments shall strengthen the management of product production and circulation process, avoid over-packaging, organize the listing of clean vegetables, and reduce the generation of domestic garbage.

Encourage social organizations, voluntary service organizations and volunteers to participate in the classified management of domestic waste, publicize the knowledge of domestic waste classification, and guide and demonstrate the classified delivery of domestic waste. Article 9 This Municipality supports the use of scientific and technological means to gradually improve the intelligent level of classified delivery, classified collection, classified transportation, classified treatment, supervision and management of domestic garbage.

Encourage research and development, introduction and application of new technologies, new processes, new materials and new equipment for the reduction, recycling and harmless treatment of domestic waste.
