Do communication base stations built in residential areas need to go through land formalities?

1. site selection application and identification: if it is really necessary to set up a mobile base station, it shall conform to the annual setting plan, and submit the setting plan of the mobile base station compiled by an engineering design unit with legal qualifications when applying to the relevant radio management organization. After the approval of the relevant radio regulatory agencies, the mobile base station location confirmation will be issued. If an independent mobile base station tower and computer room are set up, the relevant procedures shall also be handled in accordance with the provisions of relevant laws.

2. Notification of setting up mobile base stations: If an operator sets up a mobile base station on a civil building, it shall notify the owner or user of the relevant building of the location confirmation of the mobile base station 15 days before the establishment of the station. If the mobile base station is set to change the nature of the house, the operator shall report the setting of the mobile base station to the district and county planning and construction departments where the mobile base station is located for the record.

3. Royalty for the use of mobile base stations: If operators set up mobile base stations on civil buildings, they shall pay royalties to the property owners or other rights holders of the buildings. The purchase fee or lease fee for setting up a mobile base station computer room on a civil building shall be determined through consultation between the operator and the property owner or other obligee of the building.

4. Compensation Agreement for Installation of Mobile Base Station Antenna and Management of Royalty: Where an operator installs a mobile base station antenna on a civil building, he shall sign a compensation agreement for installation of the mobile base station antenna with the property owner or other obligee of the building according to the Royalty Standard, and pay the Royalty as agreed.
